    Why it is not Unreasonable for the Police to Refuse to Provide a Copy of the Search Warrant at the Outset of the Search

    This article presents numerous reasons why it would not be unreasonable for the police to refuse to provide an occupant of the premises a copy of the search warrant at the outset of the search when an occupant of the premises is present and poses no threat to the officers’ safe and effective performance of their mission. First, neither the plain text of the Fourth Amendment nor the plain text of Federal Rule 41 requires it. Second, there are numerous constitutional and statutory protections that ensure the executing official does not wrongfully execute the warrant. In essence, requiring the police to provide a copy of the search warrant prior to conducting the search would contradict many of the Fourth Amendment’s purposes. As the Supreme Court recognized, the Fourth Amendment does not give individuals “license to engage the police in a debate over the basis for the warrant.” Our nation has a judicial system and judicial actors – such as judges, prosecutors, and defense attorneys – that address the actions of an overreaching government. Allowing ordinary citizens to substitute themselves for these judicial actors is not only irresponsible but completely contradictory to the ideals and requirements of our Constitution

    Applying chiral perturbation to twisted mass Lattice QCD

    We have explored twisted mass LQCD (tmLQCD) analytically using chiral perturbation theory, including discretization effects up to O(a^2), and working at next-to-leading (NLO) order in the chiral expansion. In particular we have studied the vacuum structure, and calculated the dependence of pion masses and decay constants on the quark mass, twisting angle and lattice spacing. We give explicit examples for quantities that both are and are not automatically improved at maximal twisting.Comment: 3 pages, 1 figure.     Barriers to the use of a diagnostic oral microbiology laboratory by general dental practitioners

    OBJECTIVE: To identify barriers on the use of diagnostic microbiology facilities in general dental practice. DESIGN: A cross-sectional survey using a postal questionnaire. SETTING: Primary/secondary care interface between the diagnostic oral microbiology laboratory, University of Glasgow Dental Hospital and School, Glasgow and dental practitioners within the surrounding health boards, 1998. SUBJECTS: All GDPs (797) within Argyll and Clyde, Ayrshire and Arran, Lanarkshire and Greater Glasgow Health Boards. MAIN OUTCOME MEASURES: The responses were expressed as both absolute and relative frequencies. RESULTS: Responses were received from 430 (55%). The most frequent reason for failure to use the service was lack of information, with more than half of the respondents claiming to be unaware of the facility. Lack of request forms and sampling equipment were also viewed as barriers to using the service. CONCLUSIONS: The laboratory is failing to successfully communicate its role in addressing the growing burden of antibiotic resistance in the community and must be more proactive in encouraging appropriate use and increasing accessibility of the service to GDPs

    Modeling tourists' personality in recommender systems: how does personality influence preferences for tourist attractions?

    Personalization is increasingly being perceived as an important factor for the effectiveness of Recommender Systems (RS). This is especially true in the tourism domain, where travelling comprises emotionally charged experiences, and therefore, the more about the tourist is known, better recommendations can be made. The inclusion of psychological aspects to generate recommendations, such as personality, is a growing trend in RS and they are being studied to provide more personalized approaches. However, although many studies on the psychology of tourism exist, studies on the prediction of tourist preferences based on their personality are limited. Therefore, we undertook a large-scale study in order to determine how the Big Five personality dimensions influence tourists' preferences for tourist attractions, gathering data from an online questionnaire, sent to Portuguese individuals from the academic sector and their respective relatives/friends (n=508). Using Exploratory and Confirmatory Factor Analysis, we extracted 11 main categories of tourist attractions and analyzed which personality dimensions were predictors (or not) of preferences for those tourist attractions.     Structure determination of PF3 adsorption on Cu(100) using X-ray standing waves

    The local structure of the Cu(100)c(4x2)-PF3 adsorption phase has been investigated through the use of normal-incidence X-ray standing waves (NIXSW), monitored by P 1s and F 1s photoemission, together with P K-edge near-edge X-ray absorption fine structure (NEXAFS). NEXAFS shows the molecule to be oriented with its C3v symmetry axis essentially perpendicular to the surface, while the P NIXSW data show the molecule to be adsorbed in atop sites 2.37±0.04 Å above the surface, this distance corresponding to the Cu-P nearest-neighbour distance in the absence of any surface relaxation. F NIXSW indicates a surprisingly small height difference of the P and F atoms above the surface 0.44±0.06 Å, compared with the value expected for an undistorted gas-phase geometry of 0.77 Å, implying significant increases in the F-P-F bond angles. In addition, however, the F NIXSW data indicate that the molecules have a well-defined azimuthal orientation with a molecular mirror plane aligned in a substrate mirror plane, and with a small (5-10°) tilt of the molecule in this plane such that the two symmetrically-equivalent F atoms in each molecule are tilted down towards the surface

