    When Tradition Meets Modernity in Land Registration: Evidence from Dagbon, Ghana

    Development practice over recent years in much of Africa prioritized formalization of land policies deemed to enhance better handling and use of land as an asset for social development. Following this trend, land reform policy in Ghana was based on a pluralistic legal system in which both the customary land tenure system and the statutory system of land ownership and control co-exist by law. The primary research question for this study was the following: What implications emerge when customary land tenure system and the statutory system of land ownership and control co-exist in law? The study discussed the prospects and challenges of land title registration and the meaning of the new organizing concept in land ownership and administration among the people of Dagbon in the northern region of Ghana. The principal aim of the study was to assess the challenges of the implementation of a modern land registration system over a deeply traditional one. A qualitative research methodology was used and included qualitative descriptive analysis. This descriptive-analytical study was carried out to investigate opinions on the implications of the merger and preferred options for redress of any systemic challenges. It employed Focused Group Discussions (FGDs) to supplement in-depth interviews. Interviews were conducted among 40 key participants within formal and informal institutions including officials from both the Land Commission and Town and Country Planning Departments. Purposeful sampling was employed, and an interview guide was developed and used for collecting the data. Data were analyzed using a thematic approach. The results showed that in this structural reform, the ‘allodial title’ holder was much more trusted for tenure security because of the traditional legitimacy of the King as the sole owner and controller of land. The title registration system therefore principally served the secondary purpose as additional security. The findings indicate that in the circumstance where the law was seen as pliable, the policy engendered blurred and confusing effects that deepened the sense of ambiguity and outcomes were sometimes contradictory. We argued that the crossroads presented challenges that were novel and engendered innovative thinking for more appropriate solutions. The study revealed that policy reforms must be tailor-made to the physical, social, cultural and economic settings

    Boswellia and Commiphora Species as a Resource Base for Rural Livelihood Security in the Horn of Africa: A Systematic Review

    The dryland vegetation and particularly the Acacia-Commiphora woodlands support the livelihoods of approximately 52 million rural households in the Horn of Africa. Aromatic resins are valuable non-wood forest products (NWFPs) derived from Boswellia and Commiphora species in the drylands of this region. The study seeks to answer the following main questions: “What are the ecological and livelihood roles of resin producing species, and the role that people have in either degrading or restoring these ecosystems?” “Who are the participants in frankincense and myrrh production, processing, and trade, and how do these people interact?” “What is the current and potential future economic impact of frankincense and myrrh production and trade at the household level?” “What are the barriers to enhanced economic outcomes?” The study involves the use of PRISMA method—a systematic methodology to identify, select and analyze the recent literature on aromatic resins in relation to such factors as socio-economic situation, livelihood security, value chain, climate change adaptation, ecology and sustainable development in the Horn of Africa. Systematic identification of publications was conducted using several sources, including but not limited to electronic databases for literature search. Web of Science, Social Science Citation Index and Google Scholar and various scientific journals were investigated using search terms and restrictions. A total of 991 references were retrieved, but literature only published between 2003 to 2017 was selected, which led to the use of 51 works for full-text assessment. The results indicate that of the 51 selected studies, 45% focused on ecology and sustainable management, 31% on economic contribution and livelihood security, 20% on production and value chain development, and 4% on climate change adaptation and mitigation. It could be concluded that farmers’ adoption of Boswellia and Commiphora species as economic tree crops in the Horn of Africa has a distinct role in biodiversity conservation and climate change adaptation by contributing to the sustainability of ecosystem functioning as well as improving household incomes and the rural livelihood security in general, and thereby facilitating poverty alleviation

    Landed property as collateral to access credit for housing development in Ghana: The case of Northern Region of Ghana

    Property in the commons, or the Washington Consensus, as it is known in other circles, posits that landed property and access to formal credit are directly related. Whether landed property improves access to formal credit or not has been at the centre of the debate, with varying practical evidence, especially for the Global South. Another related dimension of the debate concerns the implications of family-help-mortgage arrangements using intra-family transfer of land as collateral to support a member's mortgage by placing a charge on the collective property. This paper investigates the use of landed property as collateral to access formal credit from financial institutions for housing development in the Tamale Metropolitan Area (TMA) in the Northern Region of Ghana. The primary research question is: does formal documentation of landed property as collateral help in accessing formal credit for housing development in TMA? The study involves the use of in-depth interviews to investigate the opinions of estate developers, credit officers of universal banks, and land title holders on the relative importance of landed property and access to credit for housing development. The data are analysed by means of thematic content analysis. The findings indicate that even though landed property may contribute to the decision to grant formal credit, it is not a turn-key solution easily accepted in the final lending decision. This study adds to the body of knowledge primarily by evaluating the effects of reforms to increase credit access with landed property as collateral in Ghana, investigating the implications of family-help mortgage arrangements, including the use of intra-family assets as collateral in obtaining loans for investment at the micro-level in Ghana. The paper concludes that while formal documentation of land rights matters in the broad scheme of estate financing, it is not sufficient to bring about more immediate access to credit, especially for those who lack regular or reliable systems of income that could be critical in ensuring the payback of loans contracted using landed property as collateral for housing development
