Europäische Betriebsräte: Genese, Formen und Dynamiken ihrer Entwicklung ; eine Typologie

"Der Artikel versucht, auf der Basis qualitativer Fallstudien die reale Vielfalt und unterschiedliche und uneinheitliche Praxis Europäischer Betriebsräte (EBR) mittels einer Typologie zu durchdringen und zu klassifizieren. Grundlegend für die Typenbildung ist eine konstitutionsanalytische Sicht, die den Gesamtprozess der Einrichtung und Entwicklung Europäischer Betriebsräte aus der dynamischen Wechselwirkung zwischen 'externen' Einflussfaktoren und 'internen' Konstitutionsbedingungen begreift. Innerhalb dieser übergreifenden Perspektive liegt der Typenbildung ein interessen- und akteursanalytischer Ansatz zugrunde. Sie setzt bei den institutionellen Voraussetzungen und der Praxis der Europäischen Betriebsräte an und bezieht zugleich das Handeln der Interaktionspartner (Management, nationale Arbeitnehmervertretung, Gewerkschaft) insoweit ein, wie dieses Handeln Möglichkeitsräume zukünftiger EBR-Praxis eröffnet, erweitert oder begrenzt. Die entsprechenden Prämissen und operationalen Kriterien werden im einzelnen entwickelt und daraus die vier Typen - symbolischer EBR, dienstleistender EBR, projektorientierter EBR, beteiligungsorientierter EBR - abgeleitet und anhand empirischen Materials 'mit Leben gefüllt'." The typology is based on the notion that the establishment and development of European works councils must be understood as a dynamic interaction between external and internal influences on the constitution of European Works Councils. This framework is used to analyse the interests and behaviour of the key actors. It focuses on the institutional setting and the actual practice of European works councils and considers the role of individuals and institutions that interact with them (management, national employees organisations, and trade unions) and how their actions expand or restrict future role of European works councils. The study identifies four types of European works councils - symbolic, service-oriented, project-oriented, and participation-oriented - and presents empirical material on each type." Europäische Betriebsräte: eine Konstitutionsanalyse ; zur Genese und Dynamik transnationaler Arbeitsbeziehungen

"Aus der Nachkonstruktion des Konstituierungsprozesses wird im folgenden die These entwickelt und begründet, dass der EBR sich dynamisch und tendenziell über die gesetzlichen Vorgaben ausbildet. Es wird gezeigt, wie und warum sich der EBR innerhalb einer Dekade von einem Informationsforum in Richtung eines Akteurs entwickeln konnte und wie sich hierbei eine 'interne' und 'externe' Dimension der Konstituierung wechselseitig beeinflusst haben. Die These eines zweifach determinierten, dynamischen Konstituierungsprozesses lautet mithin: Zwischen der Einrichtung von europäischen Informationsgremien auf freiwilliger Vereinbarungsbasis einerseits und der Verabschiedung und dem Wirksamwerden der Richtlinie andererseits besteht eine sich gegenseitig verstärkende Wechselwirkung. Dies betrifft zum einen die zahlenmäßige Verbreitung, wie die qualitative Ausformung der EBR. Ohne die ersten Pionierprojekte wäre es kaum möglich gewesen, den zur Verabschiedung der Richtlinie notwendigen gewerkschaftlichen und politischen Druck aufzubauen, die Anzahl verhandelter EBR zu vervielfachen und bis 1999 zu einer flächendeckenden Einrichtung von EBR zu kommen. Zum anderen hat die Praxis von EBR die prozeduralen Bestimmungen der Richtlinie in den freiwilligen Vereinbarungen vorweggenommen und dadurch letztlich erst ermöglicht." (Autorenreferat)"This study traces the process leading to the constitution of European works councils and arrives at the conclusion that the dynamic activity of European works councils propels them beyond the legal framework originally established for them. The study shows how and why the European works council has been able, in the course of a decade, to develop from a function primarily of information exchange to an active role. Internal and external factors contributed to this change. A complex developmental dynamic has been at work here, between implementation by voluntary agreement on the one hand, and the passing legal provisions on the other. This dual dynamic has affected both the quantitative expansion of European works councils and their qualitative configuration. Without the initial pioneer projects it would not have been possible to mobilise the trade union and political pressure needed to secure passage of the EU guideline, and to multiply the number of negotiated European works councils as an institution throughout the EU by the year 1999. The actual practice of European works councils anticipated the procedural regulations of the EU guideline in the voluntary agreements thus ultimately making the regulations possible." Die Corona-Pandemie

Zusammenfassung Die Covid-19-Pandemie hat zu radikalen Eingriffen in die Gesundheitsversorgung und das soziale Leben geführt, deren Effizienz und Angemessenheit aktuell immer stärker ins Zentrum von Auseinandersetzungen rückt. In diesem Sammelband reflektieren und kommentieren ausgewiesene Wissenschaftler/innen und Fachleute verschiedenster Disziplinen den Umgang mit der Pandemie. Thematisiert werden u.a. die Stellungnahmen nationaler Ethikkommissionen, die Triage-Problematik, die Vertretbarkeit von Eingriffen in Grundfreiheiten, die soziale Isolation Betroffener, der Umgang mit religiösen und spirituellen Bedürfnissen sowie tiefer liegende soziale Veränderungen in der Krise. Es wird damit ein wichtiger Beitrag zur Aufarbeitung der Corona-Krise geleistet. This paper gives an overview of the topic "economic governance". This term is used in economics and neighboring social sciences as a generic term under which usually all activities are subsumed that are conducted by economic policymakers to 'steer' or 'control' the economic system, individual markets therein or certain economic actors (e.g., businesses, consumers). In addition to a more detailed clarification of the concept of "economic governance" and the presentation of actors and instruments of economic governance, the paper discusses why and in what situations economic governance is necessary. The latter issue is the subject of a continuing debate in politics, the public and the social sciences
