    Foreign Price-Fixing Conspiracies

    Although price-fixing agreements remain per se illegal in the United States, courts have undermined the per se rule against price fixing by making it harder for plaintiffs to prove that such an agreement exists. For example, most courts that have considered the issue have held that defendants’ price-fixing conduct in a foreign market is not probative of price fixing in the United States. This Article examines the relationship between foreign and domestic price-fixing activity and shows how expanding a price-fixing cartel from foreign markets into the United States benefits the cartel by reducing the risk of arbitrage, stabilizing the cartel, and concealing the conspiracy from global antitrust authorities. The Article then takes the insights from the empirical and theoretical cartel literature and applies them to antitrust doctrine in order to demonstrate why defendants’ overseas price-fixing arrangements are relevant to proving the existence of an agreement in litigation claiming that the same defendants fixed prices in the American market. Finally, the Article encourages courts to better understand how international price-fixing cartels operate

    Growth or decline in the Church of England during the decade of Evangelism: did the Churchmanship of the Bishop matter?

    The Decade of Evangelism occupied the attention of the Church of England throughout the 1990s. The present study employs the statistics routinely published by the Church of England in order to assess two matters: the extent to which these statistics suggest that the 43 individual dioceses finished the decade in a stronger or weaker position than they had entered it and the extent to which, according to these statistics, the performance of dioceses led by bishops shaped in the Evangelical tradition differed from the performance of dioceses led by bishops shaped in the Catholic tradition. The data demonstrated that the majority of dioceses were performing less effectively at the end of the decade than at the beginning, in terms of a range of membership statistics, and that the rate of decline varied considerably from one diocese to another. The only exception to the trend was provided by the diocese of London, which experienced some growth. The data also demonstrated that little depended on the churchmanship of the diocesan bishop in shaping diocesan outcomes on the performance indicators employed in the study

    This paper presents the first systematic estimates of the direct money costs of reproduction-related health services. In 1982 Americans spent approximately 17.7billionforcontraception,abortion,treatmentofinfertility,obstetricalcare,andinfantcare.Thisrepresented5.5percentoftotalhealthcarespendingandwasequalto17.7 billion for contraception, abortion, treatment of infertility, obstetrical care, and infant care. This represented 5.5 percent of total health care spending and was equal to 327 per woman of reproductive age (15?44). Obstetrical care accounted for almost half of the reproduction-related expenditures and infant care accounted for morethan one-third. The paper discusses the demographic, technologic, economic,and sociopolitical factors that determine these expenditures. It also considers related public policy issues regarding legal status, sources of funding, and allocation of resources.
