O DEPOIMENTO ESPECIAL DE CRIANÇAS E ADOLESCENTES VÍTIMAS DE CRIMES SEXUAIS COMO FORMA DE PREVENÇÃO DA REVITIMIZAÇÃO

This article aimed to analyze the institute of special testimony of child and adolescent victims of sexual violence established by Law nº. 13.341/2017, which establishes assistance and protection measures for children and adolescents, victims or witnesses of crimes of violence, aiming to avoid, among other possibilities, the revictimization of the juvenile population. Therefore, for a better understanding of the topic, the methodology currently used for its collection will be presented, and an overview of children's rights will be presented, elucidating points on full protection as well as the history of protection of minors in the legal system and some particularities of sexual crimes against vulnerable, in the same way, intra-family and extra-family sexual violence, achieving the objective of extolling the rights and duties imposed by the legislation, in the effective search for protection of children and adolescents victims or witnesses of violence, aiming to avoid, among other possibilities , the revictimization of the juvenile population. Implemented by Law No. 13,431/2017, the Special Testimony is, therefore, extremely important to establish a flow of assistance without harming children and adolescents subject to legal protection. Children and teenagers.O presente artigo teve como objetivo analisar o instituto do depoimento especial da criança e do adolescente vítimas de violência sexual instituído pela Lei nº. 13.341/2017, que estabelece medidas de assistência e proteção à criança e ao adolescente, vítimas ou testemunhas de crimes de violência, visando evitar, entre outras possibilidades, a revitimização da população infantojuvenil.  Sendo assim, para melhor compreensão do tema, será apresentada a metodologia atualmente utilizada para sua colheita, e apresentar uma visão geral sobre os direitos infantojuvenis, elucidando pontos sobre a proteção integral bem como o histórico de proteção dos menores no ordenamento jurídico e algumas particularidades dos crimes sexuais contra vulnerável, da mesma forma, a violência sexual intrafamiliar e extrafamiliar, alcançando o objetivo de enaltecer os direitos e deveres impostos pela legislação, na busca efetiva de proteção às crianças e adolescentes vítimas ou testemunhas de violência, visando evitar, entre outras possibilidades, a revitimização da população infantojuvenil. Efetivado pela Lei nº 13.431/2017, o Depoimento Especial é, portanto, de extrema importância para estabelecer um fluxo de atendimento sem que haja danos às crianças e adolescentes sujeitos de proteção legal.
