    Implikasi Hak Recall Partai Politik Terhadap Sistem Kedaulatan Rakyat

    Penelitian ini bertujuan untuk mengetahui apakah pengaturan hak recall partai politik sejalan dengan prinsip kedaulatan rakyat. Jenis penelitian ini adalah normatif, menggunakan pendekatan undang-undang (statute approach), pendekatan kasus (case approach) dan pendekatan historis (historical approach). Hasil penelitian menunjukkan bahwa pengaturan hak recall partai politik dalam peraturan perundang-undangan, tidak sejalan dengan prinsip kedaulatan rakyat, bahkan menggeser kedaulatan rakyat menjadi kedaulatan partai. Kata Kunci : Recall, Kedaulatan Rakyat, dan Partai Politik

    ENVIRONMENTAL PROTECTION POST ESTABLISHMENT OF OMNIBUS LAW ON JOB CREATION IN THE PERSECTIVE OF LOCAL GOVERNMENT AUTHORITY

    The dynamics of regulation of environmental protection, with the publication of the Omnibus Law on Job Creation, has had an impact on the content contained in Law Number 32 of 2009 concerning Environmental Protection and Management. The existence of the Omnibus Law on Job Creation has changed at least 27 articles, added 4 articles, and 10 articles were deleted in Law Number 32 of 2009. This paper aims to reflect on the legal implications of environmental protection after the Omnibus Law on Job Creation on regional authorities. The results of the study show that the Omnibus Law on Job Creation has reduced the authority of local governments in protecting the environment. There have been several withdrawals of local government affairs to the central government (recentralization), as well as the strengthening of evaluation instruments by the central government. This legal implication can be a challenge and a threat to solving problems and protecting the environment in the region. On the other hand, this can reduce the spirit of environmental decentralization and weaken the spirit of regional autonomy

    Tourism Policy: Local Wisdom and Integrated Coastal Zone Management

    The Pesawaran District governance conduct and cultivate the tourism potential in the coastal villages areas, through Integrated coastal zone management for sustainable by Department of Tourism and Creative economy. This research is focus on "how the strategy of local governance in managing the local wisdom being potential assets for tourism industry??".The method is qualitative descriptive, using data obtained through a large visit to the relevant key informant. The location of this research is in Pesawaran district. The results of the research are as follows: The tourism-management of the Pesawaran District develops into independent tourism industry based on local wisdom. The strategy undertaken through One Village One Destination (OVOD) program for tourism destination carried out by natives. Pesawaran governance is trying to develop villages in the District to serve as a tourist destination. Nowdays, among 148 villages are already develop as 50 top tourist destinations, among others: Sungai Langka Village in GedungTataan sub-district as agrotourism, village (Pekon) Ampai in MargaPunduh sub-district as natives house cultural destinations, NegeriKaton village as center handcrafter of SulamTapis, Muncak village in TelukPandan sub district has sea binoculars and the center of maritime tourism, GunungRejo village in Way Ratai sub-district has waterfalls, agro tourism and other destinations. The OVOD program is expected to provide tourist attraction to the potential of the each destination area. However, local governments still need to fix supporting facilities, such as the availability of shops, souvenir vending shops, restaurant, and other supporting facilities.     IMPLICATIONS OF OMNIBUS LAW ON JOB CREATION TOWARDS REGULATIONS IN DECENTRALIZATION PERSPECTIVE

    The discussion about omnibus law in the formation of laws and regulations has become a continuing discourse to this day, this is because omnibus law has been implemented in Indonesia through the work copyright law contained in Law Number 11 of 2020 concerning Job Creation. In its development, through the Constitutional Court Decision Number 91/PUU-XVIII/2020 on the Formal Review of Law Number 11 of 2020 concerning Job Creation, it is stated that the Job Creation Act is conditional. However, on one hand, the Instruction of the Minister of Home Affairs Number 68 of 2021 regarding the Follow-up to the Decision of the Constitutional Court Number 91/PUU-XVIII/2020 becomes a dilemma because in Indonesia regions must continue to follow the Job Creation Act and make adjustments to regional regulations on the follow-up to the existing law. The content material in the work copyright law is so diverse that it consists of eleven clusters and has changed, deleted and/or stipulated new arrangements for several provisions regulated in various laws, which have implications for the laws and regulations below them, including the regulations. On the other hand, some local government authorities have also experienced a shift through the law. The implications of the omnibus law regarding job creation on regional regulations include the deregulation of various regional regulations as a delegation of norms from higher regulations, and the responsibility of regional governments in harmonizing and synchronizing regional regulations in an effort to optimally implement autonomy and co-administration tasks

    Legal Discourse on Customary Forest Determination Progressive Law Based

    Customary forests are an integral part of the life of indigenous and tribal peoples. MK Decision No. 35/PUU-X/2012 is a progressive step stipulating that customary forests are no longer part of State forests. However, after the decision, there is still a long process that the Indigenous Peoples must pass to obtain their rights. This article aims to describe the legal discourse in determining the customary forest. Using doctrinal research methods as well as statutory and conceptual approaches, it was found that: The designation of customary forests is an important matter in the context of implementing the constitutional rights of customary law communities that existed even before Indonesia was established as a sovereign country. The long and procedural process of establishing customary forests requires the support of the regional government through various progressive policies to create indigenous peoples who are sovereign over their customary forests. With the legal credo for humans, progressive law offers an approach that can become the basis for the realization of legal policies for establishing customary forests in the regions

