The Jurisprudence of Transformation: Intellectual Incoherence and Doctrinal Murkiness Twenty Years After Campbell v. Acuff-Rose Music
Examining recent judicial opinions, this Article analyzes and critiques the transformative-use doctrine two decades after the U.S. Supreme Court introduced it into copyright law in Campbell v. Acuff-Rose Music. When the Court established the transformative-use concept, which plays a critical role in fair-use determinations today, its contours were relatively undefined. Drawing on an influential law-review article, the Court described a transformative use as one that adds “new expression, meaning or message.” Unfortunately, the doctrine and its application are increasingly ambiguous, with lower courts developing competing conceptions of transformation. This doctrinal murkiness is particularly disturbing because fair use is a key proxy for First Amendment interests in copyright law. This Article traces the evolution of transformative use, analyzes three key paradigms of transformative use that have gained prominence in the post-Campbell environment, and offers suggestions for a jurisprudence in which transformative use is a less significant component of the fair-use analysis
Improved Spin Dynamics Simulations of Magnetic Excitations
Using Suzuki-Trotter decompositions of exponential operators we describe new
algorithms for the numerical integration of the equations of motion for
classical spin systems. These techniques conserve spin length exactly and, in
special cases, also conserve the energy and maintain time reversibility. We
investigate integration schemes of up to eighth order and show that these new
algorithms can be used with much larger time steps than a well established
predictor-corrector method. These methods may lead to a substantial speedup of
spin dynamics simulations, however, the choice of which order method to use is

Fissures, Fractures & Doctrinal Drifts: Paying the Price in First Amendment Jurisprudence for a Half Decade of Avoidance, Minimalism & Partisanship
This Article comprehensively examines how the U.S. Supreme Court’s adherence to principles of constitutional avoidance and judicial minimalism, along with partisan rifts among the Justices, have detrimentally affected multiple First Amendment doctrines over the past five years. The doctrines analyzed here include true threats, broadcast indecency, offensive expression, government speech, and strict scrutiny, as well as the fundamental dichotomy between content-based and contentneutral regulations
Crowd sourcing challenges assessment index for disaster management
Emergency agencies (EA) rely on inter-agency approaches to information management during disasters. EA have shown a significant interest in the use of cloud-based social media such as Twitter and Facebook for crowd-sourcing and distribution of disaster information. While the intentions are clear, the question of what are its major challenges are not. EA have a need to recognise the challenges in the use of social media under their local circumstances. This paper analysed the recent literature, 2010 Haiti earthquake and 2010-11 Queensland flood cases and developed a crowd sourcing challenges assessment index construct specific to EA areas of interest. We argue that, this assessment index, as a part of our large conceptual framework of context aware cloud adaptation (CACA), can be useful for the facilitation of citizens, NGOs and government agencies in a strategy for use of social media for crowd sourcing, in preventing, preparing for, responding to and recovering from disasters. © (2012) by the AIS/ICIS Administrative Office All rights reserved
Construction and Measurements of an Improved Vacuum-Swing-Adsorption Radon-Mitigation System
In order to reduce backgrounds from radon-daughter plate-out onto detector
surfaces, an ultra-low-radon cleanroom is being commissioned at the South
Dakota School of Mines and Technology. An improved vacuum-swing-adsorption
radon mitigation system and cleanroom build upon a previous design implemented
at Syracuse University that achieved radon levels of
0.2Bqm. This improved system will employ a better pump and
larger carbon beds feeding a redesigned cleanroom with an internal HVAC unit
and aged water for humidification. With the rebuilt (original) radon mitigation
system, the new low-radon cleanroom has already achieved a 300
reduction from an input activity of Bqm to a

Longitudinal magnetic excitations in classical spin systems
Using spin dynamics simulations we predict the splitting of the longitudinal
spin wave peak in all antiferromagnets with single site anisotropy into two
peaks separated by twice the energy gap at the Brillouin zone center. This
phenomenon has yet to be observed experimentally but can be easily investigated
through neutron scattering experiments on MnF and FeF. We have also
determined that for all classical Heisenberg models the longitudinal
propagative excitations are entirely multiple spin-wave in nature.Comment: four pages three figures, the last two postscript files are two parts
