    The purpose of this Comment is to investigate the current effect of both the FECL and the AML on TICs.\u276 It begins with a historical analysis of past applications of these laws to TICs. It then discusses the current terms of the AML and the FECL, the government\u27s application of these terms to TICs, and the effect of this application on the formation of TICs. This Comment concludes that, although the means of regulation has changed and there has been some liberalization, the FECL and the AML continue to create substantial prejudicial effects for the interests of foreign parties to TICs in Japan, especially in the case of cross-licensing agreements for certain types of technology

    Bundling Economics Under Adverse Selection in the Individual Health Insurance Market

    We examine the impact of bundling strategies on the level of consumer participation and premium rates realized in an individual health insurance market characterized by an adverse selection problem. In this context we show that society may use private insurers to attain universal coverage at equitable premiums under a pure bundling strategy, where insurers offer only a comprehensive policy to the market. This result is strengthened as the number of medical conditions covered in the comprehensive policy increases and as applicant risk aversion increases. When insurance applicants exhibit low levels of risk aversion a mixed bundling strategy (or offering single-disease policies along with the comprehensive policy) improves consumer participation and decreases premium rates when compared to a pure bundling strategy. In this case market performance is improved by increasing policy options offered to applicants. Alternatively, when insurance applicants exhibit moderate levels of risk aversion a mixed bundling strategy reduces consumer participation and increases premium rates when compared to a pure bundling strategy. In this case market performance is improved by reducing policy options offered to applicants. In addition, when insurance applicants exhibit sufficiently high levels of risk aversion the consumer participation and premium rates realized under a pure bundling strategy and mixed bundling strategy converge toward full market participation. Finally, under all levels of risk aversion we show that offering an exclusion policy along with the comprehensive policy decreases consumer participation

    Method and apparatus for power plant simulation and optimization

    A system for simulating and optimizing a powerhouse designed to furnish electrical power to a process plant which incorporates a plurality of units for simulating operation of the individual components of the powerhouse, and for calculating the cost of operation of the system as a whole, including the cost of fuel for the powerhouse components and the cost of purchased power needed to satisfy the power demand of the process plant beyond the capacity of the powerhouse. An adaptive search routine varies all of the operative parameters of the powerhouse, on a random basis, and repeats the simulation in order to identify a combination of parameters which represents a lower cost solution. The range of random variation is reduced, as lower cost solutions are not found within a given number of repetitions, in order to identify a precise convergence on the optimum solution. The procedure may be restarted, and repeated many times, with the range of variation each time initially at maximum, in order to insure the identification of the global optimum

    Mastitis in two herds managed as a comparison between organic and conventional dairy farming systems was monitored for 9 years utilising regular bacterial culture of milk samples, individual and bulk somatic cell counts and observation by farm staff. The most important isolates in pure cultures were coagulase-negative staphylococci, Staphylococcus aureus, Streptococcus uberis, and Bacillus spp. Positive cultures were generally not associated with subclinical mastitis. The objective was to develop strategies for the control of mastitis in organic cows without the use of antibiotics. Within a set of key control measures, two management strategies were trialled, one of which reduced the prevalence of subclinical mastitis to very low levels

    Organisations have become increasingly dependent on technology in order to compete in their respective markets. As IT technology advances at a rapid pace, so does its complexity, giving rise to new IT security vulnerabilities and methods of attack. Even though the human factors have been recognized to have a crucial role in information security management, the effects of weakness of will and lack of commitment on the stakeholders (i.e., employers and employees) parts has never been factored into the design and delivery of awareness programs. To this end, this paper investigates the impacts of the availability of awareness programs and end-user drive and lack of commitment to information security awareness program design, delivery and success.<br /

    Impact of the Journey: IS Employee Attitudes and Perceptions as Organizations Climb the CMM Ladder

    We surveyed 736 IS professionals in organizations at varying levels of the Capability Maturity Model (CMM) to investigate job attitudes and perceptions. Although anecdotal reports and the scant preliminary empirical studies to-date suggest job attitudes and perceptions improve for employees as organizations climb the CMM ladder, we found evidence of a more complex picture. IS workers reported significantly lower professional efficacy and affective commitment in organizations at CMM Level 3 than in organizations at Level 1, and reports of cynicism were higher in organizations at upper levels of the CMM
