Trucks on our turf: Seeking to resolve the international inconsistency in Public Citizen v. Department of Transportation
Such it is with international trade. What was once a world divided into separate and distinct cultures has now become a globe where borders continually fade and cease to exist. Although this progress brings new opportunities to many, it similarly awakens emotions of apprehension and uncertainty, while creating clashes between what was known and what is yet to be discovered. A recent Ninth Circuit case, Public Citizen v. Department of Transportation,6 illuminated inconsistencies that may occur when transnational interactions attempt to fit into our previously ethnocentric societies. The discrepancy brought to light through this decision concerned a claimed conflict between an international arbitration decision under the North American Free Trade Agreement7 (hereinafter âNAFTAâ) and United States environmental law
Relating characteristics of global biodiversity targets to reported progress
To inform governmental discussions on the nature of a revised Strategic Plan for Biodiversity of the Convention on Biological Diversity (CBD), we reviewed the relevant literature and assessed the framing of the 20 Aichi Biodiversity Targets in the current strategic plan. We asked international experts from nongovernmental organizations, academia, government agencies, international organizations, research institutes, and the CBD to score the Aichi Targets and their constituent elements against a set of specific, measurable, ambitious, realistic, unambiguous, scalable, and comprehensive criteria (SMART based, excluding time bound because all targets are bound to 2015 or 2020). We then investigated the relationship between these expert scores and reported progress toward the target elements by using the findings from 2 global progress assessments (Global Biodiversity Outlook and the Intergovernmental ScienceâPolicy Platform on Biodiversity and Ecosystem Services). We analyzed the data with ordinal logistic regressions. We found significant positive relationships (p < 0.05) between progress and the extent to which the target elements were perceived to be measurable, realistic, unambiguous, and scalable. There was some evidence of a relationship between progress and specificity of the target elements, but no relationship between progress and ambition. We are the first to show associations between progress and the extent to which the Aichi Targets meet certain SMART criteria. As negotiations around the postâ2020 biodiversity framework proceed, decision makers should strive to ensure that new or revised targets are effectively structured and clearly worded to allow the translation of targets into actionable policies that can be successfully implemented nationally, regionally, and globally
Date Rape: The Intractability of Hermeneutical Injustice
Social epistemologists use the term hermeneutical injustice to refer to a form of epistemic injustice in which a structural prejudice in the economy of collective interpretive resources results in a personâs inability to understand his/her/their own social experience. This essay argues that the phenomenon of unacknowledged date rapes, that is, when a person experiences sexual assault yet does not conceptualize him/her/their self as a rape victim, should be regarded as a form of hermeneutical injustice. The fact that the concept of date rape has been widely used for at least three
decades indicates the intractability of hermeneutical injustices of this sort and the challenges with its overcoming
New Constraints (and Motivations) for Abelian Gauge Bosons in the MeV-TeV Mass Range
We survey the phenomenological constraints on abelian gauge bosons having
masses in the MeV to multi-GeV mass range (using precision electroweak
measurements, neutrino-electron and neutrino-nucleon scattering, electron and
muon anomalous magnetic moments, upsilon decay, beam dump experiments, atomic
parity violation, low-energy neutron scattering and primordial
nucleosynthesis). We compute their implications for the three parameters that
in general describe the low-energy properties of such bosons: their mass and
their two possible types of dimensionless couplings (direct couplings to
ordinary fermions and kinetic mixing with Standard Model hypercharge). We argue
that gauge bosons with very small couplings to ordinary fermions in this mass
range are natural in string compactifications and are likely to be generic in
theories for which the gravity scale is systematically smaller than the Planck
mass - such as in extra-dimensional models - because of the necessity to
suppress proton decay. Furthermore, because its couplings are weak, in the
low-energy theory relevant to experiments at and below TeV scales the charge
gauged by the new boson can appear to be broken, both by classical effects and
by anomalies. In particular, if the new gauge charge appears to be anomalous,
anomaly cancellation does not also require the introduction of new light
fermions in the low-energy theory. Furthermore, the charge can appear to be
conserved in the low-energy theory, despite the corresponding gauge boson
having a mass. Our results reduce to those of other authors in the special
cases where there is no kinetic mixing or there is no direct coupling to
ordinary fermions, such as for recently proposed dark-matter scenarios.Comment: 49 pages + appendix, 21 figures. This is the final version which

