Illecito amministrativo e retroattività in bonam partem: da eccezione alla regola a regola generale

Analizzata la sentenza della Corte Costituzionale n. 63/2019, il presente contributo evidenzia quali conseguenze discendono dall'avvenuto riconoscimento, quale principio generale, del principio della retroattivit\ue0 in mitius delle norme sulle sanzioni amministrative

Il soccorso istruttorio nel nuovo Codice degli appalti : pre e post D.Lgs. n. 56 del 2017

Il presente contributo ha ad oggetto la nuova disciplina sul c.d. soccorso istruttorio in materia di gare d\u2019appalto di cui all\u2019art. 83 del D.Lgs. n. 50 del 2016. In particolare, nella prima parte si analizza l\u2019evoluzione che ha nel tempo subito l\u2019istituto in parola no al D.L. n. 90 del 2014, col quale si \ue8 notevolmente ampliato il suo perimetro di applicazione. Nel- la seconda parte, che \ue8 direttamente dedicata all\u2019analisi della nuova disciplina, pre e post \u201ccorrettivo\u201d, si d\ue0 risalto alle analogie e alle differenze che vi sono tra quest\u2019ultima e quella contenuta nel D.Lgs. n. 163 del 2006. In tale parte si tratta, in ne, della dubbia legittimit\ue0 costituzionale della sanzione pecuniaria prevista dalla originaria formulazione del citato art. 83 del nuovo codice degli appalti e di come il legislatore sia intervenuta su di essa con il D.Lgs. n. 56/2017.This paper relates to the new regulations on the so-called aid investigation regarding tenders in Art. 83 of Legislative Decree No. 50/2016. In particular, it initially analyses the evolution that the institution in question su ered over time up to Legislative Decree No. 90/2014, with which it greatly expanded its scope of application. In the second part, which is directly dedicated to the analysis of the new legislation, pre- and post-modifications, it em-phasises the similarities and di erences that exist between the former and the latter, that contained in Legislative Decree No. 163/2006. Finally, in this part, the dubious constitutionality of the nancial sanction is examined, as laid out in the original formulation of the above-mentioned Art. 83 of the new Public Procurement Code, and how the legislator tried to solve these problems with Legislative Decree No. 56/2017

Il presente contributo ha ad oggetto la disciplina nazionale sul whistleblowing, della quale si pongono in evidenza taluni aspetti problematici. Aspetti problematici che, se non corretti, rischiano paradossalmente di vanificare gli intendimenti di contrasto alla cattiva amministrazione che hanno indotto ad introdurre nel nostro ordinamento detta disciplina. LE REGIONI D’EUROPA TRA IDENTITÀ LOCALI, NUOVE COMUNITÀ E DISPARITÀ TERRITORIAL

Europe today is crossed by a strong demand for autonomy from the territories: on the one hand, to protect the identities of local communities and, on the other, for the growing demand for a wider representation of resident citizens. However, these requests can jeopardize the objectives of balance and integration between parts of the territory and between those who live in them, objectives that have always been at the center of reflection and proposals developed in the context of regional sciences. The recent crisis has heightened instability and widened economic and social gaps not only between regions, but also within the regions themselves. The North-South gaps in Italy have further increased and, in a post-crisis phase, this unstoppable process requires ever greater scientific and policy insights in terms of commitment and intervention capacity. If the economic growth of the past decade had found impetus in expanding the spaces of relationships and exchanges, the responses to the threats brought about by the crisis materialized in the closure of borders and in the defense of local levels of well-being. A particular specification of this theme also concerns the relationships between urban and rural territories and local systems, between plains and mountains as well as mountain areas, . The preface is therefore an acute reflection on issues of urgent relevance for Italy and of great interest for the regional sciences, accepting important scientific and policy challenges

Correlation between mesio-distal teeth diameters and arch width

Objective: To verify the existence of a correlation between the mesio-distal size of teeth and the arch width by analyzing the data separately for maxillary and mandibular arch in patients with ideal occlusion. Material and Methods: 58 patients with ideal occlusion were studied, for a total of 276 files analyzed. Dental casts were then scanned using a professional scanner (Epson Perfection v 330) and images were obtained in TIFF format at 600 dpi. All single teeth measurements were carried out for all teeth of both arches using the VAM software (Vectra, Canfield Scientific, Fairfield, NJ, USA). The repeatability and reproducibility of the measurement method were evaluated using the Gauge R&R method. In case a correlation between tooth size and arch size is found to be significant, a linear regression analysis can be applied through the following statistical relationship: y=a+b*x, where y is the result (inter-molar distance “AvgB66” or inter-canine distance “Cusp 33”), and x the specific tooth. The a and b respectively represent the intercept (point of intersection between the line and the y axis) and the slope of the line that describes the regression ratio. Results: The statistical analysis highlights a significant correlation (p<1%) between the results of the mesio-distal measurements of each tooth and the two variables considered to define the size of each arch (“AvgB66” and “Cusp 33”). Based on these results, a numerical relationship "y=a+b*x" has been extrapolated. Thus, it is possible to calculate the estimated inter-molar or inter canine distance necessary to have the teeth aligned. Conclusion: The inter-canine and inter-molar distances can be estimated starting from measuring the mesio-distal diameter of a single tooth
