You Can\u27t Always Get What You Want, But If You Try Sometimes You Can Steal It and Call It Fair Use: A Proposal to Abolish the Fair Use Defense for Music
The fair use doctrine in copyright has become the excuse for every creatively challenged author who gets caught using someone else\u27s intellectual property without paying for it and tries to pass it off as his or her own. Fair use has also become the means to use someone else\u27s work for purposes unrelated to the original without paying for the use.
While there are scholars who believe fair use should be more widely applicable than it already is, this Article will discuss how the fair use defense in music has been expanded far beyond the original legislative intent and has been applied too liberally by the courts, potentially rendering an author\u27s rights under 17 U.S.C. § 1068 meaningless. For authors to recapture these lost rights, the defense should be severely restricted, abolishing it for all but a very few narrowly tailored exceptions
Body Image and Bodybuilding: The Impact Commitment to Bodybuilding Has on Body Image Disturbance among Competitive Bodybuilders
The purpose of this study was to examine the effect commitment to bodybuilding had on body image disturbance in men. It was hypothesized that competitive bodybuilders would exhibit higher levels of body dissatisfaction, body checking, body consciousness, and symptoms of muscle dysmorphia than regular weight lifters. It was also hypothesized that commitment to bodybuilding, as defined by the number of competitions, would predict the severity of body image disturbance as measured by body dissatisfaction, body checking, body consciousness, and symptoms of muscle dysmorphia. Participants included males who were a minimum age of 18 years old. Participants were recruited via Mechanical Turk, Amazon.com’s paid participant database. Participants who met the criteria completed a battery of questionnaires measuring body image disturbance, exercise dependence, and commitment to bodybuilding. Multiple regressions, analyses of variance, and correlations were conducted in order to test the hypotheses. Results suggest that both competitive bodybuilders and competitive fitness lifters show higher levels of muscle dysmorphia symptoms than regular fitness lifters. Competitive fitness lifters also expressed higher levels of body checking and body dissatisfaction than regular fitness lifters
Creep-Fatigue Relationsihps in Electroactive Polymer Systems and Predicted Effects in an Actuator Design
The paper concerns the time-dependent behavior of electroactive polymers (EAP) and their use in advanced intelligent structures for space exploration. Innovative actuator design for low weight and low power valves required in small plants planned for use on the moon for chemical analysis is discussed. It is shown that in-depth understanding of cyclic loading effects observed through accelerated creep rates due to creep-fatigue interaction in polymers is critical in terms of proper functioning of EAP based actuator devices. In the paper, an overview of experimental results concerning the creep properties and cyclic creep response of a thin film piezoelectric polymer polyvinylidene fluoride (PVDF) is presented. The development of a constitutive creep-fatigue interaction model to predict the durability and service life of electroactive polymers is discussed. A novel method is proposed to predict damage accumulation and fatigue life of polymers under oyclic loading conditions in the presence of creep. The study provides a basis for ongoing research initiatives at the NASA Kennedy Space Center in the pursuit of new technologies using EAP as active elements for lunar exploration systems

Stock composition and coastal migration characteristics of coho salmon in fisheries of Norton Sound, Alaska

University of Alaska Fairbanks, 2023Knowledge of the dynamic interactions between directed fishing effort and exploitable stocks of Pacific salmon Oncorhynchus spp. is needed to balance harvest opportunities against diversity conservation in mixed stock fisheries. This is often accomplished by relating stock proportions in commercial landings with spatial and temporal strata of harvests, but catch partitioning is hindered in fisheries targeting local stocks that do not display enough discernable variation for classification using modern tools (e.g., genetic stock identification). This study investigates the composition and migratory behavior of Coho Salmon O. kisutch stocks in the Norton Sound district of Alaska by mimicking local fisheries to capture and tag 578 fish in the contiguous Shaktoolik and Unalakleet subdistricts over two seasons. A network of acoustic receivers monitored coastal movement and freshwater entry, and 341 individuals last detected in spawning areas were assigned to a stock of origin based on assumed natal site fidelity. In Chapter 1, models using spatiotemporal and demographic variables were fit to commercial harvest data in project years and estimated that 32.9% of Shaktoolik subdistrict catch was Shaktoolik stock, while 86.7% of landings were Unalakleet stock in Unalakleet subdistrict. In Chapter 2, significant differences in migratory characteristics were identified among stocks within the study area, with local stocks swimming slower and further offshore relative to fish bound for spawning streams outside the study area, and residency time within coastal fishery boundaries decreased for all stocks as the season progressed. Detection histories were used to estimate parameters for multistate movement models which indicated that Unalakleet stock members are more likely than other observed stocks to explore coastal waters outside their natal subdistrict before moving into freshwater. An Online Tutorial Vs. Pre-Recorded Lecture For Reducing Incidents Of Plagiarism
The current study compared an online academic integrity tutorial modified from Belter & du Pre (2009) to a pre-recorded online academic integrity lecture in reducing incidents of plagiarism among undergraduate students at a science and technology university. Participants were randomized to complete either the tutorial or the pre-recorded lecture and then completed an academic integrity quiz. We hypothesized that students who completed the tutorial would exhibit fewer incidents of plagiarism and complete the quiz with fewer attempts. Results revealed no statistically significant difference in incidents of plagiarism between the groups. There was a significant positive relation between the number of quiz attempts and the incidents of plagiarism (r (31) = .388, p = .03). Results suggest that an online tutorial is equally effective as a pre-recorded online lecture in addressing issues of plagiarism in the classroom. These results are discussed in the context of education strategies, intrinsic motivation, and time-saving methods.
