Federal Civil Jurisdiction of Military Justice

    Get PDF
Control exercised by the federal civil courts over courts-martial differs from that found in other types of cases involving the relation of federal and state courts. The federal civil courts are constitutional courts; the military courts are administrative courts established by Congress and empowered by the Constitution; while state courts receive their power from entirely different sovereigns. Thus, to determine the powers of review which federal civil courts have over courts-martial, reference must be made almost exclusively to cases involving courts-martial

Deep Learning Based Forecasting-Aided State Estimation in Active Distribution Networks

Operating an active distribution network (ADN) in the absence of enough measurements, the presence of distributed energy resources, and poor knowledge of responsive demand behaviour is a huge challenge. This paper introduces systematic modelling of demand response behaviour which is then included in Forecasting Aided State Estimation (FASE) for better control of the network. There are several innovative elements in tuning parameters of FASE-based, demand profiling, and aggregation. The comprehensive case studies for three UK representative demand scenarios in 2023, 2035, and 2050 demonstrated the effectiveness of the proposed approach

The Rise and Fall of the Original Lone Star State: Infant American Imperialism Ascendant in West Florida

    Get PDF
To many scholars, the West Florida Revolt of 1810 served merely as a transitional period in American history. Referenced as a time when a few social elites rose to challenge Spanish colonial authority in southeastern Louisiana, the West Florida Revolt has been viewed as a necessary step in the annexation of the territory by the United States. Recent research suggests this perspective should be qualified. Much like the Republic of Texas, the Republic of West Florida exhibited characteristics common to more successful independent states, including a functioning written constitution, a judicial system, a treasury, an army, and important elements of foreign policy. Rather than focus on the eventual annexation of the region, this article examines how a faction of the social elite of West Florida was able to stage a successful revolt, develop a government while still under Spanish control, and build an independent nation, despite the many obstacles faced by those involved. Understanding this process provides a different context for evaluating the eventual submission of the Republic to infant American imperialism and nation building in the Americas during the nineteenth century overall

Interethnic Antagonism In the Wake of Colonialism: U. S. Territorial and Ethnic Relations at the Margins

Since the proliferation of scholarship on racial and ethnic antagonism following the Civil Rights era, neo-Marxist, colonialism, and other power-conflict theories reached popularity and have been widely applied to explain racial and ethnic conflict throughout the world, particularly in the United States. However there is a lack of scholarship on racial and ethnic relations in the U.S. territories in general and the Pacific Islands in particular. Although a few works exist in terms of interethnic antagonism and anti-immigrant sentiment in Puerto Rico, Melanesia, and Hawaii, there is a lack of research on interethnic antagonism in Micronesia; therefore comparative analyses of race and ethnicity in the context of U.S. territorial relations would contribute to the general body of knowledge in ethnic studies. In light of Micronesia\u27s complex colonial history and its contemporary political and economic context (i.e. immigration, labor exploitation, territorial relations, neocolonialism, indigenous sovereignty struggles, and garment, tourist, and construction industries), understanding of intergroup relations in Micronesia would also benefit from an analysis of interethnic antagonism

An analysis of the legal problems and issues arising from the European Union's current anti-dumping legislation with regard to the People's Republic of China

On 27 April 1998, the European Union (EU) removed the People's Republic of China from its list of non-market economies (NMEs) due to the progress made under China's economic reforms. After that, it has applied a hybrid anti-dumping policy towards imports from China, including the use of the analogue country method, conditional market economy treatment, one country one duty rule and individual treatment. However, there has been no significant change as far as the EU anti-dumping authority's practice is concerned. This is inconsistent with China's current economic status as a transitional economy with many sectors very close to a market economy. This thesis analyses the implementation of the policy and explores its legal problems and issues from both a theoretical and practical standpoint. The study begins by examining the origin of EU anti-dumping legislation - the General Agreement on Tariffs and Trade (GATT) anti-dumping rules. It identifies the legal problems of EU anti-dumping practice in the context of China's economic reforms starting from 1979. In order to suggest solutions to several of the problems thus identified, comparative studies are made to reveal alternative strategies by illustrating the anti-dumping legislation of the U.S, Australia, New Zealand and Japan insofar as it is applicable to China. Due to China's accession to the World Trade Organization (WTO) on 11 December 2001, new issues and disputes may arise with regard to the EU's anti-dumping practice. With regard to all of these issues, this thesis finally attempts to propose solutions to both the EU and China
