A Study on Maritime Strategy of the Jeju Naval Task Flotilla and it′s Commitment for Ocean Sovereignty

Accounting for 70% of global surface, the sea would never be enough to be emphasized for our everyday life as source of foods and line of communication. Maritime conflicts among Republic of Korea, China, and Japan on Yi-eo Do, southernmost island of the Republic of Korea, and the island-containing South China Sea persist, and, at the same time, national competitions unclearly drawn by regional issues for safeguarding own maritime sovereignty, such as drawing border of Exclusive Economic Zone, continental shelf, and Territorial Seawater Base Line, continue. Especially, the Republic of Korea has failed to setting borders of continental shelf with China and Japan, raising concerns and likelihood of potential conflicts on overlapped jurisdiction over the area among the states. China and Japan have fortified their maritime strategies and strengthened their own naval capabilities mainly for securing maritime hegemony on East and South China Sea. Against the backdrop, the Republic of Korea Navy decided to place a naval base at Gangjeong-Dong, Seoguipo-Si in Jeju Island, in order to exert its best efforts for response to new martime security threats, solidification of national security by maritime activities in vicinity of Southern Jeju Island, and protection of sovereignty rights, thereby stationed Maritime Task Flotilla capable of maritime power projection. Given condition of increasing needs for swift response to various threats in waters, developed countries has put their best efforts to strengthen maritime security and secure national interests through consistent development of naval power. But, the Republic of Korea has failed in understanding significance of maritime security and national interests up to now and undergone many of cacophonies in development of naval base in Jeju island for upholding these values. The issue related to the base construction has been centered on various social conflicts involving the government, military, residents of Jeju island. scholars, politicians, and even religious circle. In order to seek any course of action to overcome these situations, critical meanings of vessels assigned under Jeju Naval Task Flotilla in the aspects of maritime and national securities are defined, and justification of establishment of the naval base and military activities was reviewed by verifying the international maritime law, such as right of visit for inspection and hot pursuit given to jurisdiction. Unlike Chinhae or Busan naval base, Jeju naval base allows the Republic of Korea Navy to shorten responding time against military provocation in vicinity of NLL by North korea and any types of maritime contingency occurred on the South Korean Waters and its near sea. In addition, the base will be very effective to monitor and respond to maritime activities of neighboring countries including China continuing its military presence using Naval Ship, Government ship, and aircrafts at the waters near Yi-eo Do in accordance with its claim of maritime border expansion. The Republic of Korea Navy is capable of conducting swift operations at every waters near the Korean Peninsula, and Naval forces of Jeju Naval Task Flotilla are capable of conducting multifaceted operations including anti-submarine, anti-surface, and anfi-aircraft. 한 국가의 지식정보의 강국 및 자산화는 유능한 연구인력, 우수한 연구실험 인프라, 그리고 최적의 지식정보자원이 투입되어 시너지 효과를 발휘할 때 연구생산성이 제고되고 지식정보의 축적량이 누적될 때 구현 될 수 있다. 그 중에서 지식정보자원은 모든 연구개발의 원동력에 해당되며 이를 관장하는 학술연구도서관은 모든 지식정보자원의 축적이며 지식정보자원의 바탕이며 보루이다. 그런면에서 대학도서관을 대학의 심장이라 지칭하였고 대학의 연구경쟁력을 좌우하는 첨병이라고 표현하였다. 최근의 도서관계 상황을 학술 커뮤니케이션의 위기 상태라고 비유하고 있다. 그것은 학술지의 구독비용이 대학도서관의 예산 증가율을 상회함에 따라 학술 및 연구자료의 접근력이 축소되거나 상실되는 상황을 의미하며 이는 곧 대학의 연구력과 경쟁력을 저하시키는 요인으로 직결될 수 있다는 것이다. 전통적으로 대학도서관의 연속간행물 선정은 이용자의 요구, 연속간행물의 지명도, 예산을 고려해 결정되는 만큼 특수한 상황이 발생되지 않는 한 변동없이 재구독 하는것이 일반적이다. 하지만 구독료 인상으로 인한 구매력 약화와 예산의 삭감은 핵심에서 벗어난 주변영역 연속간행물 구독 취소를 요구하고 있고 상대적으로 이용빈도가 낮은 연속간행물은 구독 취소 대상의 우선순위가 되는 것이 현실적인 정책이 되고 있다. 본고에서는 이러한 현실을 극복하고 가장 효율적인 학술지 구독을 위하여 우리도서관에서 구독중인 학술지를 정밀 분석, 평가하여 문제점과 낭비요인을 진단하고 비용대 효과 면에서 비교우위를 점하고 있는 핵심장서 개발에 역점을 둔 수서정책으로 전환하는 계기를 마련하고자 한다