    ACCURACY OF THE BRCAPRO RISK ASSESSMENT MODEL IN MALES PRESENTING TO MD ANDERSON FOR BRCA TESTING Publication No. _______ Carolyn A. Garby, B.S. Supervisory Professor: Banu Arun, M.D. Hereditary Breast and Ovarian Cancer (HBOC) syndrome is due to mutations in BRCA1 and BRCA2 genes. Women with HBOC have high risks to develop breast and ovarian cancers. Males with HBOC are commonly overlooked because male breast cancer is rare and other male cancer risks such as prostate and pancreatic cancers are relatively low. BRCA genetic testing is indicated for men as it is currently estimated that 4-40% of male breast cancers result from a BRCA1 or BRCA2 mutation (Ottini, 2010) and management recommendations can be made based on genetic test results. Risk assessment models are available to provide the individualized likelihood to have a BRCA mutation. Only one study has been conducted to date to evaluate the accuracy of BRCAPro in males and was based on a cohort of Italian males and utilized an older version of BRCAPro. The objective of this study is to determine if BRCAPro5.1 is a valid risk assessment model for males who present to MD Anderson Cancer Center for BRCA genetic testing. BRCAPro has been previously validated for determining the probability of carrying a BRCA mutation, however has not been further examined particularly in males. The total cohort consisted of 152 males who had undergone BRCA genetic testing. The cohort was stratified by indication for genetic counseling. Indications included having a known familial BRCA mutation, having a personal diagnosis of a BRCA-related cancer, or having a family history suggestive of HBOC. Overall there were 22 (14.47%) BRCA1+ males and 25 (16.45%) BRCA2+ males. Receiver operating characteristic curves were constructed for the cohort overall, for each particular indication, as well as for each cancer subtype. Our findings revealed that the BRCAPro5.1 model had perfect discriminating ability at a threshold of 56.2 for males with breast cancer, however only 2 (4.35%) of 46 were found to have BRCA2 mutations. These results are significantly lower than the high approximation (40%) reported in previous literature. BRCAPro does perform well in certain situations for men. Future investigation of male breast cancer and men at risk for BRCA mutations is necessary to provide a more accurate risk assessment

    Gamma Ray Lines from a Universal Extra Dimension

    Indirect Dark Matter searches are based on the observation of secondary particles produced by the annihilation or decay of Dark Matter. Among them, gamma-rays are perhaps the most promising messengers, as they do not suffer deflection or absorption on Galactic scales, so their observation would directly reveal the position and the energy spectrum of the emitting source. Here, we study the detailed gamma-ray energy spectrum of Kaluza--Klein Dark Matter in a theory with 5 Universal Extra Dimensions. We focus in particular on the two body annihilation of Dark Matter particles into a photon and another particle, which produces monochromatic photons, resulting in a line in the energy spectrum of gamma rays. Previous calculations in the context of the five dimensional UED model have computed the line signal from annihilations into \gamma \gamma, but we extend these results to include \gamma Z and \gamma H final states. We find that these spectral lines are subdominant compared to the predicted \gamma \gamma signal, but they would be important as follow-up signals in the event of the observation of the \gamma \gamma line, in order to distinguish the 5d UED model from other theoretical scenarios.Comment: 21 pages, 6 figure

    Theory of Multiphonon Excitation in Heavy-Ion Collisions

    We study the effects of channel coupling in the excitation dynamics of giant resonances in relativistic heavy ions collisions. For this purpose, we use a semiclassical approximation to the Coupled-Channels problem and separate the Coulomb and the nuclear parts of the coupling into their main multipole components. In order to assess the importance of multi-step processes, we neglect the resonance widths and solve the set of coupled equations exactly. Finite widths are then considered. In this case, we handle the coupling of the ground state with the dominant Giant Dipole Resonance exactly and study the excitation of the remaining resonances within the Coupled-Channels Born Approximation.     The Stability of the Weak Skyrmions

    We consider a set of gauge invariant terms in higher order effective Lagrangians of the strongly interacting scalar of the electroweak theory. The terms are introduced in the framework of the hidden gauge symmetry formalism. The usual gauge term is known to stabilize the skyrmion but only in the large vector mass limit. We find that adding higher-order gauge terms is insufficient to insure stability. We then proceed to analyze other gauge invariant interaction terms.
