The evolution of same-sex marriage case law in Europe
The number of countries allowing same-sex marriage is gradually increasing. Currently, 37 countries have laws regulating same-sex marriages, specifying their status and/or the possibility of adopting children. These solutions counter discrimination against same-sex couples and are part of the protection of human rights. Against the background of other countries, the pan-European tendency to accept the institution of same-sex marriage is garnering positive attention, although it is still controversial in some countries. Regulations of European law and the case law of the Court of Justice of the European Union, the European Court of Human Rights and the constitutional courts, which play an essential role in anti-discrimination measures and are in favour of respecting human rights, provide crucial support. This article discusses the evolution of the jurisprudence of the ECtHR, the CJEU and the national courts of selected countries (Slovenia, Spain, Portugal, Germany and Austria) concerning same-sex marriage. It highlights how recognising the right to same-sex marriage does not come at the expense of the rights of others or the public interest.info:eu-repo/semantics/publishedVersio
Dissentimento ou consentimento constrangido de adolescentes : conjugação dos Arts. 163º, nº2 e 164º, nº2 com os Arts. 172º e 173º do Código Penal
Na sequência da ratificação da Convenção de Istambul por Portugal e, consequentemente, da sua entrada em vigor na nossa ordem jurídica em 2014, foi necessário proceder-se a alterações legislativas para dar cumprimento às obrigações impostas pela mesma. Assim, a Lei nº83/2015, de 5 de agosto, alterou, nomeadamente, os números 2 dos artigos 163º e 164º do Código Penal, passando a abranger as situações em que o ato sexual não foi consentido ou o foi mediante pressões que não atinjam o patamar referido nos seus números 1. A questão que se coloca é a de saber se nesses casos de consentimento constrangido ou de dissentimento de menores adolescentes se aplica o artigo 172º ou 173º do Código Penal, conforme o caso, ou o número 2 dos artigos 163º ou 164º, agravado em razão da idade (artigo 177º, nº6 do Código Penal).Following the ratification of the Istanbul Convention by Portugal and, consequently, of its entry into force in our legal order in 2014, it was necessary to make some legislative changes to comply with the obligations imposed by it. Thereby, the Law nº83 / 2015, of 5th of August, amended, in particular, the numbers 2 of articles 163º and 164º of the Penal Code, start covering the situations which the sexual act was not consented or was consented under pressures that do not reach the level mentioned in the 1st numbers. The question that it is placed, is to know if in that cases of constrict consent or dissent of adolescents it is applied the article 172º or 173º of the Penal Code, according the case, or the number 2 of the articles 163º or 164º, heightened for the age factor (article 177º, nº6 of the Penal Code)
