    Pengurusan pembangunan harta wakaf: Pengalaman Majlis Agama Islam Negeri Pulau Pinang (MAINPP) terhadap wakaf Setee Aishah

    Purpose– The purpose of this study is to review the waqf property development that has been implemented by the Islamic Religious Council of Pulau Pinang (MAINPP) as a trustee for the endowment land named waqf Seetee Aishah. The Seetee Aishah endowment land located at Seberang Jaya, Pulau Pinang. This waqf land was developed into a housing estate. Methodology– This study employs two types of methods – library research and field research. The library research is used as the first method for collecting data, where the data is extracted from fiqh contemporary books,fiqh classic books, journals, internet websites, annual reports and scientific conference papers.The second method of data collection is field research,where interviews were conducted with the head of the endowment (waqf) and also the project manager of the Seetee Aishah endowment at MAINPP. The methods of analysis covered three aspects – deductive, inductive and comparative.Findings – This study finds that the development of waqf properties at Pulau Pinang was carried out by the collaboration between MAINPP with the developer (UDA Holdings Bhd.).Because of the lack of cashflows, MAINPP is not able to provide financial capital (liquid assets) to carry out the development of waqf property, but able to provide unmovable capital(waqf land) for the project.Originality/Value – This study proves that joint venture between MAINPP and UDA Holdings Bhd. in developing the waqf land could increase the value of existing waqf properties.The joint venture implemented by MAINPP can also be used as a model for the other states in Malaysia to construct their waqf property more productive

    The relationship marketing as a determinant of customer satisfaction in Islamic banking services management

    The purpose of this study is to identify the dimensions that determine whether customer satisfaction in Islamic banking services has been conducted at the Institusi Pengajian Tinggi Awam (IPTA) in Perlis involving two institutions, namely Universiti Malaysia Perlis (UNIMAP) and Universiti Teknologi Mara (UITM) Perlis.The collection of the principal data was accomplished by using a survey paper to answer the study’s research questions.It involved 224 customers using the Islamic banking services.This study was analysed using the Statistical Packages for Social Science (SPSS) by applying descriptive analysis and inferential analysis (Independent T-test, One Way Analysis of Variance (ANOVA) and Correlation Pearson). This study finds that there are some different relationships in terms of position at the university level of education in the demographic characteristics analysis towards customer satisfaction. Most of the dimensions related to customer satisfaction in the Islamic banking services are positively correlated with each other (commitment, product knowledge, competence, service encounter).This study proves that this research is useful to academicians by providing new empirical evidence of relationship marketing with customer satisfaction in the Islamic banking industry.The results of this study can encourage bank managers to learn how to improve commitment, product knowledge, competence and service encounter in Islamic banks’ services to customers

    Artikel ini membincangkan tentang kaedah pengurusan harta wakaf yang dilaksanakan Oleh Majlis Agama Islam Kedah (MAIK).Terdapat pelbagai kaedah pembangunan yang telah digunakan oleh MAIK untuk tujuan pengurusan yang optimal antaranya kaedah sewaan, istibdal, B.O.T (Build Operate Transfer), Pajakan 99 tahun, RMK-9 (Rancangan Malaysia Ke-9) dan juga kaedah usahasama. Kajian ini memfokuskan kaedah pajakan 99 tahun yang telah diamalkan oleh MAIK untuk menguruskan harta wakaf yang berada dibawah seliaannya.Perbahasan dari segi fiqh juga diutarakan dalam kajian ini yang berkisar tentang kaedah pajakan tanah untuk tempoh 99 tahun. Hasil perbincangan ini kelak akan membolehkan institusi wakaf dinegeri lain menjadikan ianya sebagai acuan dalam usaha memartabatkan kelestarian harta wakaf yang diselia

    Pengurusan muzakarah Jawatankuasa Fatwa Majlis Kebangsaan dan Jawatankuasa Fatwa Negeri: Satu analisis persamaan dan perbezaan fatwa tahun 2000–2009

    Purpose – The aim of this study is to discuss in detail the similarities and differences that exist as well as to identify the factors that lead to the fatwa issued by the Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia (MJFK) and the Jawatankuasa Fatwa Negeri-Negeri from 2000 till 2009.Design/Methdology – This study is a qualitative research design, which involves the use of the following methods: 1. The data collection methods – The sources of the data were the various news sources such as the Malaysia Annual Government Gazette, the minutes of the state fatwa meeting, the MJFK fatwa collection of books, the fatwa books that were issued by the state Mufti departments, the official website of the Mufti departments as well as the e-fatwa sites that were provided by JAKIM.2.The data analysis methods – The data was analysed manually.It involved the process of data classification, comparative data analysis such as the similarities and differences between these two institutions. Findings – This study found some similarities and differences between these two institutions in issuing the fatwa.A factor that was identified as common between these two committees is the issuance of fatwa that was related to the Islamic faith (al-Iman). On the other hand, the issues that were related to the sharia law and the moral values (al-akhlak) had few differences regarding the needs in their states.However, some differences in fatwa were discovered in terms of the Islamic law between the MJFK and the state fatwa committees.Among the reasons were identified was the difference in determining the concept of priority (aulawiyyat).In addition ,there were also some differences in understanding the local realities and in terms of elobrating the general arguments.These differences also led to the occurrence of inconsistencies between the MJFK fatwa and the state fatwa committees as well.Originality/Value – This study revealed that the similarities and the differences in the fatwas are common because the ability to understand and interpret the fatwa is determined based on the concept of priority (aulawiyyat), but the most important things in issuing the fatwa are based on the method of ijtihad among fuqaha

