Constitutional Limits on the Liability of Churches for Negligent Supervision and Breach of Fiduciary Duty

In the many suits against churches during the past several years for alleged misbehavior of clergy, a wide variety of tort theories have been put forward as possible bases for recovery. Among these are breach of fiduciary duty owed to church members, negligence in hiring, supervision and retention of clergy, intentional or negligent infliction of mental distress and vicarious liability for torts committed by individual clergy. This Article explores possible federal constitutional barriers to these tort actions, focusing mostly on the torts of negligent supervision and breach of fiduciary duty

Merrimack Valley Elder Partners

As stated in the thesis project, "My project was to generate a series of issues forums for people over 60 in the Merrimack Valley. The mission of the group I worked with, Elder Partners of the Merrimack Valley, is to "organize and empower elders in the Merrimack Valley so that they can advocate for themselves to improve services and conditions". The process was to survey various elder providers (housing authorities, family service agencies, visiting nurse associations, Councils on Aging) to get a sense of what the elder network feels are important issues. The group then held a series of "community speak-outs" with elders throughout the Merrimack Valley. These were held in elder housings using peer facilitators. Issues generated from these two sources shaped the focus of the legislative forums. The first forum held was with state representatives, the next with national representative and a third with state representatives again (in a different district of the valley). The focus of these events was to gather together elder constituents with change makers. The underlying purpose of the project continues to be to create informed, empowered and organized advocates. A Comparative Study of Tourism and Hospitality Education in the United Kingdom and France

pp.55-95Sufficient historical detail is provided on the development of tourism in France and the United Kingdom to provide a context for the discussion of how comparative education practices can inform and improve the provision of university education in Europe. Findings from a recent empirical comparative study of university provision for tourism and hospitality studies are presented and analysed to progress the work in this field of research. Finally, very recent moves, especially in industry-specific education in France, are combined with the teaching initiative called CLIL (Content & Language Integrated Learning) to offer a way forward for educators in tourism and hospitality departments in higher education in Europe

Crescent Singularities in Crumpled Sheets

We examine the crescent singularity of a developable cone in a setting similar to that studied by Cerda et al [Nature 401, 46 (1999)]. Stretching is localized in a core region near the pushing tip and bending dominates the outer region. Two types of stresses in the outer region are identified and shown to scale differently with the distance to the tip. Energies of the d-cone are estimated and the conditions for the scaling of core region size R_c are discussed. Tests of the pushing force equation and direct geometrical measurements provide numerical evidence that core size scales as R_c ~ h^{1/3} R^{2/3}, where h is the thickness of sheet and R is the supporting container radius, in agreement with the proposition of Cerda et al. We give arguments that this observed scaling law should not represent the asymptotic behavior.
