    Negative and positive integration in EU criminal law co-operation

    The distinction between negative and positive integration that has played a pivotal role in understanding the dynamics of the common market is also instrumental in explaining the dynamics of criminal law co-operation in the EU. Despite manifold differences between common market governance and criminal law cooperation, the introduction of mutual recognition as the lead principle has privileged the abolition of obstacles to cross-border law enforcement (negative integration) over the adoption of common standards (positive integration). As an analysis of the measures taken thus far demonstrates, criminal law cooperation has been biased towards law enforcement at the expense of individual rights

    Between military efficiency and democratic legitimacy. Mapping parliamentary war powers in contemporary democracies, 1989-2004

    Parliamentary approval can be of crucial importance to ensure the democratic legitimacy of military operations as it can establish public consent to the executive's use of force. But involving parliament in decisions to deploy military forces may have negative repercussions on the efficiency of operations, e.g. by slowing down decision-making. As the military activity of democracies has been on the rise since the end of the Cold War, democracies around the world have been increasingly pressed to deal with this trade-off between legitimacy and efficiency in sending troops abroad. This paper surveys the deployment provisions of 49 contemporary democracies to establish whether and how parliaments are actually involved in deployment decisions. It demonstrates that the rules for parliamentary participation mark a continuum that ranges from complete exclusion to a comprehensive veto position of parliament over all potential deployments. In between these two extremes, democracies have found a wide variety of solutions to cope with the legitimacy-efficiency problem. Despite the growing prevalence of military deployments, there is no discernible trend towards parliamentarisation, however. Rather the trend towards internationalisation of security policies contributed to a weakening of parliamentary powers in some countries. © 2010 The Author

    ABSTRACT The creation of the Single European Market has been accompanied by an intense discussion on whether market-creating measures have been privileged over market- correcting ones by the institutional system of the EU. The creation of an ‘Area of Freedom, Security and Justice' (AFSJ) launched by the Treaty of Amsterdam poses a similar question which, however, has remained heavily under-researched: will the balance between policing competencies and individual rights shift towards the former at the expense of the latter? Recent work on the ‘new raison d'e ́tat' and the strengthening of national executives in processes of Europeanisation points in this direction. This essay explores the parallels between the Common Market and the AFSJ with regard to the relationship between the structures and substance of governance. The balance between security and individual rights is scrutinised in the main pillars of the AFSJ: asylum cooperation, judicial cooperation in criminal matters and police cooperation

    War and Punitivity under Anarchy

    The individualization of punishment is a key element in liberal narratives about international law and international relations. By now, this narrative has become integral part of positive international law, especially the regimes governing the use of force and the prosecution of international crimes. Rather than punishing states or entire societies, liberals claim, punishment has become restricted to those who incurred individual guilt. To liberals, the individualization of punishment is part of a larger process of enlightenment and civilizations that has helped to fence atavisms like revenge. In this paper, we do not question the emergence of an ever more sophisticated system of individual punishment in international law. However, we argue that punitivity has been more difficult to fully channel towards individuals and away from collectives than claimed. To be sure, punitive language has by and large been banned from the laws of armed conflict. We argue, however, that the absence of a punitive vocabulary does not equal the absence of punitivity. In contrast, current state practices of using armed force are still imbued with punitivity, however silenced in the current legal framework and thus pushed underground. Realizing the presence of a punitive undercurrent, we argue, adds to a more comprehensive understanding of contemporary state practices

    Gender differences in tumor characteristics, treatment allocation and survival in stage I–III pancreatic cancer:a nationwide study

    Introduction: Sex and gender are modulators of health and disease and may have impact on treatment allocation and survival in patients with cancer. In this study, we analyzed the impact of sex and gender on treatment allocation and overall survival in patients with stage I-III pancreatic cancer. Methods: Patients with stage I-III pancreatic cancer diagnosed between 2015 and 2020 were selected from the nationwide Netherlands Cancer Registry. Associations between sex and gender and the probability of receiving surgical and/or systemic treatment were examined with multivariable logistic regression analyses. Overall survival was assessed with log rank test and multivariable Cox proportional hazard analysis. Results: Among 6855 patients, 51.2 % were female. Multivariable logistic regression analyses with adjustment for known confounders (age, performance status, comorbidities, tumor location, tumor stage and previous malignancies) showed that females less often received systemic chemotherapy compared to males (OR 0.799, 95 %CI 0.703–0.909, p &lt; .001). No difference was found in the probability for undergoing surgical resection. Furthermore, females had worse overall survival compared to males (median OS 8.5 and 9.2 months respectively, 95 %CI 8.669–9.731). Conclusion: This nationwide study found that female patients with stage I-III pancreatic cancer significantly less often received systemic treatment and had worse overall survival as compared to males. Disparities in pancreatic cancer care can be decreased by recognizing and resolving potential obstacles or biases in treatment decision-making.</p