Une etude sur Les actes administratifs en droit administratif francais

Un des sujets qui attirent beaucoup d'attentions des professeurs de droit public ces jours-ci, c'est l'amendement de la loi de contentieux administratif. On pense en général que la présente loi adoptée en 1984 est insuffisante pour la protection des individus lésés de leurs droits par les actes illégaux dans plusieurs points; d'où la nécessité de son amendement. Par conséquent, l'effort se porte essentiellement sur l'amélioration de la situation des individus dans le projet de l'amendement de la loi. On essaie notamment d'élargir objets de recours pour annulation de même que l'intérêt pour agir. C'est bien naturel dans ce contexte que le recours pour excès du droit français ainsi que les actes administratifs qui font objets de ce recours attirent l'attention vive des professeurs et des praticiens. Cet article a pour but de donner une idée précise et concrète du régime des actes administratifs en droit français. Nous avons d'abord procédé à l'étude de l'économie générale des actes administratifs en droit français. Dans cette optique, nous avons examiné la notion générale de l'acte administratif, les actes individuels et règlementaires comme deux catégories de l'acte administratif de même que l'intérêt de leurs distinctions. Nous avons ensuite procédé à l'étude concrète de l'acte administratif. Nous avons d'abord examiné les actes non règlementaires ou individuels au sens large; nous avons examiné les actes individuels stricto sensu, les actes collectifs et les actes particuliers comme les actes individuels. 행정처분의 발급을 구하는 쟁송제도

사인이 관계법에 기하여 행정청에 일정한 처분(허가·면허·특허 등)의 발급을 신청한 경우에 있어, 행정청이 이를 위법하게 거부하거나 방치(부작위)하는 경우에 당사자는 궁극적으로 쟁송에 의하여 그 당해 처분의 발급을 확보할 수 있어야 할 것이다. 본고에서는 이러한 경우에 있어서의 우리나라에서의 행정처분의 발급을 구하기 위한 쟁송수단에 관하여 검토하려고 하는 것이다. 행정처분의 거부 또는 부작위에 대하여 그 발급을 구할 수 있는 가장 실효적인 소송수단은 의무이행소송인 바, 그 대표적인 형태가 독일의 연방행정재판소법이 규정하고 있는 것이다. 이러한 의무이행소송에 대하여 우리의 행정소송법은 명시적 규정을 두고 있지 않으나, 해석상으로 이 소송은 이른바 「무명항고소송」또는「비법정항고소송」으로 인정될 수 있는 소지가 있다 할 것이다. 그러나 현재로는 이 소송형태를 인정한 판례는 없다. 전술한 바와 관련하여 이하 본론에서는 먼저 의무이행소송에 관하여 독일의 법례를 개관하고 우리나라에서의 그 허용성의 문제를 간단히 검토하기로 한다. 이어서 우리 행정심판법 및 행정소송법상의 행정처분의 발급을 구하기 우한 쟁송수단에 관하여 구체적으로 검토한다

종래 행정행위에 대한 부관의 문제는 민법상의 부관에 상응하는 관념으로서 기본적으로 민법상의 법리에 따라 검토될 수 있는 문제로 보아서, 별다른 관심의 대상이 되지 못하였던 것이 사실이다. 그러나 비교적 최근에 들어 주로 독일에서의 학설상의 논의의 영향을 받아, 행정행위에 대한 부관의 문제는 그에 고유한 여러 측면이 있다는 인식을 가지게 되어, 이에 관한 연구가 논의가 비교적 활발하게 전개되었다. 이러한 새로운 시각에서 제기되고 논의된 문제로서는 부관의 관념, 부관을 붙일 수 있는 행정행위의 종류, 부관에 대한 쟁송가능성의 문제 등을 들 수 있을 것이다. 또한 부관의 종류와 관련하여서는, 부담의 부관성의 문제가 일용 외형상으로는 중요한 하나의 논점으로 제기되고 있으나, 이 문제는 그 실제와는 다르게 문제성이 과도하게 표출되어 있다고 본다. 이러한 부관에 대하여는 필자는 이미 다른 논문에서 상당히 구체적으로 다룬 바 있었으나, 이 글에서는 지면상의 제한으로 기본적으로 부관의 관념과 부담을 중심으로 하여 검토한 것이었다. 그러나 부관에 관하여 제기되는 문제는 이들 문제에 한정되는 것이 아닌 것임은 물론이다. 그에 따라 본고에서는 보다 종합적 관점에서 이 문제를 검토하여 보려고 하는 것이다. 이러한 본고의 검토시각에 따라, 이전 논문에서 다루었던 문제도 부분적으로 중복적으로 검토되고 있는 것임을 밝혀둔다