    Peran koperasi yang sangat besar bagi perekonomian masyarakat sudah terbukti mampu bertahan dalam menghadapi krisis perekonomian. Koperasi merupakan potensi dalam mengembangkan ekonomi nasional. Selain itu, koperasi juga mewakili sistem ekonomi indonesia yang berciri khas asas kekeluargaan dan gotong royong, bukan kapitalisme. Kegiatan Pengabdian ini bertujuan untuk mengedukasi aparatur desa mengenai Perlindungan dan Pemberdayaan Koperasi Pasca UU Cipta Kerja. Hal ini karena berbagai adanya perubahan kebijakan hukum terhadap koperasi menjadi bagian penting yang juga perlu dipahami oleh desa. Kegiatan ini menjadi sebuah solusi agar desa dalam melakukan upaya dalam pengembangan koperasi di wilayahnya. Sehingga sasaran khalayak dalam kegiatan ini adalah pemerintah desa, badan permusyawaratan desa, dan perwakilan masyarakat. Lokasi kegiatan dilaksanakan di Desa Fajar Baru. Metode yang digunakan dalam kegiatan ini yaitu melalui ceramah, dan diskus. Hasil kegiatan menunjukkan bahwa: kesadaran hukum masyarakat dalam Perlindungan dan Pemberdayaan Koperasi Pasca UU Cipta telah meningkat hingga 88%. Hal ini ditunjukkan dengan beberapa indikator diantaranya: peran koperasi; perlindungan hukum koperasi dalam peraturan perundang-undangan; otonomi desa; dan perlindungan koperasi pasca UU Cipta Kerja.&nbsp

    This Community Service activity aims to increase legal awareness of the community, especially the younger generation in understanding their own human rights and the importance of respecting the human rights of others within the framework of the rule of law. This is important so that students do not only promote the Human Rights inherent in themselves, but ignore the Human Rights which are also attached to others. The specific target of this activity is expected to be a solution and an effort to encourage a culture of law awareness so that the conditions for law-abiding and law-abiding among young people are increasingly created. So that the target audience in this activity is high school students. The location of the activity was carried out at MAN 1 Bandar Lampung. The method used in this activity is through lectures and discussions. It is hoped that after this activity is carried out, the participants will increase their understanding of Human Rights as regulated in laws and regulations so as to encourage the creation of a culture of legal awareness. The results of the activity show that: the legal awareness of the activity participants towards human rights has increased by up to 85%. This is indicated by several indicators including human rights; children's rights; the purpose of protecting human rights; regulation of human rights in Indonesia; and the importance of a litigious culture

    ABSTRAK. Pengelolaan pertambangan mineral bukan logam dan batuan merupakan salah satu urusan pemerintahan yang dibagi secara konkuren antara pemerintah pusat, pemerintah provinsi dan pemerintah kabupaten/kota. Studi ini bertujuan untuk memetakan harmonisasi pengaturan kewenangan pengelolaan pertambangan mineral bukan logam dan batuan melalui pemberian izin pertambangan rakyat. Penelitian hukum yang menggunakan optik doktrinal ini menunjukkan bahwa terjadi disharmonisasi horizontal antar undang-undang yang mengatur kewenangan pemberian izin pertambangan rakyat. UU No. 23 Tahun 2014 memberikan kewenangan pemberian izin pada pemerintah provinsi, sedangkan UU No. 4 Tahun 2009 memberikan kewenangan pemberian izin pada pemerintah kabupaten/kota. Kondisi disharmonisasi tersebut menimbulkan ketidakpastian hukum bagi pengusaha pertambangan sehingga akan mempengaruhi iklim usaha pertambangan rakyat di daerah, sehingga disarankan agar pemerintah pusat dan dewan perwakilan rakyat (DPR), perlu meninjau kembali kewenangan pemberian izin pertambangan rakyat, dengan mengembalikan kewenangan tersebut dari perspektif rezim hukum pemerintahan daerah kepada pemerintah kabupaten/kota, karena rentang kendalinya dengan pelaku dan wilayah pertambangan lebih singkat sehingga cenderung lebih berdayaguna dan berhasilguna.   Harmonization of Regulation Local Government Authority in The Management of Non-Metal Mineral and Rock Mining   ABSTRACT. Mineral non-metal and rocks mining management is one of the government affairs are shared concurrently between the central government, provincial government and district/city governments. This study aims to mapping the harmonization of authority regulation in the management of non-metallic mineral and rock mining through the granting of people permits mining. This legal research that used the doctrinal optical shows that there is horizontal disharmony between the governing legislation in the licensing mining authority. Law No. 23 of 2014 granting the authorizes of licenses to the provincial government, while Law No. 4 of 2009 provides the authority to grant permission to the district/city government. The disharmony conditions create legal uncertainty for mining entrepreneurs that will affect people's mining business climate in the area, so it is suggested that the central government and the parliament (DPR), need to review the authority regulation in the management of non-metallic mineral and rock mining, to restore the authority of licensing in the perspective of local government legal regime area to the district/city, because of its control range with actors and mining areas tend to be shorter so effective and efficient

    The standard of environmental quality is one of the instruments in preventing environmental pollution beside KLHS, special plan, environemtal analysis, UKL-UPL, permission, etc. the standard comprises of the standards of water, water waste, sea water, air ambien, emission, and nuisance. Politics of law in determination of the standards as a preventive  instrument of the pollution is based on Article 28H verse (1) of the Indonesian Constitution 1945 states that healthy and good environment is a human rights that should be guaranteed, Article 33 of the Act also provides that national economy must be based on economic democracy by environmentally principle. The determination is one of the legal responsive forms raised from democracy politics configuration to answer the need of people for the healthy and good environment.
