Zoning code of Social Housing in Metropolitan Lima: Exclusionary zoning and infringement of the right to housing
The objective of this article is to analyze the role of urban planning and building parameters in guaranteeing the right to adequate housing in Metropolitan Lima, with emphasis on social housing (SIV). To this end, we develop a state of the art on the urban regulation of SIV until December 2022, which shows that there is no consensus among the different levels of government regarding the mechanisms to promote the production of SIV and guarantee the right to housing. Then, we analyze the impact of urban and building parameters on the right to housing and other legal rights and goods.Based on this analysis, we present two arguments.First, we argue that the urban and building parameters approved by the municipalities of Metropolitan Lima represent a case of exclusionary zoning, as they limit or prohibit the production of SIV in areas with greater access to services and facilities. The second argument is that the incentives of the Special Regulation –i.e., the table of SIV parameters– do not guarantee the right to housing because they do not ensure adequate access to services and facilities for SIV beneficiaries.El artÃculo tiene como objetivo analizar el rol que cumplen los parámetros urbanÃsticos y edificatorios para garantizar el derecho a una vivienda adecuada en Lima Metropolitana, con énfasis en la vivienda de interés social (VIS). Para ello, desarrollamos un estado de la cuestión sobre la regulación urbanÃstica de la VIS hasta diciembre de 2022, lo cual demuestra que no hay consenso entre los distintos niveles de gobierno respecto a los mecanismos para fomentar la producción de VIS y garantizar el derecho a la vivienda. Luego, analizamos el impacto que tienen los parámetros urbanÃsticos y edificatorios en el derecho a la vivienda y en otros derechos y bienes jurÃdicos.A partir de este análisis, presentamos dos argumentos.Primero, sostenemos que los parámetros urbanÃsticos y edificatorios aprobados por las municipalidades de Lima Metropolitana representan un caso de zonificación exclusionaria, pues limitan o prohÃben la producción de VIS en las áreas con mayor acceso a servicios y equipamientos. El segundo argumento es que los incentivos del Reglamento Especial –es decir, el cuadro de parámetros de la VIS– no garantizan el derecho a la vivienda pues no aseguran un acceso adecuado a servicios y equipamientos para los beneficiarios VIS
