Constitutional court in Turkish political life (1960-1980)
Bu çalışmada, 1960-1980 dönemi içerisinde Anayasa Mahkemesinin Türk
siyasi hayatındaki rolünün, 1961 Anayasası temelinde değerlendirilmesi
amaçlanmaktadır. Anayasacılık akımı doğal hukuk, toplum sözleşmesi ve kuvvetler
ayrılığı ilkesi çerçevesinde geliştirilmiştir. Bu amaçla hedeflenen siyasi iktidarın
keyfi yönetimine karşı temel hak ve özgürlüklerin garanti altına alınması ve bir
denge mekanizması kurulmasıdır. Anayasacılık akımının önemli kurumlarından
bir tanesi de Anayasa Mahkemesidir.
Türk Anayasa Mahkemesi ise, kurulduğu 1962 yılından günümüze hem
demokratik meşruiyeti açısından hem de verdiği kararlarla sürekli tartışılan, hatta
zaman zaman varlığı sorgulanan bir kurum haline gelmiştir. Özellikle anayasal
yetkisini aştığı gerekçesiyle yoğun bir şekilde eleştirilmekte ve zaman zaman siyasi
ve hukuki krizlere yol açmaktadır. Bu nedenle, şekil denetiminin kavramsal bir
çerçevesinin çizilmesi ve Anayasa Mahkemesinin bu konuda verdiği kararların
ortaya çıkardığı sorunların çözüm yollarının ortaya konulması Türk Anayasa
Yargısı açısından büyük önem taşımaktadır.
Bu amaçla birinci bölümde anayasa yargısının gelişimi, işlevi ve meşruluğu
araştırılmıştır. İkinci bölümde 1960-1980 döneminde siyasi hayat ve bu dönemde
Anayasa Mahkemesinin kuruluşu, işleyişi, siyasi hayat içerisinde öne çıkan
kararları ve etkileri incelenmiştir. Üçüncü ve son bölümde ise bu dönemde aldığı
kararlar ve yüklendiği işlevler göz önüne alınarak kurumsal varlığı üzerine
değerlendirmeler yapılmıştır.In this study, it is aimed to evaluate the role of the Constitutional Court in
Turkish political life in the period 1960-1980 on the basis of 1961 Constitution. The
constitutionalism movement was developed within the framework of natural law,
social contract and separation of powers. To this end, the aim is to guarantee
fundamental rights and freedoms against the arbitrary rule of political power and
to establish a balance mechanism. One of the important institutions of the
constitutionalism is the Constitutional Court.
The Turkish Constitutional Court, on the other hand, has become an
institution that has been constantly debated and even questioned from time to time
both in terms of its democratic legitimacy and its decisions since its establishment in
1962. In particular, its criticized extensively on the grounds that it has exceeded its
constitutional authority and sometimes cause political and legal crises. For this
reason, it has great importance for the Turkish Constitutional Judiciary to draw a
conceptual framework of shape control and to provide solutions to the problems
raised by the decisions of the Constitutional Court on this matter.
For this purpose, in the first part of the thesis, the development, function and
legitimacy of the constitutional jurisdiction are searched. In the second part,
political life in 1960-1980 period and the constitution, operation, prominent
decisions and effects of the Constitutional Court in this period are examined. In the
third and the last part, there are evaluations which made on the corporate existence
by taking into consideration the decisions taken and the functions undertaken in this
period
