The bottom of such a social acceptance of the mentally ill person in our society has the solid measures supported by the diverse legal mechanism. The legal mechanism does not only socially exclude the mentally ill persons, but also include them. For example, the mental illness might be a cause of divorce, dismissal, and involuntary hospitalization. Yet the mental illness also might be a cause for the person to receive the welfare systems aid, i.e. social security benefits, and social welfare services. Also in civil and criminal laws a mentally ill person shall be limited to only certain capacity level for civil or criminal conduct, allowed to receive guardian help together with proper treatment-protection, and excused to take less civil and criminal responsibility. The mentally ill person shall face diverse law and systematic measures against him in his social lives. Involuntary hospitalization in mental health law, guardianship system in civil law, and treatment-protection system in criminal law are a few of them, all of which might need the proper bases of law, for they deprive certain capabilities of the mentally ill person and limit his freedom of physical body. The social exclusion of mentally ill persons makes law system measures work against them and also such a social understanding does the law system measures sustained or maintained much stronger. However, establishing the law enforcements or social systems for helping the mentally ill persons has been made rather slowly. Even though social exclusion has become our legal attitude against the mentally ill persons, sovereign power needs their existence in much deeper level and exercises its efforts to control and manage them. For example, sovereign power establishes the system of involuntary hospitalization of the mentally ill persons but pays for the costs of their existence and medical treatment through social welfare system. In other words, it keeps the law system measures not only to exclude the mentally ill persons socially but also to include them. The purpose of this thesis aims at integrative and systematic understanding of issues dealing with the mentally ill persons by focusing diverse subjects suggested through law study realms and related issues of which they must face in actual life in light of the mental health law. By observing as basic resources some historical facts in the past, the processes of law establishment and its reestablishment, interpretation and enforcement of laws, this thesis scrutinizes the formation and change of diverse legal treatments such as confinement system, guardianship system, treatment-protection system, social welfare system, and so forth which consist of law enforcements for the mentally ill persons. And then I try to re-illuminates the results in light of the social security law by specifying related law principles which regulate the mentally ill persons. Through observing the law enforcements for the mentally ill persons, this thesis tries to reveal our current legal treatment as the state of social exclusion and show our future orientation as social cohesion by suggesting concrete law principles and the following principles as realization methods: 1) Realistic affirmation of self decision-making rights and procedural participation rights 2) Reducing the range of social exclusion systems and edifying social cohesion 3) Transformation of the concept of mentally ill persons as social danger into the concept of the mentally disabled persons 4) Reestablishment of nation's roles toward the mentally ill personsDocto
