Location-Based Preferences in Federal and Federally Funded Contracting: An Overview of the Law
[Excerpt] The recession that began in December 2007 has prompted increased interest among some Members of Congress and their constituents in legal authorities that could require or allow federal agencies to prefer contractors in one state or locality over those in other states or localities. Federal spending on procurement contracts has remained high, reaching $523.9 billion in FY2009, at a time when many other businesses have scaled back their purchases of goods and services. However, this spending has historically been localized in three to five states, which receive nearly half of all federal procurement dollars, prompting concerns about whether other states receive their “fair share.” Such concerns may be overstated, given that many contracts must be performed in or near Washington, DC, and shifting the place of performance of existing contracts from one state to another would generally not decrease overall unemployment. Nonetheless, geographic distribution of federal spending and federal funding is often a concern during economic downturns.
This report discusses constitutional and other legal issues related to the creation and implementation of location-based preferences in federal contracting, as well as summarizes key authorities requiring or allowing federal agencies to “favor” contractors located in specific places. The report does not address federal preferences for domestic products or provisions of federal law that could, depending upon their implementation, effectively prefer local contractors, such as project labor agreements
Learning an Artist's Style: Just What Does a Pigeon See in a Picasso?
Judgments of style in art, music, and literature are commonplace, although the mechanisms providing for this structural sensitivity are not well understood. Watanabe, Sakamoto, and Wakita (1995) showed that pigeons trained to discriminate colour slides of paintings of Picasso from those of Monet could generalise this discrimination not only to new paintings of Picasso and Monet, but also to paintings of other cubist and impressionist painters. These results suggest that the bases for such judgments of artistic style may be simpler than normally thought. This tacit sensitivity to artistic style is explored in terms of a simple PCA network model applied to pixel-maps of the paintings. The eigenvectors obtained from the singular value decomposition of sets of these pixel-maps provide for descriptions of the stimuli in terms of visual macro-features. These macro-features provide a simple basis not only for recognising previously-experienced paintings, but for the successful discrimination of novel paintings into various style categories. A summary of simulations of the performance of Watanabe et al.s pigeons using precisely the same stimuli and tasks is provided. The results suggest that the eigen-decomposition is a necessary first-step, and that the bases for judgments of style may indeed be quite simple
Providing More Effective and Efficient Casino RFPs
The proliferation of gaming has required governmental entities to become more efficient in the selection of new gaming operators. The Request for Proposal (RFP) process has become the accepted method for selecting operators in new jurisdictions. However, the development of this process has been, and continues to be, evolving; more recent RFPs have learned from the mistakes made in earlier ones. The authors discuss how to make the RFP process more effective and efficient by analyzing the mistakes made in previous RFPs. They provide recommendations on how to structure the initial RFP and about what information should be contained in all RFPs
The effects of soil moisture, soil texture, and host orientation on the ability of Heterorhabditis bacteriophora (Rhabditida: Heterorhabditidae) to infect Galleria mellonella (Lepidoptera: Pyralidae)
Abstract
Entomopathogenic nematodes (EPN) demonstrate potential as a biological control for soil dwelling insects. However, edaphic factors, such as soil moisture and texture impact the efficacy of EPN on a host. The objectives were to examine the effects of soil texture and moisture on 1) the infection rate of Galleria mellonella L. by EPN and; 2) the ability of H. bacteriophora (Poinar) to move through the soil to find a host at different orientations. Soil textures consisted of sand, a sand/silt/peat mixture, and a silt/peat mixture at 50% and 100% moisture. A general linear model was used to evaluate infection rates and EPN movement. Both soil moisture (p \u3c 0.05) and texture (p \u3c 0.05) had significant effects on nematodes infection rates of G. mellonella. Texture, moisture, and host orientation did not significantly affect (p \u3e 0.05) the ability of EPN to find a host. While EPN were able to find a host within a variety of soil types, soils that held more water had higher infection rates than soils that held less water, suggesting that moisture may be a key component in facilitating infection by EPN. By understanding the factors that influence the ability of EPN to find and infect a host, improved bio-control programs using EPN can be developed
MCFM for the Tevatron and the LHC
A summary is given of the current status of the next-to-leading order (NLO)
parton-level integrator MCFM. Some details are given about the Higgs + 2-jet
process and the production and decay of , both of which have
recently been added to the code. Using MCFM, comparisons between the Tevatron
running at ~TeV and the LHC running at ~TeV are made
for standard model process including the production of Higgs bosons. The case
for running the Tevatron until 16fb are accumulated by both detectors is
