    The Existence Of The International Anarcho-Syndicalism Movement Based On Indonesian Law Perspective

    Anarcho-syndicalism is an ideology in which workers want to work freely, not bound by rules. Anarcho-syndicalism is an ideology that wants the dissolution of all political power institutions that are narrated to oppress and exploit workers to be replaced by free communities bound by socio-economic interests. This research aims to find out the existence of the anarcho-syndicalist movement based on international law and the readiness of national law in facing the threat of anarcho-syndicalist ideology in Indonesia. The research method used in this research is normative legal research (library research) which has relevance to the research issues studied. Sources and legal materials used are primary, secondary, and tertiary legal materials. Based on the results of the research that has been carried out, it is known that the existence of the anarcho-syndicalism movement in terms of International Law has an impact on the application of the Right to freedom of association for workers/laborers as regulated in ILO (International Labour Organization) Convention No. 87 of 1948 concerning freedom of association and protection of the right to organize. Furthermore, the State has regulated people who join organizations to commit criminal offenses or prohibited organizations will be subject to imprisonment or fines, namely by what is written in the Criminal Code/KUHP (Kitab Undang-Undang Hukum Pidana) Article 261 concerning Participation in Organisations to commit Criminal Offences

    One country that is often a transit country for people seeking asylum elsewhere is Indonesia. Due to its location, Indonesia can become an illicit trade corridor and a stopover for people seeking asylum in Australia. As the influx of these refugees is deemed to pose a danger to national security and resilience, these illegal arrivals are certainly bad for Indonesia. Every person entering or leaving Indonesia is required by law to have a valid travel document. Indonesian laws and regulations governing the treatment of international refugees are inadequate. The purpose of this study is to analyse the role of IOM in fulfilling the basic needs of refugees in Kupang City in terms of Presidential Regulation Number 125 of 2016 concerning the handling of refugees from abroad". Normative-Empirical (applied) legal research. Researchers apply qualitative data analysis methods. The approaches used in this legal research are statutory approach, historical approach and conceptual approach.  The result of this research is that IOM in Indonesia has supported the Indonesian government in its efforts to overcome migration problems, both domestic and international. In Indonesia, IOM fulfils its policies regarding protection and a rights-based approach, by assisting migrants and refugees directly in accordance with the references or referrals given by the Indonesian Government to IOM. As a country that did not ratify the 1951 Refugee Convention, Indonesia still respects the rights of refugees including the right to fulfil basic needs for refugees in Kupang City. As referred to in Presidential Regulation No. 125 of 2016 concerning the handling of refugees from abroad.Salah satu negara yang sering menjadi negara transit bagi orang-orang yang mencari suaka di tempat lain adalah Indonesia. Karena lokasinya, Indonesia dapat menjadi koridor perdagangan gelap dan persinggahan bagi orang-orang yang mencari suaka di Australia. Mengingat masuknya para pengungsi ini dianggap dapat menimbulkan bahaya bagi keamanan dan ketahanan nasional, kedatangan ilegal ini tentu saja sangat buruk bagi Indonesia. Setiap orang yang memasuki atau meninggalkan Indonesia diwajibkan oleh hukum untuk memiliki dokumen perjalanan yang sah. Hukum dan peraturan di Indonesia yang mengatur perlakuan terhadap pengungsi internasional tidak memadai. Tujuan penelitian ini untuk menganalisis peran IOM dalam pemenuhan kebutuhan dasar pengungsi di Kota Kupang ditinjau dari Peraturan Presiden Nomor 125 Tahun 2016 tentang penanganan pengungsi dari luar negeriā€. Penelitian hukum Normative-Empiris (terapan). Peneliti menerapkan metode analisis data secara kualitatif. Pendekatan yang digunakan dalam penelitian hukum ini adalah pendekatan perundang-undangan, pendekatan histori dan pendekatan konseptual.  Hasil penelitian ini bahwa IOM di Indonesia telah mendukung pemerintah Indonesia dalam upaya mengatasi permasalahan migrasi baik itu domestik maupun internasional. Di Indonesia, IOM memenuhi kebijakannya mengenai perlindungan dan pendekatan berbasis hak, dengan membantu migran dan pengungsi secara langsung sesuai dengan referensi atau referal yang diberikan Pemerintah Indonesia kepada IOM. Sebagai negara yang tidak meratifikasi Konvensi Pengungsi 1951, Indonesia tetap menghormati hak-hak para pengungsi termasuk hak dalam pemenuhan kebutuhan dasar bagi pengungsi di Kota Kupang.
