    Restoring RLUIPAs Equal Terms Provision

    The Religious Land Use and Institutionalized Persons Act\u27s (RLUIPA) equal terms provision prohibits government from implementing a land-use regulation in a manner that treats religious assemblies and institutions less favorably than secular assemblies and institutions. Lower courts have only begun to interpret and apply RLUIPA\u27s equal terms provision, but already they have significantly weakened its protections of religious liberty by giving the provision unnecessarily restrictive interpretations. Not surprisingly, in light of the Supreme Court\u27s invalidation of the Religious Freedom Restoration Act of 1993 (RFRA), the lower courts\u27 restrictive readings seen? driven by concerns that a broader interpretation would exceed Congress\u27s Fourteenth Amendment enforcement power. Yet the lower courts\u27 concerns about the constitutionality of a broader interpretation are misplaced, and their restrictive readings of the equal terms provision severely weaken RLUIPA\u27s protections of religious liberty. This Note argues that a textual interpretation of the provision, which would strictly prohibit unequal treatment of religious assemblies and institutions as compared to secular assemblies and institutions, falls within Congress\u27s prophylactic power under Section 5 of the Fourteenth Amendment. Moreover, a textual interpretation is more consistent with Congress\u27s intent to broadly protect religious liberty

    Outcome Measures for Chronic Cough: A Literature Review

    Background: Approximately 9-10 percent of adults experience chronic cough. Chronic cough is a cough that lasts greater than eight weeks, with significant impacts on an individual\u27s quality-of-life in social, psychological, and physical domains. Current treatment is not successful for all patients, and a lack of validated outcome measures makes it challenging to determine the efficacy of experimental chronic cough interventions. Aims: The purpose of this review is to determine the optimal protocols for outcome measures needed to ascertain the efficacy of chronic cough treatment. Main contribution: Inconsistent correlations were found between objective and subjective outcome measures. The strongest outcome measure correlations were found between cough-specific quality-of-life questionnaires and objective cough frequency counting. Methods of objective measures vary and require further investigation. Conclusions: Data from both subjective and objective outcome measures are needed to determine a cough treatment\u27s efficacy due to the different constructs measured by each tool, and the inconsistent correlations found between subjective and objective outcome measures. Additionally, further standardization is needed for subjective outcome tools

    This snapshot focuses on a doctoral study at the University of Manchester which is situated within a larger ESRC funded study, ‘The Hair and Care Project’, which seeks to explore the relationship between appearance and personal identity for people with dementia. The snapshot presents male shaving as a case example of bodywork in dementia care and argues that male shaving could be a revealing lens through which to explore masculinity and embodiment in dementia care

    Speech and language impairments after left hemisphere stroke are life altering. Neuroprotective interventions, such as tissue plasminogen activator, or tPA, are utilized to diminish the impact of the stroke on functional ability. The purpose of this study was to examine speech and language recovery in the first three months after stroke in individuals with aphasia and to further investigate any differences between individuals who did and individuals who did not receive tPA, using objective speech and language measures. Twenty-six individuals, thirteen of whom received tPA and thirteen who did not, suffering from first-ever left hemisphere stroke with resulting aphasia were enrolled and completed repeated speech and language assessments within 24 hours after stroke, at one and two weeks after stroke. A three month assessment also included an additional quality of life measure. Findings indicate that both individuals who did and those who did not receive tPA demonstrated significant gains in language skills. Results also suggest that the individuals who received tPA have better outcomes at three months compared to those who did not. This is clinically significant as it helps provide prognostic information about the use of tPA and informs decision making for speech pathologists within the acute care hospital
