    Patent Scope and Innovation in the Software Industry

    Software patents have received a great deal of attention in the academic literature. Unfortunately, most of that attention has been devoted to the problem of whether software is or should be patentable subject matter. With roughly eighty thousand software patents already issued, and the Federal Circuit endorsing patentability without qualification, those questions are for the history books. The more pressing questions now concern the scope to be accorded software patents. In this Article, we examine the implications of some traditional patent law doctrines for innovation in the software industry. We argue that patent law needs some refinement if it is to promote rather than impede the growth of this new market, which is characterized by rapid sequential innovation, reuse and re-combination of components, and strong network effects that privilege interoperable components and products

    First Results of the 74 MHz VLA-Pie Town Link. Hercules A at Low Frequencies

    We present the results of the first successful observations of the Pie Town link with the Very Large Array (VLA) at 74 MHz on Hercules A. The improvement in resolution from 25 arcsec to 10 arcsec resolves the helical- and ring-like features seen at higher frequencies. We also present new high dynamic range images of this powerful radio galaxy at 325 MHz. Our low frequency observations confirm the multiple outburst interpretation of the spectral index differences at high frequencies. Comparison between our radio and ROSAT X-ray data does not reveal any association between the X-ray emission from the cluster and the radio lobes.     Relative importance of crystal field versus bandwidth to the high pressure spin transition in transition metal monoxides

    The crystal field splitting and d bandwidth of the 3d transition metal monoxides MnO, FeO, CoO and NiO are analyzed as a function of pressure within density functional theory. In all four cases the 3d bandwidth is significantly larger than the crystal field splitting over a wide range of compressions. The bandwidth actually increases more as pressure is increased than the crystal field splitting. Therefore the role of increasing bandwidth must be considered in any explanation of a possible spin collapse that these materials may exhibit under pressure.Comment: 7 pages, 4 figure

    The Detailed Chemical Abundance Patterns of M31 Globular Clusters

    We present detailed chemical abundances for >>20 elements in ∼\sim30 globular clusters in M31. These results have been obtained using high resolution (λ/Δλ∼\lambda/\Delta\lambda\sim24,000) spectra of their integrated light and analyzed using our original method. The globular clusters have galactocentric radii between 2.5 kpc and 117 kpc, and therefore provide abundance patterns for different phases of galaxy formation recorded in the inner and outer halo of M31. We find that the clusters in our survey have a range in metallicity of −2.2<-2.2<[Fe/H]<−0.11<-0.11. The inner halo clusters cover this full range, while the outer halo globular clusters at R>>20 kpc have a small range in abundance of [Fe/H]=−1.6±0.10=-1.6 \pm 0.10. We also measure abundances of alpha, r- and s-process elements. These results constitute the first abundance pattern constraints for old populations in M31 that are comparable to those known for the Milky Way halo.Comment: XII International Symposium on Nuclei in the Cosmos August 5-12, 2012 Cairns, Australia.
