    Dynamic Yardstick Regulation

    This paper shows that the inability of regulators to commit to long-term contracts is irrelevant when there is some competition between regulated firms and when firms' private information is correlated. This sharply contrasts with the dynamic of regulation without such competition. The paper also explores what limitations on yardstick mechanisms can justify the use of long-term contracts. We found that the inability of a regulator to commit not to renegotiate long-term contracts is without consequences even if there is a bound on transfers that a firm can be asked to pay. In contrast, short-term contracting fails to implement the commitment solution with constraints on transfers. Second, absent current competition, the possibility of future entry allows the regulator to implement the first-best with a renegotiation-proof long-term contract whereas this cannot be achieved with short-term contracting.Yardstick regulation, ratchet effect, short and long-term contracts, commitment.

    Herding with Heterogeneous Ability: An Application to Organ Transplantation

    There are many economic environments in which an object is oļ¬€ered sequentially to prospective buyers. It is often observed that once the object for sale is turned down by one or more agents, those that follow do the same. One explanation that has been proposed for this phenomenon is that agents making choices further down the line rationally ignore their own assessment of the objectā€™s quality and herd behind their predecessors. Our research adds a new dimension to the canonical herding model by allowing agents to di er in their ability to assess the quality of the oļ¬€ered object. We develop novel tests of herding based on this ability heterogeneity and also examine its eļ¬€iciency consequences, applied to organ transplantation in the U.K. We nd that herding is common but that the information lost due to herding does not substantially increase false discards of good organs or false acceptances of bad organs. Our counter-factual analysis indicates that this is due (in part) to the high degree of heterogeneity in ability across transplant centers. In other settings, such as the U.S., where organ transplantation is organized very diļ¬€erently and the ability distribution will not be the same, the ineļ¬€iciencies due to herding might well be substantial

    Contract design and non-cooperative renegotiation

    We study a contract design setting in which the contracting parties cannot commit not to renegotiate previous contract agreements. In particular, we characterize the outcome functions that are implementable for an uninformed principal and an informed agent if, having observed the agent's contract choice, the principal can offer a new menu of contracts in its place. An outcome function can be implemented in this setting if and only if it is optimal for the principal for some belief over agent types which is more pessimistic, in the sense of the likelihood ratio order, than the prior. Furthermore, the outcome function cannot be too sensitive to variations in the agent's type. We show that the direct revelation mechanism which implements such a function when renegotiation can be prevented will also implement it in any equilibrium when it cannot, so the standard contract is robust to renegotiation

    Herding in quality assessment: An application to organ transplantation

    There are many economic environments in which an object is offered sequentially to prospective buyers. It is often observed that once the object for sale is turned down by one or more agents, those that follow do the same. One explanation that has been proposed for this phenomenon, which goes back to Banerjee (1992) and Bikhchandani (1992) is that agents making choices further down the line rationally ignore their own assessment of the object's quality and herd behind their predecessors. We develop novel tests to detect information-based herding, based on heterogeneity in agent ability, together with a methodology to quantify its welfare consequences, that are applied to organ transplantation in the U.K. We find that herding is common and is an important contributor to the high rate at which organs are rejected by transplant centers (and subsequently discarded). However, herding does not raise discard rates much above the level that would be obtained if private assessments were made publicly available. Instead, the (limited) information contained in predecessors' decisions substantially reduces the acceptance of bad organs. This is because in our application (i) high ability centers are often willing to deviate from the herd and follow their own positive signals, and (ii) sequences are exogenously terminated relatively quickly
