O crime de recebimento indevido de vantagem : análise aos elementos objetivos

Desde sempre que a corrupção é entendida como um fenómeno complexo de elevada danosidade social que afeta, não só o Estado, como todos os cidadãos em geral. Assim, tem-se procurado combater tal fenómeno e os impactos que o mesmo possa vir a causar, através da criação de diversas medidas legislativas. É nesse contexto que surge, em 2010, o denominado crime de recebimento indevido de vantagem que pune as condutas de solicitação ou aceitação, dádiva ou promessa de vantagem indevida que ocorram no exercício das funções do funcionário ou por causa delas. Na presente dissertação é nosso objetivo analisar o crime previsto no artigo 372.º do Código Penal, em concreto, os seus elementos objetivos.Corruption has always been understood as a complex phenomenon of high social damage that affects not only the State, but all citizens in general. Thus, attempts have been made to fight this phenomenon and the impacts that it may cause, through the creation of various legislative measures. It is in this context that, in 2010, the crime of receiving undue advantage is created, which punishes the conduct of requesting or accepting, giving or promising an undue advantage that occurs in the exercise of the employee's duties or because of them.
