A educação sobre a igualdade como prevenção primária da violência de gênero

Neste trabalho científico procuro demonstrar a importância de aliar o Direito à Educação com enfoque na prevenção primária da violência de gênero, pois, ainda que demande esforço coletivo de longo prazo, percebi no decorrer da pesquisa ser de extrema necessidade que se inicie desde a infância para que os resultados sejam mais eficientes, em virtude da cultura patriarcal enraizada na sociedade ocidental. Apurei estudos sociológicos do fenômeno de dominação masculina, onde há sobreposição do homem sobre as minorias, especialmente as mulheres, do contexto familiar ao escolar, me permitindo constatar a possibilidade de transformação social por meio de atos governamentais e coletivos em prol da cidadania e igualdade. Ao considerar que o Direito contribuiu muito – e ainda o faz – para reafirmar as discriminações sociais, ressalto conquistas femininas que permitiram alterações comportamentais e atualizações normativas ao longo das décadas. Neste sentido, trago em contexto jurídico a análise do texto constitucional brasileiro, leis especiais de enfrentamento à violência doméstica e familiar contra a mulher, políticas públicas de incentivo, proteção e assistência às vítimas. A título complementar, referencio normas legais em vigor e procedimentos de ação integrada que objetivam o desenvolvimento de planos de formação pela prevenção de violência de gênero em Portugal. A regulamentação é indispensável à organização social (igualdade formal), contudo, fundamental que se faça uma correta interpretação e aplicação das normas (igualdade material) para que haja plena eficácia do ordenamento jurídico. Como forma de inserir-me com mais objetividade ao tema, buscando pôr em prática a norma, desenvolvi um programa de encontros com alunos de ensino fundamental numa escola rural em Araucária, região sul do Brasil, a fim de desmistificar a cultura patriarcal como verdade absoluta, questionando-os sobre os costumes sociais e a normalização da realidade sexista em que vivem. Associar a justiça ao ensino me permitiu compreender que a alteração comportamental de uma sociedade somente será possível progressivamente à transformação da cultura atual pelas novas gerações, isto é, que estas consigam reproduzir a empatia e o respeito como forma a enfrentar e reduzir significativamente a violência de gênero.In this scientific work I try to demonstrate the importance of combining the Right to Education with a focus on the primary prevention of gender violence, because even though it requires a long-term collective effort, I realized throughout the research that it is extremely necessary to start from childhood to that the results are more efficient because of the patriarchal culture rooted in western society. I investigated sociological studies of the phenomenon of male domination, where there is overlap of men over minorities, especially women, from the family to the school context, allowing me to see the possibility of social transformation through governmental and collective acts in favor of citizenship and equality. Considering that the law has contributed a lot - and still does - to reaffirm social discrimination, I highlight female achievements that have allowed behavioral changes and normative updates over the decades. In this sense, I bring in legal context the analysis of the Brazilian constitutional text, special laws to combat domestic and family violence against women, public policies of incentive, protection and assistance to victims. In addition, I refer to current legal rules and integrated action procedures that aim at the development of training plans for the prevention of gender violence in Portugal. Regulation is indispensable to social organization (formal equality), however, it is essential to make a correct interpretation and application of the rules (material equality) for the legal order to be fully effective. As a way of introducing myself more objectively to the theme, seeking to implement the norm, I developed a program of encounters with elementary students in a rural school in Araucaria, southern Brazil, in order to demystify the patriarchal culture as absolute truth, questioning them about social customs and the normalization of the sexist reality in which they live.
