PERLINDUNGAN HUKUM TERHADAP HAK CIPTA LAGU PADA KEJAHATAN MAYANTARA (CYBER CRIME)

Pelanggaran hak cipta lagu yang saat ini menjadi perhatian bukan lagi pembajakan melalui media kaset CD ataupun DVD, melainkan juga melalui perkembangan teknologi internet. Pelanggaran hak cipta di jaringan internet, baik berupa download lagu atau video clips saat ini sangat memprihatinkan. Banyaknya website yang menyediakan download lagu gratis, sehingga dengan mudahnya pengguna mendapatkan lagu secara cepat dan gratis di internet. Penulisan hukum ini bertujuan untuk mengetahui dan menjawab permasalahan mengenai kendala dalam perlindungan hukum yang diberikan oleh Undang-Undang Nomor 19 tahun 2002 tentang Hak Cipta serta Undang-Undang Nomor 11 tahun 2008 tetang Informasi dan Transaksi Elektronik kepada para pencipta dan upaya pencegahan yang harus dilakukan agar tidak terjadi pelanggaran hak cipta atas lagu dan musik di internet. Penelitian ini merupakan penelitian normatif yang bersifat deskriptif. Sumber data yang dipergunakan adalah sumber data hukum sekunder. Data dikumpulkan dengan tehnik studi kepustakaan. Dari hasil penelitian ini, diperoleh data bahwa terdapat banyaknya kendala dalam perlindungan hak cipta atas lagu dan musik di internet dan upaya yang dilakukan untuk mencegah terjadinya pelanggaran hak cipta lagu dan musik di media internet yaitu dengan sosialisasi dan penanaman kebiasaan kepada masyarakat untuk memahami norma-norma yang ada, memberikan teguran dan pemblokiran terhadap website yang memfasilitasi illegal download. Copyright infringement songs that currently concern not to mention piracy through the media CD or DVD cassette, but also through the development of internet technology. Copyright infringement on the internet, either in the form of songs or video clips when this very concern. The large number of websites that provide free songs download, so easily get users quickly and free of charge on the internet. The writing of this law aims to acknowledge and answer the problems regarding the obstacles in the legal protection provided by Act No. 19 of 2002 on copyright and the law number 11 year 2008 about the information and electronic transactions to the creators and prevention efforts should be done in order not to breach copyright on songs and music on the internet. This research is a descriptive nature of normative research. The data source used is the secondary law of the data source. The data collected with technical studies library. From the results of this study, obtained the data that there is a large number of constraints in the protection of copyright on the song and music on the internet and efforts made to prevent the occurrence of violations of copyright songs and music on the internet media with socialization and cultivation of the habit to the community to understand the existing norms, provide the reprimand and the blocking against the website that facilitates illegal downloads.
