Alternatif Penyelesaian Sengketa Dalam Islam (Kajian Terhadap Konsep Islah Sebagai Alternatif Penyelesaian Sengketa Perdata Dalam Islam)

In the course of human life history, they were always face with various problems ranging from the smallest conflict such as personal conflicts, groups conflict, even religious, nations and countries. The conflict stems from the loss of a sense of justice, wisdom, humanity, unity, peace, among both individuals and groups. Such conditions require immediate measures to improve and reconcile the relationship between the parties so as always to create a harmonious life mutual understanding and peace. The aim of this study was to analyze more deeply on Islah as ADR in Islam that includes theories, models, concepts, and examples stage in the settlement of civil cases, as well as the institutionalization opportunities in Indonesia. This research is a sociological empirical research, with sociological juridical approach, and analyzed descriptively qualitative and presented descriptively. The results of this study are, first, dissatisfaction with the judicial system encourages people to seek an alternative settlement; secondly, Islah has long been accepted and commonly used by the people of Indonesia so it is also legitimate for Muslims in Indonesia to apply it as an alternative to solving civil law problems that arise in their lives
