State Sovereignty: Balancing Effectiveness and Legality/Legitimacy

This contribution seeks to explain why territorial entities formed in violation of fundamental norms of international law are not completely ignored by this legal system. The reason for this is not only to be found in functionalism or in the structural characteristics of the order itself.