The mu problem and sneutrino inflation
We consider sneutrino inflation and post-inflation cosmology in the singlet
extension of the MSSM with approximate Peccei-Quinn(PQ) symmetry, assuming that
supersymmetry breaking is mediated by gauge interaction. The PQ symmetry is
broken by the intermediate-scale VEVs of two flaton fields, which are
determined by the interplay between radiative flaton soft masses and higher
order terms. Then, from the flaton VEVs, we obtain the correct mu term and the
right-handed(RH) neutrino masses for see-saw mechanism. We show that the RH
sneutrino with non-minimal gravity coupling drives inflation, thanks to the
same flaton coupling giving rise to the RH neutrino mass. After inflation,
extra vector-like states, that are responsible for the radiative breaking of
the PQ symmetry, results in thermal inflation with the flaton field, solving
the gravitino problem caused by high reheating temperature. Our model predicts
the spectral index to be n_s\simeq 0.96 due to the additional efoldings from
thermal inflation. We show that a right dark matter abundance comes from the
gravitino of 100 keV mass and a successful baryogenesis is possible via

The unique ethical challenges of conducting research in the rehabilitation medicine population
BACKGROUND: The broad topic of research ethics is one which has been relatively well-investigated and discussed. Unique ethical issues have been identified for such populations as pediatrics, where the issues of consent and assent have received much attention, and obstetrics, with concerns such as the potential for research to cause harm to the fetus. However, little has been written about ethical concerns which are relatively unique to the population of patients seen by the practitioner of rehabilitation medicine. DISCUSSION: This paper reviews unique ethical concerns in conducting research in this population, including decision-making capacity, communication, the potential for subject overuse, the timing of recruitment, hope for a cure and therapeutic misconception and the nature of the health care provider-research subject relationship. SUMMARY: Researchers in the area of rehabilitation medicine should be aware of some of the unique ethical challenges posed by this patient population and should take steps to address any potential concerns in order to optimize subject safety and ensure that studies meet current ethical guidelines and standards
Cosmic strings from pseudo-anomalous Fayet-Iliopoulos U(1) in D3/D7 brane inflation
We examine the consequences of recent developments on Fayet-Iliopoulos (FI)
terms for D-term inflationary models. There is currently no known way to couple
constant FI terms to supergravity consistently; only field-dependent FI terms
are allowed. These are natural in string theory and we argue that the FI term
in D3/D7 inflation turns out to be of this type, corresponding to a
pseudo-anomalous U(1). T he anomaly is canceled by the Green-Schwarz mechanism
in 4 dimensions. Inflation proceeds as usual, except that the scale is set by
the GS parameter. Cosmic strings resulting from a pseudo-anomalous U(1) have
potentially interesting characteristics. Originally expected to be global, they
turn out to be local in the string theory context and can support currents. We
outline the nature of these strings, discuss bounds on their formation, and

Chiral perturbation theory in a magnetic background - finite-temperature effects
We consider chiral perturbation theory for SU(2) at finite temperature in
a constant magnetic background . We compute the thermal mass of the pions
and the pion decay constant to leading order in chiral perturbation theory in
the presence of the magnetic field. The magnetic field gives rise to a
splitting between and as well as between
and . We also calculate the free energy and the
quark condensate to next-to-leading order in chiral perturbation theory. Both
the pion decay constants and the quark condensate are decreasing slower as a
function of temperature as compared to the case with vanishing magnetic field.
The latter result suggests that the critical temperature for the chiral
transition is larger in the presence of a constant magnetic field. The increase
of as a function of is in agreement with most model calculations but
in disagreement with recent lattice calculations.Comment: 24 pages and 9 fig
Kahler Moduli Inflation Revisited
We perform a detailed numerical analysis of inflationary solutions in Kahler
moduli of type IIB flux compactifications. We show that there are inflationary
solutions even when all the fields play an important role in the overall shape
of the scalar potential. Moreover, there exists a direction of attraction for
the inflationary trajectories that correspond to the constant volume direction.
This basin of attraction enables the system to have an island of stability in
the set of initial conditions. We provide explicit examples of these
trajectories, compute the corresponding tilt of the density perturbations power
spectrum and show that they provide a robust prediction of n_s approximately
0.96 for 60 e-folds of inflation.Comment: 27 pages, 9 figure
Status and Trends in Global Ecosystem Services and Natural Capital: Assessing Progress Toward Aichi Biodiversity Target 14
The Convention on Biological Diversity uses six indicators to assess progress toward Aichi Biodiversity Target 14 (ecosystem services), leaving many elements of the target untracked. We identify 13 ecosystem services as directly essential for human well-being, and select a set of 21 datasets as indicators of the state of natural capital underpinning those services, the benefits derived from them, and distribution of access to those benefits. Analysis of these indicators supports previous conclusions that there is no overall progress toward Target 14. Sixty percent of our âbenefitâ indicators have positive trends, whereas 86% of our âstateâ indicators show a decline in natural capital. This suggests that well-being is increasing in the near-term despite environmental degradation, and that unsustainable use of natural capital may fuel human development. As regulating services such as âsoil fertilityâ continue to decline, however, it seems unlikely that this trend can continue without future negative impacts on humanity
