Du tribunal de Nuremberg au Tribunal permanent des peuples

From the Court of Nürnberg to the Permanent People's Court, by Edmond Jouve Given the difficulties encountered in the creation of an international criminal court and given the powerlessness of existing international courts in the field of human rights, original solutions have been sought. Some of these have received the approval of the community of nations. This was the case of the Courts of Nürnberg and Tokyo at the end of World War II to which was given the task to judge the chief war criminals of Germany and Japan. Even though these precedents are faulted in that they were born out of "might makes right", they have had the incomparable merit of having opened a "cycle for the future, creating a precedent, the embryo of a tradition". After having inherited these precedents, the courts of opinion are trying to strenghten them. This is the case today with the Russell Court and the Permanent People's Court.Du tribunal de Nuremberg au Tribunal permanent des peuples, par Edmond Jouve Devant les difficultés rencontrées par la création d'une Cour criminelle internationale, devant l'impuissance des juridictions internationales existantes, en matière de droit des peuples, des solutions originales ont été recherchées. Certaines ont reçu l'aval de la société des Etats. Ce fut le cas, à la fin du second conflit mondial, des tribunaux de Nuremberg et de Tokyo, qui se virent confier la mission de juger les grands criminels de guerre allemands et japonais. Même si ces précédents ne sont pas sans tâche - ils sont nés du droit du plus fort -, ils ont eu l'incomparable mérite d'ouvrir "un cycle d'avenir, en créant un précédent, l'embryon d'une tradition". Après l'avoir recueillie, les tribunaux d'opinion s'efforcent de la consolider. Tel est le cas, aujourd'hui, des tribunaux Russel et du Tribunal permanent des peuples.Jouve Edmond.
