    Resource-Saving Technologies of Treatment of Polluted Washing Water for Transport Companies

    Dedicated to the development of resource-saving polluted washing water treating technologies for transport companies. The article suggests methods of water purification with regard to scientifically grounded requirements to the quality of the water used and the required degree of purification and The article also considers the method of selecting efficient methods of sewage water treating, when a selective removal of individual polluting ingredients should be done. For this purpose we have conducted a simulation process of treating polluted washing water in the circulating water systems, and provided solutions for refining the process parameters

    Patent Citations and International Knowledge Flow: The Cases of Korea and Taiwan

    This paper examines patterns of knowledge diffusion from US and Japan to Korea and Taiwan using patent citations as an indicator of knowledge flow. We estimate a knowledge diffusion model using a data set of all patents granted in the U.S. to inventors residing in these four countries. Explicitly modeling the roles of technology proximity and knowledge decay and knowledge diffusion over time, we have found that knowledge diffusion from US and Japan to Korea and Taiwan exhibits quite different patterns. It is much more likely for Korean patents to cite Japanese patents than US patents, whereas Taiwanese inventors tend to learn evenly from both US and Japanese inventors. The frequency of a Korean patent citing a Japanese patent is almost twice that of the frequency of a Taiwanese patent citing a Japanese patent. We also find that a patent is much more likely to cite a patent from its own technological field than from another field.

    Can Post-Grant Reviews Improve Patent System Design? A Twin Study of US and European Patents

    This paper assesses the impact of adopting a post-grant review institution in the US patent system by comparing the “opposition careers” of European Patent Office (EPO) equivalents of litigated US patents to those of a control group of EPO patents. We demonstrate several novel methods of "twinning" US and European patents and investigate the implications of employing these different methods in our data analysis. We find that EPO equivalents of US litigated patent applications are more likely to be awarded EPO patent protection than are equivalents of unlitigated patents, and the opposition rate for EPO equivalents of US litigated patents is about three times higher than for equivalents of unlitigated patents. Patents attacked under European opposition are shown to be either revoked completely or narrowed in about 70 percent of all cases. For EPO equivalents of US litigated patents, the appeal rate against opposition outcomes is considerably higher than for control-group patents. Based on our estimates, we calculate a range of net welfare benefits that would accrue from adopting a post-grant review system. Our results provide strong evidence that the United States could benefit substantially from adopting an administrative post-grant patent review, provided that the post-grant mechanism is not too costly

    Competition, Innovation and Racing for Priority at the U.S. Patent and Trademark Office

    The U.S. Patent and Trademark Office resolves patent priority disputes in patent interference cases. Using a random sample of cases declared between 1988 and 1994, we establish a connection between patent interferences and patent races, and then use the data to consider some key issues in dynamic competition and innovation. We look at the incidence and distribution of patent races by technology, evidence for strategic delay of innovation by incumbent firms, and evidence that patent races moderate incentives to delay.     Effects of Patent Length on R&D: A Quantitative DGE Analysis

    This paper develops an R&D-growth model and calibrates the model to aggregate data of the US economy to quantify a structural relationship between patent length, R&D and consumption. Under parameter values that match the empirical flow-profit depreciation rate of patents and other key features of the US economy, extending the patent length beyond 20 years leads to a negligible increase in R&D despite equilibrium R&D underinvestment. In contrast, shortening the patent length leads to a significant reduction in R&D and consumption.     The Interpretation-Construction Distinction in Patent Law

    The ambiguity of claim language is generally considered to be the most important problem in patent law today. Linguistic ambiguity is believed to cause tremendous uncertainty about patent rights. Scholars and judges have accordingly devoted enormous attention to developing better linguistic tools to help courts understand patent claims. In this article, we explain why this diagnosis is fundamentally wrong. Claims are not often ambiguous, and linguistic ambiguity is not a major cause of the uncertainty in patent law today. We shall explain what really causes the uncertainty in patent rights, how the erroneous diagnosis of linguistic ambiguity has led the literature off-track, and what will get us back on track to solving the uncertainty problem
