    The Essential Facilities Doctrine Under United States Antitrust Law

    The issue of essential facilities has attracted renewed attention in Europe in recent years because of the controversy between IMS Health Inc. and NDC Health Corporation, two competitors in pharmaceutical data services in Germany . . . After an extensive investigation, the European Commission (EC) ordered that IMS grant access to the 1860 brick structure on commercially reasonable terms, and the EC decision is now on appeal in the Court of First Instance in Luxembourg. One issue that emerged in that litigation is whether a decision by European authorities to grant access to the alleged essential facility, especially one whose market power derived in part from a copyright, would open a gap between European and U.S. antitrust law. In response to that contention, the authors of this piece filed a statement in the Court of First Instance describing U.S. law on the subject. We argued that the EC\u27s ruling is consistent with U.S. jurisprudence on the subject of essential facilities.     Does family structure affect children's educational outcomes?

    In this paper we examine the effect of family structure on children’s educational outcomes by exploiting the sibling structure in the NLSY and NLSY-Child to control for unobserved heterogeneity across families and individuals. We also compare outcomes for children within the same family—stepchildren with their half-siblings in the same blended family who are the biological children of both parents. Using panel data methods to control for unobserved heterogeneity across families, we find that family structure effects are statistically insignificant. Finally, comparing half-siblings in our data, we find no difference in educational outcomes as a function of family structure. Our empirical results are consistent with at least two interpretations. First, they can be interpreted as evidence that estimates of family structure effects reflect selection rather than causation. Second, they can be interpreted as evidence that the presence of stepchildren disrupts families.Child care ; Demography ; Education ; Human capital

    Local Finance: A Brief Constitutional History

    This Comment traces the constitutional history of local finance from the seventeeth century through the present. The authors conclude that the New York City Bar Association Committee on Municipal Affairs\u27 report places the New York State Legislature at a crossroad in its history of dealing with local finances, and the well travelled path of patchwork amendment and politically expedient compromise is unacceptable for the future in light of New York City\u27s recent fiscal problems. However, the authors recognize that the alternative may be politically dangerous to members of the legislature hiding from the challenge and may jeopardize the fiscal stability of New York City and its sister municipalities across New York State

    Do Historically Black Colleges and Universities Enhance the College Attendance of African American Youths?

    Recently, Historically Black Colleges and Universities (HBCUs) have become the center of intense policy debates. Do HBCUs enhance the college attendance of African American youths? Previous research has been inconclusive. Among other improvements, our study adjusts for the relative availability of HBCU enrollment opportunities in each state. We find that African Americans are more likely to choose HBCUs over other colleges if more HBCU openings are available. However, more HBCU openings don\u27t increase overall African American enrollment. As we have shown elsewhere, attendance at an HBCU does enhance African American students\u27 college graduation rates

    The "Window Problem" in Studies of Children's Attainments: A Methodological Exploration

    Numerous studies of the determinants of children's attainments rely on observations of circumstances and events at age 14 as proxies for information over the entire childhood period. Using 21 years of panel data from the Michigan PSID on 825 children who were 14-16 years old in 1979, we evaluate the effects of using truncated or "window" (e.g., age 14) information in models of the determinants of attainments (e.g., education, nonmarital fertility) of young adults. Correlations between truncated and full-childhood variables are presented, along with 5 tests of the reliability of estimates based on "window" measurements. The tests are designed to evaluate the differential effects of data accuracy, multiple occurrence of events, duration of circumstances, and the timing of events or circumstances during childhood between "window" and full childhood information. We conclude that most of the standard truncated variables serve as weak proxies for multi-year information in such models, and draw the implications of these findings for future data-collection and research.