    Terdapat beberapa kaedah yang boleh dipraktikkan untuk memproduktifkan aset wakaf. Hal ini termasuk aktiviti seperti, menyewakan aset wakaf kepada pihak yang berkepentingan dan melakukan aktiviti ekonomi dalam pelbagai bidang seperti bidang pertanian dan penternakan. Sekiranya kesemua kaedah tersebut tidak sesuai dipraktikkan, nazir hendaklah mencari alternatif lain agar tanah tersebut dapat diproduktifk an. Pemegang amanah wakaf juga seharusnya peka terhadap potensi sesebuah tanah wakaf yang berada di bawah jagaannya agar dapat dioptimunkan penggunaannya. Oleh itu, pelaburan hartanah merupakan salah satu alternatif yang boleh dilakukan untuk tujuan membangunkan tanah wakaf. Pelaburan hartanah terhadap harta wakaf dapat dibuat dengan cara pembinaan bangunan secara komersil seperti pasar raya, tempat penginapan (hotel) dan juga taman perumahan. Dengan ini penciptaan aset wakaf baru akan terhasil setelah tanah wakaf tersebut dibangunkan. Penyelidikan ini dilakukan untuk mengkaji kaedah pembangunan secara komersil yang telah dilakukan oleh Majlis Agama Islam Negeri Pulau Pinang (MAINPP) terhadap salah sebuah tanah wakaf (waqaf Seetee Aishah) yang terletak di Seberang Jaya, Pulau Pinang. Dengan kepakaran pengurusan yang ada dipihak MAINPP serta kerjasama daripada UDA Holdings Berhad, tanah wakaf Seetee Aishah telah berjaya diproduktifkan dengan pembinaan sebuah taman perumahan yang dikenali sebagai taman perumahan wakaf Seetee Aishah.   Kata kunci: Pembangunan harta wakaf, Majlis Agam a Islam Negeri Pulau Pinang (MAINPP), pelaburan harta wakaf

    Employing cash waqf in financing micro, small and medium enterprises for sustainable poverty alleviation: grounded theory approach

    Waqf is the most effective way of expressing philanthropy for sustaining the welfare of the poor. It is a special mechanism through which constructive wealth is transferred from private ownership to public utility for servicing all sectors of life. So long as governments alone cannot cater for the basic needs of their peoples, philanthropic initiatives should be systematically exploited to tackle the menace of poverty. As an act of worship, waqf proves to be a prominent institution that caters for not only the poor but the entire community. About 75% of business opportunities in developing countries are proved to be provided by micro-, small- and medium-enterprises (MSMEs). Unfortunately, these vital job-providers are mostly underfinanced thereby leaving wide vacuums to be filled by ravaging poverty. This paper perceives the poor to be either active or inactive. The active poor are those who are physically and mentally capable of running dependable enterprises but are constrained by lack of, or inadequate, capital. The inactive poor, on the other hand, are those living in poverty while they are physically and/or mentally impaired. By adopting the grounded theory approach of qualitative research method, the researchers explore how poverty alleviation could be sustained through utilizing cash waqf to develop the earning potentials of the active poor for self-reliance and to provide decent social security services to the inactive poor

    Cash WAQF as an effective tool of financing MSMEs for sustainable poverty alleviation: a Nigerian perspective

    Poverty is not only an impediment to any meaningful development but a grazing ground for numerous crimes and civil disobedience. Globally, micro, small and medium enterprises (MSMEs) are generally known to contribute immensely towards poverty alleviation through their employment-generating potentials. In Nigeria, as this paper reveals, these potentials of MSMEs are seriously constrained by a lack of access to finance for the commencement, expansion or modernization of entrepreneurial activities. With the current state of waqf institution in the predominantly Muslim states in the country, this paper presents an operational mechanism for financing MSMEs in a bid to reduce the rate of poverty to the lowest level. The management of cash waqf has numerous debt and equity Islamic financing techniques based on profitand-loss-sharing (PLS) system that could be employed to achieve the desired objective.     Religion is no longer considered as the main obstacle, but it has become a motivating factor for the development of entrepreneurship management. However, a lot of research on entrepreneurship and its relation to religious values in terms of terminology, theoretical models, concepts and empirical been pioneered by the non-Muslim scholars either from the West part or the East part. In this case, the difference result is considered to be a reasonable based on the difference angle such as religion, culture and the background knowledge. This spiritual element has been discussed in a huge concept according to each religion itself. This study only focused on the Islamic religious dimension that related with faith, Sharia and morals associated with personality and behavior of respondents in the business sector only. The data obtained through questionnaires distributed among small entrepreneurs under Majlis Amanah Rakyat (MARA) in Kedah. The study found that the level of management religious practice among entrepreneurs is high and their impact on entrepreneurial activity in line with their identity as Malays.     Al-Wāqif is individual who donated his property (waqf) to the path of Allah. These properties (waqf)can be rented out to interested parties or used for various economic activities such as agriculture and livestock farming.In cases where the above methods are deemed unsuitable the endowment trustees (nazir) should try to find other alternatives to make the waqf land more productive. The endownment trustees should also explore other avenues to optimize the usage of endowment land under their care. Thus, real estate investment can be used as an alternative to develop the endowment land. Real estate/property investment on waqf assets can be implemented by constructing commercial buildings for rental purpose. The development of these lands will lead to the creation of new waqf assets.
