New Steps Towards Sustainable Public Procurement in Ukraine in the Context of the EU-Ukraine Association Agreement

In the context of implementing the EU-Ukraine Association Agreement in April 2020, a new version of the Law of Ukraine ‘On Public Procurement’ came into effect. It introduces a significant transformation in the public procurement system which could facilitate the strategic use of public procurement to achieve broader societal goals, and provides new opportunities for sustainable public procurement in Ukraine. This paper firstly presents the background of relations between Ukraine and the EU in terms of procurement. Secondly, special consideration is given to changes in the legal framework for technical specifications and contract award criteria as important tools in achieving the relevant sustainable development goals within public procurement. Finally, the paper focuses on the difference in conceptual approaches to the strategic use of public procurement in the EU and Ukraine

Ukraine's Potential Accession to the WTO Government Procurement Agreement: What are the pros and cons?

The present paper is dedicated to the problem of accession to the WTO Agreement on Government procurement (GPA) for Ukraine as well as for other acceding countries and the existing Parties of this Agreement. In the light of the recent decision of Ukraine to join GPA, the paper gives an appraisal of its opportunities concerning the accession to the Agreement and puts forward the critical assessment of such decision. Special attention is given to current Ukrainian legislation on government procurement and the main obstacles to Ukraine’s accession to the GPA. The article presents an in-depth analysis of problems and threats in the WTO public procurement system which may affect the functioning of the public procurement market of Ukraine as well as other acceding countries, especially domestic manufactures, and may cause the imbalances in the world trading system. Scientific and expert opinion on the Concept of updating the Civil Code of Ukraine

5 січня 2021 року Перший заступник Голови Верховної Ради України Р.О. Стефанчук запросив фахівців до обговорення проєкту Концепції оновлення Цивільного кодексу України. Реагуючи на це звернення, група експертів, предметом досліджень яких є питання правового регулювання економічних відносин, здійснили науковий аналіз зазначеної Концепції з урахуванням положень чинного законодавства України та сформулювали пропозиції щодо її вдосконалення. Науково-експертний висновок до Концепції оновлення Цивільного кодексу України було схвалено на розширеному засіданні Координаційного бюро з проблем правових основ підприємницької діяльності, господарського та комерційного права Відділення екологічного, господарського та аграрного права НАПрН України (протокол № 3 від 09.04.2021 р.). Stefanchuk invited experts to discuss the draft Concept of updating the Civil Code of Ukraine. Responding to this appeal, a group of experts, whose subject of research is the issue of legal regulation of economic relations, conducted a scientific analysis of this Concept in consideration of the provisions of current legislation of Ukraine and formulated proposals for its improvement. The scientific and expert opinion on the Concept of updating the Civil Code of Ukraine was approved at an extended meeting of the Coordination Bureau on the legal basis of business, Economic and Commercial law of the Department of Environmental, Economic and Agrarian law of NALS of Ukraine (Protocol № 3 of 09.04.2021).
