FEDERAL COURTS-VENUE-TRANSFER TO A MORE CONVENIENT FORUM UNDER TITLE 28, UNITED STATES CODE, SECTION 1404(a)

A cause of action based on diversity of citizenship was brought in a United States District Court in Pennsylvania by a New York corporation against a Delaware corporation. Plaintiff joined a New York corporation as an involuntary plaintiff. Defendant then moved for a transfer based on forum non conveniens to the Southern District of New York. Held, this suit could not have been brought originally in the Southern District of New York since the present involuntary plaintiff, amenable to process in that district, could only have been joined as a defendant and diversity of citizenship would have been absent. Integrated responses to domestic violence: legally mandated intervention programmes for male perpetrators

    No full text
International surveys have suggested that around one-third of all adult women will, at some point in their lifetime, experience abuse perpetrated by an intimate male partner. Domestic violence is considered to be one of the major risk factors affecting women’s health in Australia and there is a need for the community to respond in ways that reduce the likelihood of further violence occurring. One way of doing this is to deliver programs that aim to reduce the risk of known perpetrators committing further offences. This paper describes the outcomes of a Gold Coast program delivered to men who perpetrate domestic violence and who are legally obliged to participate. The data show that this type of program can produce positive changes in participants. However, the extent to which such changes lead to direct behavioural change is less clear and further research and evaluation is required to develop the evidence base that is needed to ensure that programs for perpetrators produce significant and enduring improvements to community safety.<br/

Professional views on the management of sex offenders in the community

Sex offender registration and community notification schemes form an increasingly important part of public policy relevant to the management of known sex offenders in the community. Critics of these policies not only point to the lack of empirical evidence that is currently available to support their impact on reoffending, but also the disproportionate and potentially iatrogenic effects that they have on offenders. However, there have been few attempts to understand these issues from the perspective of those practitioners who work on a daily basis with sex offenders in the community. These professionals are uniquely placed to contribute to an understanding of effective risk management and, as such, this article presents an analysis of the perspectives of a group of experienced practitioners and how this practice-based wisdom might inform the development of sex offender public policy
