GETTING BACK THE CONTROVERSY AROUND THE ACTION: COMPREHENSIVE APPOINTMENTS TO A TERMINOLOGICAL DISPUTE

The proposal of this text is, from a comprehensive perspective, to demonstrate that there is some reason in the various conceptual lines around the action. Essentially, the intent is to demonstrate that each of the word “action” famous uses tried to describe a different juridical phenom, whereby, instead of being incompatible concepts which exclude each other, the ideas should be used together to complement each other for a complete perception of the legal problem. However, certainly the most adequate is the selection of different terms to designate each of the conceptual objects, as a requirement of terminological precision and to avoid ambiguities
