    In the German industrial relationship, worker organization consists of a dual structure; one is trade union, the other is works council. While trade unions as industrial well-organized represent a workers interest apart from workplace, works councils are autonomously organized at workplace, but, lacking in the power of collective bargaining including dispute right, etc., have an ambiguous character between management organization and class one. Most of the German industrial relationship is determined by the dynamics among employers, trade unions, and works councils. And the institutionalization of that dynamics is the codetermination. The main provisions of the codetermination include, for examples, an obligatory founding of the works council in all the German companies and worker delegates participation on the supervisory board which has an power of inspection about management. As the survival of each national state faced catastrophic situations of political crisis, all democratic states revealed authoritarian figures through several dictatorial decision making styles, even though such a political behavior has been maintained over the duration of such crisis. In a nutshell, both the modem democracy and the political dictatorship may be analogized as twins that were born from the same womb. On the basis of that hypothesis, this article examines another aspect of constitutionalism by focusing on the reasoning of Carl Schmitts sovereign dictatorship. Furthermore, it has an other aim which is to critically reinterpret the political principle of the Yushin Constitution during Koreas fourth republic that seems to have been influenced greatly by Carl Schmitts political theory of sovereign dictatorship
