Вісник Кримінологічної асоціації України 2 (2015): 168-177.Статтю присвячено дослідженню системи протидії злочинності, її сутнісних ознак та порівнянню із суміжними категоріями. Визначено місце цього поняття серед кримінологічних категорій.The article is devoted to the research of the system of counteracting crime, its essential features and comparison with adjacent categories, including “crime prevention”, “control over crime”, “criminological security”. It is stressed that the counteraction crime is a specific branch of social management, where its multilevel nature is the most important feature. It is reflected in particular in the fact that it consists of addressing the causes of crime in general, causes of some of its varieties, as well as the causes and conditions of specific crimes. It is revealed that counteraction crime is carried out both in the process of solving common problems of social and economic development, and in the course of realizing special and criminological measures. The process of combating crime consists of the interaction between various of its subjects, among them – the authorities and management, law enforcement agencies, administrations of enterprises and institutions, NGOs and individuals. The hierarchy of objectives that the system of combating crime is facing is studied; thus it is found out that the most important goal is early prevention of crimes. The authors talk about preventing unfavorable formation of a personality that is even the possibility of forming criminogenic personal qualities. Thus, factors of criminal behavior are eradicated at the beginning of their formation. It is proved that the concept of “counteraction crime” is a collective, comprehensive and at the individual level includes prevention measures, prevention and suppression of crime. It is established that these types of criminological influence is functionally even closer to law enforcement activity because it is related to such stages of the mechanism of criminal behavior, as the decision-making to commit a crime, its planning, preparation and execution of the decision. It is concluded that as a crime is always a process that is developed in the time, the main way to prevent it is to intervene in the process timely and to prevent its development. The main difference between these activities is in time distance of their realization from the fact of a crime’s commission, as well as the degree of intensity and dynamic of use. Consequently, the use of the term “counteraction crime” makes it possible to reflect the totality of the state, society and citizens’ activity to prevent crimes. That is the reason for using the term “counteraction” in recent years not only in science but also in legislative activity.Статья посвящена исследованию системы противодействия преступности, ее сущностных признаков и сравнению со смежными категориями. Визначено місце цього поняття у системі кримінологічних категорій.A new scientific direction within the limits of legal theory has been formed. It involves the use of scientific knowledge of public relations of the mechanistic approach in this field. As a scientific category “mechanism of crime counteraction” is associated with the concept of the relevant activity. Activities on crime counteraction may be considered both as the general material legal guarantee of public and private interests’ realization in this area, and as the problem of their contact, the existence of which is conditioned by complex and contradictory mechanisms of realizing this activity within the departmental goal-setting and branch competence. While developing the concept of the activity mechanism one should consider right accentuation on the organization way and functioning of the phenomenon, because it is this approach will provide further synthesis not only static elements but also dynamic ones. The term “mechanism” may be used in this case to characterize the functioning of a certain system, where the specific activity as a system whole is reflected. It records the most general and essential features, relations between needs and specific kinds of activity to meet them, i.e. the achievement of a certain result from this kind of activity. The term “mechanism” in relation to the specified area of social reality should reflect the ways of organization and functioning of the system and characterize the forms of reflection in the relevant procedures of social processes and regularity. Therefore, the mechanism of crime counteraction, despite the mechanism of management, has such a specific structural feature as the process of realizing the activity with inherent goals, tasks, functions, methods, principles, etc. Whereas mentioned complex organizational and legal phenomenon, aiming at improving the system of crime counteraction includes a set of seamlessly connected and interacting elements (subjective structure, objective, tasks, principles, functions, methods, legal grounds of activity, etc.). This mechanism is derived category from the system of crime counteraction as a social phenomenon and serves as a mean of expressing its practical potential. The mechanism of crime counteraction from mechanistic positions is an internal system (form of organization) of criminological activity, mechanics of transforming the ideas contained in the legal consciousness into real social practice.Статья посвящена разработке понятия «механизм противодействия преступности» и исследованию его сущности по сравнению со смежными категориями. Розглянуто цілі, завдання та функції управління боротьбою зі злочинністю, зокрема, планування, координація, контроль та вимірювання ефективності.Combating crime includes two main aspects: criminal and legal, that contains detection, solving, investigating crimes and prosecuting perpetrators to the liability set by the law; and criminological that covers the study of crime, its causes and taking measures for their elimination or neutralization. Combating crime is a kind of social activity and requires organization. Proper organization of combating crime is the essential condition to its effectiveness. Organization of combating crime includes: crime analysis, determining the goals and priori-ties, planning of measures directed on ighting against crime, coordination and assessment of ef iciency. Crime analysis is a unity of cognition and assessment. It can be carried out across the country, within regions, districts, neighborhoods. Correctly formulated objectives define the main directions of the fight against crime, act as a factor that mobilizes, serve as criteria for assessment of the ef-fectiveness of law enforcement agencies’ activities in combating crime. A special role in organizing the fight against crime belongs to planning of measures di-rected on the suppression of crimes, weakening and neutralization of the fac-tors that cause them. The object of control as a management function is activity of the subjects of combating crime on the implementation of measures provided by the plans and programs of combating crime as well as measures, periodic or systematic implementation of which is entrusted to the relevant subjects by the current law. Coordination assists to create a single front to combat crime, which is a prerequisite for success. Practical possibility to measure the effectiveness of efforts in combating crime directly depends on the fact how properly objec- tives and tasks are scientifically grounded in this area, as well as the presence of the system of indicators, on which basis any activity in combating crime can be evaluated. However, for the assessment of the state of combating crime in general and in its some areas we should have own set of indicators.Статья посвящена анализу организационных основ борьбы с преступностью.
