    Statistical Analysis of Federal District Court Cases Seeking Longer Patent Term Adjustments in the Wake of Wyeth v. Kappos, 10 J. Marshall Rev. Intell. Prop. L. 1 (2010)

    Over 175 Federal District Court cases filed from September 2008 through July 2010 were analyzed to determine common features noted by applicants seeking longer patent term adjustments (“PTAs”) in view of a Federal District Court ruling, later affirmed by the U.S. Court of Appeals for the Federal Circuit in Wyeth v. Kappos, which held that the United States Patent and Trademark Office (“PTO”) misinterpreted a statute relating to the calculation of PTAs involving overlapping periods of delay attributable to the PTO or to the applicant. Applicant and PTO errors in calculating PTAs were common, often relating to counting errors due to the mischaracterization of events that occur at the beginning or end of specific delay periods. Asymmetries were also noted in the treatment of delay periods encountered in the prosecution of national phase applications based on earlier-filed international applications, compared to applications which take priority only to earlier-filed U.S. applications. Common patterns of delay were noted, and practices that minimize Applicant Delay, maximizing effective PTA, are highlighted. Despite the intent of Congress to compensate applicants for delays in prosecution in an industry-independent manner, applicants seeking reconsideration of a patent term adjustment in Federal District Court are highly-biased toward institutions seeking patents on pharmaceutical and related biotechnology inventions. Unlike patent term extensions, which are sought in a six-month period prior to regulatory approval and sale of a pharmaceutical product, and often long after a patent has issued claiming the product, court cases identifying patents needing longer PTAs provide early notice to the public, including investors and competitors, of technologies considered to have particular value to the applicant. Understanding the complex calculations behind PTAs, patent term extensions, and expiration dates, is key to the development of successful scientific, legal, and business strategies involving licensing and ownership of patented technologies

    Quantum simulation of multiple-exciton generation in a nanocrystal by a single photon

    We have shown theoretically that efficient multiple exciton generation (MEG) by a single photon can be observed in small nanocrystals (NCs). Our quantum simulations that include hundreds of thousands of exciton and multi-exciton states demonstrate that the complex time-dependent dynamics of these states in a closed electronic system yields a saturated MEG effect on a picosecond timescale. Including phonon relaxation confirms that efficient MEG requires the exciton--biexciton coupling time to be faster than exciton relaxation time

    Comparison between bioactive sol-gel and melt-derived glasses/glass-ceramics based on the multicomponent SiO2-P2O5-CaO-MgO-Na2O-K2O System

    Bioactive sol-gel glasses are attractive biomaterials from both technological and functional viewpoints as they require lower processing temperatures compared to their melt-derived counterparts and exhibit a high specific surface area due to inherent nanoporosity. However, most of these materials are based on relatively simple binary or ternary oxide systems since the synthesis of multicomponent glasses via sol-gel still is a challenge. This work reports for the first time the production and characterization of sol-gel materials based on a six-oxide basic system (SiO2-P2O5-CaO-MgO-Na2O-K2O). It was shown that calcination played a role in inducing the formation of crystalline phases, thus generating glass-ceramic materials. The thermal, microstructural and textural properties, as well as the in vitro bioactivity, of these sol-gel materials were assessed and compared to those of the melt-derived counterpart glass with the same nominal composition. In spite of their glass-ceramic nature, these materials retained an excellent apatite-forming ability, which is key in bone repair applications

    A guided walk through the world of mesoporous bioactive glasses (MBGs): Fundamentals, processing, and applications

    Bioactive glasses (BGs) are traditionally known to be able to bond to living bone and stimulate bone regeneration. The production of such materials in a mesoporous form allowed scientists to dramatically expand the versatility of oxide-based glass systems as well as their applications in biomedicine. These nanostructured materials, called mesoporous bioactive glasses (MBGs), not only exhibit an ultrafast mineralization rate but can be used as vehicles for the sustained delivery of drugs, which are hosted inside the mesopores, and therapeutic ions, which are released during material dissolution in contact with biological fluids. This review paper summarizes the main strategies for the preparation of MBGs, as well as their properties and applications in the biomedical field, with an emphasis on the methodological aspects and the promise of hierarchical systems with multiscale porosity

    1974 Preliminary Report of Kentucky Small Grain Variety Trials at Bowling Green and Lexington

    Each year the small grain variety trials are conducted at Princeton, Murray, Bowling Green and Lexington. In 1974, the plots at Princeton and Murray were severely infected with a complex of diseases including Barley Yellow Dwarf, Septoria glume blotch, wheat scab and an unidentified disease in the wheat. As a result of the intensity of these diseases, the data obtained from these plots was very erratic and the results were not considered to be experimentally valid. The data obtained at Bowling Green and Lexington were quite valid and representative of the general situation in Kentucky
