Cumulative Harm, Products Liability, and Bilateral Care

    Get PDF
We extend consideration of cumulative harm in products liability to the case of bilateral care. For this specification, the level of care and the level of output chosen by the firm are inextricably interrelated, and different liability regimes yield different combinations of care and output. As in the case of bilateral care with proportional harm, strict liability by itself leads to moral hazard on the part of the consumer, but strict liability with a defense of contributory negligence on the part of the consumer is now a resilient (that is, both robust and convergent) liability rule when harm is cumulative

Revelation and Suppression of Private Information in Settlement Bargaining Models

We discuss the implications of various models of settlement negotiations for the revelation or suppression of private information held by the parties. This information may be relevant to multiple audiences, including those involved in the instant lawsuit; other potential litigants that may subsequently make use of the information in their own suits against one of the parties; and more distant observers and users of the legal process. We also examine how rules of evidence and rules of civil procedure can sometimes result in different degrees of purposeful or (arguably) unintended information suppression

Experimental investigation of turbulent heat transfer in straight and curved rectangular ducts

    Get PDF
An experimental investigation was conducted to examine the convective heat transfer in straight and curved ducts of rectangular cross-section. The experimental configuration was modeled at infinite parallel plates with one wall at a constant temperature and the opposite wall adiabatic. The experiments were conducted at steady state for turbulent flow. Average Nusselt numbers were used to compare the heat transfer characteristics of the straight and curved sections. The development of Taylor-Gortler vortices in the curved section was shown to enhance the heat transfer rate in the curved section as compared to that of the straight section by approximately 15-to 20 percent. Improved heat exchanger designs and improved cooling of turbine blades are two disciplines that could benefit from a better understanding of the effects of curvature on the rate of heat transfer.http://archive.org/details/experimentalinve00wilsLieutenant, United States NavyApproved for public release; distribution is unlimited

THEOLOGICAL DISCUSSION AND INSTITUTIONAL CHANGE AT A CHURCH-RELATED INSTITUTION

    Get PDF
This study explores the relationship between theological discussion and organizational change within a church-related institution. The qualitative case study examines the dialogue on a campus that received a Lilly Endowment grant through their Program for the Theological Exploration of Vocation to engage its campus community in the theological discussion of vocation. The study makes correlations between theological discussions and institutional changes that occurred as a result of those discussions. The college in the study is a private, church-related institution. Organizational change theory provides the framework for analysis.  Ed.D
