Envisioning a Compulsory-Licensing System for Digital Samples Through Emergent Technologies
Despite the rapid development of modern creative culture, federal copyright law has remained largely stable, steeped in decades of tradition and history. For the most part, copyright finds strength in its stability, surviving the rise of recorded music, software programs, and, perhaps the most disruptive technology of our generation, the internet.
On the other hand, copyrightâs resistance to change can be detrimental, as with digital sampling. Although sampling can be a highly creative practice, and although copyright purports to promote creativity, current copyright law often interferes with the practice of sampling. The result is a largely broken system: Those who can legally sample are usually able to do so because they are wealthy, influential, or both. Those who cannot legally sample often sample illegally.
Many scholars have suggested statutory solutions to this problem. Arguably, the most workable solutions are rooted in compulsory licenses. Unfortunately, implementing these solutions is practically difficult.
Two recent developments invite us to revisit these proposals. First, with the passage of the Music Modernization Act (âMMAâ), Congress has evinced a willingness to âmodernizeâ parts of copyright law. Second, emergent technologiesâfrom the MMAâs musical-works database to blockchain to smart contractsâcan be leveraged to more easily implement a compulsory-licensing solution. This time around, rather than simply discuss why this solution is favorable, this Note will focus on how it can be implemented

Numerical Computation for Backward Doubly SDEs with random terminal time
In this article, we are interested in solving numerically backward doubly
stochastic differential equations (BDSDEs) with random terminal time tau. The
main motivations are giving a probabilistic representation of the Sobolev's
solution of Dirichlet problem for semilinear SPDEs and providing the numerical
scheme for such SPDEs. Thus, we study the strong approximation of this class of
BDSDEs when tau is the first exit time of a forward SDE from a cylindrical
domain. Euler schemes and bounds for the discrete-time approximation error are

The obstacle problem for semilinear parabolic partial integro-differential equations
This paper presents a probabilistic interpretation for the weak Sobolev
solution of the obstacle problem for semilinear parabolic partial
integro-differential equations (PIDEs).
The results of Leandre (1985) concerning the homeomorphic property for the
solution of SDEs with jumps are used to construct random test functions for the
variational equation for such PIDEs. This results in the natural connection
with the associated Reflected Backward Stochastic Differential Equations with
jumps (RBSDEs), namely Feynman Kac's formula for the solution of the PIDEs.
Moreover it gives an application to the pricing and hedging of contingent
claims with constraints in the wealth or portfolio processes in financial
markets including jumps.Comment: 31 page
