    TARGETED SANCTIONS, JUDICIAL ANTAGONISM OR LEGAL DIALOGUE

    This piece begins by illustrating the current status of United Nations targeted sanctions regimes, from the formal point of view. It then proceeds to explain the mechanisms of listing and de-listing at the UN level, as well as the means by which UN Member States, and the European Union, implement these sanctions in their national (regional) legal orders, and why the chosen means of implementation create potential situations where the states (the EU) might find themselves in breach of differing international obligations. In the final part, the article shows how the major international European courts (the Court of Justice of the European Union and the European Court of Human Rights) have dealt with this potential conflict, and posits that their approaches are very different and will have different consequences: i.e. whereas the CJEU has taken a militant approach, which threatens to damage the unity of international law, the ECtHR has taken an unitary approach, which strengthens the international system, while also promoting human rights over sanctions

    Numerical Experiment to Analyse the Reliability of Coarse Grid Based Numerical Methods for Modelling Groundwater Flow by Drainage Objects Like Wells in Confined Aquifer

    AbstractAt the neighbourhood of several drainage objects types in shallow aquifer like fully penetrated wells, partially penetrated wells, well with laterals, horizontal drainages etc. groundwater flow forms contain frequently 2D/3D singular behaviours (e.g. logarithmical or polar singularities), which require special attention by coarse grid simulations Groundwater reservoir modelling. The first objective of the paper is to test the accuracy of Finite Volume Methods with specific reference to one of the most used standard reservoir modelling software in groundwater modelling PMWIN/MODFLOW (i.e. Processing MODFLOW for Window), Chiang (2001). The numerical experiment will be accomplished mainly for fully penetrating well (W) and partially penetrating well (ppW) using various discretization size.It will be shown that the standard Well Index method (Peaceman 1983), currently used by coarse grid simulations, allows the local correction in well blocks only for hydraulic head (or pressure) in the wellbore obtained by coarse grid simulation for imposed global discharge/recharge rate of the well. In the paper an extension of the WI based method will be proposed which allows also the well discharge rate correction by coarse grid modelling for imposed hydraulic head (imposed pressure) in the well. The proposed method is proved with several numerical simulation examples for fully wells and ppWells

    Dynamics of Microbial Functional Groups in Rhizosphere of Spring Barley

    Plant rhizosphere is the portion of soil which is in direct contact with the plant roots. From the microbiological point of view, this area is characterized by strong dynamic of functional groups with high specificity towards the substrate available. Spring barley is a crop with high requirements to the composition of the microflora in the rhizosphere, disturbances produced by agronomic inputs affecting the stability of rhizospheric contact interfaces and ultimately the plant growth. Analysis of changes within the microbial community was carried out with the purpose of defining the disruptive impact of mineral inputs and potential of zeolite to reduce these disruptions. Microbial functional groups were analyzed on the basis of the CO2 export under the specific conditions of soil inoculation on specific substrates over a time period of incubation. Microresp detection plates allow evaluation of a large number of samples under identical conditions of inoculation and the establishment of dynamics of the entire microbial community. The dynamics of the entire microbial communities (basal respiration) is stimulated to increase in case of unilateral application of zeolite and zeolite as a buffer for urea fertilization. General growth trend of microbial communities follows proportional the associated application of zeolite with urea, the most powerful non-symbiotic nitrogen fixation processes being stimulated by this combination of fertilizers. Simultaneously, an increase in the dynamics of denitrifiers was observed, also the decomposition of lignin and cellulose and biological crust formation due to the proliferation of cyanobacteria. Rhizosphere of barley plants is characterized by the presence of actinomycetes as dominant in functional microbial community of all experimental variants analyzed with a high capacity for biological degradation and raised mineralization of organic matter
