The Metamorphosis of Corporate Criminal Prosecutions

    Get PDF
Corporate criminal enforcement has exploded in this country. Billion dollar fines are now routine across a range of industries, where they were unimaginable a decade ago. We have federal prosecutors and the Department of Justice, together with the white-collar bar, to thank for this. Their innovations have transformed what was, in decades past, a backwater area of criminal practice. Yet deep concerns remain that corporate prosecution settlements offer lenient and non-transparent deals that fail to hold either the corporations or the culpable individuals adequately accountable. Now, the DOJ has begun to rethink the evolving corporate prosecution approach through the adoption of new guidelines. This Essay explores the most recent set of changes to the evolving DOJ approach, responding to an incisive critique offered by Professors Elizabeth Joh and Thomas Joo. While a commendable and overdue effort, I agree with Joh and Joo that the changes are incremental and may have perverse consequences. Still more troubling, the changes entirely fail to address separate concerns, including regarding calculation of fines, scope and effectiveness of compliance reforms, treatment of recidivists, and supervision of agreements. A deeper rethinking of the federal approach towards enforcing corporate crime is much needed. During a time of broader rethinking of our criminal justice priorities, the paramount concern with leniency and rehabilitation in corporate prosecutions should instead be directed to the benefit of individuals

The Science Studio – A Workshop Approach to Introductory Physical Science

    Get PDF
This paper describes the Science Studio, an innovative workshop approach for instruction in a physical science course that combines aspects of traditional lecture and laboratory. The target audience for this introductory course is non-science majors, including prospective teachers. An inquiry-based, technology-rich learning environment has been created to allow students hands-on, in-depth exploration of topics in physics, and earth and space science. Course philosophy, course development, and sample activities are described in this paper, along with outcomes from a project-wide evaluation of the Virginia Collaborative for Excellence in the Preparation of Teachers (VCEPT), an investigation of change in student attitudes and the lasting impact of the studio model at Norfolk State University

Multi-Pion Systems in Lattice QCD and the Three-Pion Interaction

The ground-state energies of 2, 3, 4 and 5 \pi^+'s in a spatial volume V (2.5 fm)^3 are computed with lattice QCD. By eliminating the leading contribution from three-\pi^+ interactions, particular combinations of these n-\pi^+ ground-state energies provide precise extractions of the \pi^+\pi^+ scattering length in agreement with that obtained from calculations involving only two \pi^+'s. The three-\pi^+ interaction can be isolated by forming other combinations of the n-\pi^+ ground-state energies. We find a result that is consistent with a repulsive three-\pi^+ interaction for m_\pi < 352 MeV.Comment: 4 pages, 5 figure

System and rapidity dependence of baryon to meson ratios at RHIC

The rapidity and centrality dependence of baryon to meson ratios in Au++Au, Cu++Cu and p++p collisions at sNN\sqrt{s_{NN}} = 200 GeV at RHIC is presented. The pΛ‰/Ο€βˆ’\bar{p}/\pi^{-} ratios are founded to be independent of collision system at a fixed at mid- and forward rapidities.Comment: Talk at Quark Matter 2005 Conference in Budapest, Hungary. 4 pages, 4 figure

The technique of successive partial equilibria to predict precipitation of carbides in equilibrium with a solution phase

    Get PDF
The technique of successive partial equilibria has been employed to predict the equilibrium precipitation of carbides in iron-based alloy systems. To employ this technique, the principle that the equilibrium state is independent of the path followed, is utilized. The technique is illustrated with respect to the Fe-Cr-C system and also with respect to a steel containing several alloying elements. The technique is applicable to the precipitation of nitrides, oxides etc. also, in addition to that of carbides
