MINIMUM RIGHTS AS A GUARANTEE OF PROTECTION OF POSTED WORKERS IN THE EUROPEAN UNION LAW
Ovim se diplomskim radom, nastoji prikazati kako je kretanje radne snage na unutarnjem tržištu te uživanje temeljnih gospodarskih sloboda utjecalo na razvoj pravne regulative koja uređuje situaciju u kojima je radnik upućen u inozemstvo, tj. u drugu državu članicu radi obavljanja posla za poslodavca iz svoje matične države. U tom kontekstu, fokus se stavlja na Direktivu o upućivanju radnika te razvoj minimalnih prava i sloboda koji sami radnici uživaju. Kako se Direktiva o upućivanju mijenjala kroz povijest i kada je uočena potreba sa njezinom izmjenom te koje su se zloupotrebe u tom smislu pojavile, obrazložit će se kroz sudsku praksu Suda Europske unije i relevantne primjere. Na samome kraju, imajući u obzir trendove upućivanja radnika u okviru pružanja usluga analizirat će se implementacija same regulative u hrvatsko zakonodavstvo.This thesis elaborates how the movement of labour in the internal market and the enjoyment of fundamental economic freedoms influenced the development of legal framework governing the situation where a worker is sent to another Member State to perform work for his/her employer from the home Member State. In this context, the focus will be put on the Directive concerning the posting of workers in the framework of the provision of services and the development of the minimum rights and freedoms that the posted workers enjoy. How did the Directive change over time, what were the main challenges that prompted changes to the legal framework and what are the most common fraudulent and abusive practices are the main issues that will be explained by referring to the relevant case law of the Court of Justice of the European Union.
At the very end, bearing in mind the trends of posting workers to another country within the framework of service provision, the implementation of the Directive into the Croatian legislation will be analysed
