    Moral Philosophy And The Intellectual World Of Justices: The United States Supreme Court, 1860-1910

    The United States Supreme Court during the period between 1860 and 1910 has been portrayed as the source of a laissez-faire style of constitutional interpretation under which the nation and the Court largely abdicated their obligation to protect society\u27s common interests from the ideologically conservative influences of new and powerful economic interests.;Recent trends in legal/intellectual history have moderated this critical view and have begun to rehabilitate the Supreme Court\u27s image by placing it in a more accurately drawn intellectual context. This approach reasserts the role of ideas in shaping the law and reduces that of economic determinism. This thesis extends that trend by examining the powerful influence of antebellum Moral Philosophy, particularly as it was presented in the antebellum Protestant colleges, upon legal theory and practice during the last third of the nineteenth century.;The thesis examines the philosophical public statements and legal opinions of a select group of justices appointed after 1862 who shared exposure to an antebellum college education, to the doctrines of American Protestant theology, and to varying levels of legal education. This examination avoids, as far as practically possible, adopting a legal typology of the subject and adopts instead the typology of nineteenth-century moral science, with a view to illustrating the relationship between American Protestant theology, academic Moral Philosophy, and legal theory. This approach provides a better understanding of late nineteenth-century judicial conservatism in its own terms of reference. It demonstrates that the acceptance by conservative jurists of voluntaristic, moral view of the individual, society, and the economy led them to conclusions concerning individual liberty and responsibility, race and the question of quality, and the role and function of government profoundly different from those of late nineteenth-century reformers. It demonstrates that judicial conservatism had less to do with belief in a gospel of wealth than an attempt to preserve a vision of man and society founded upon moral values

    A Competency-based Approach to Faculty Development

    Background—Faculty development at the Virginia Commonwealth University School of Medicine (VCU SOM) has previously focused on enhancing teaching and learning in the medical and clinical education settings. While this work is important, this narrow focus does not address all facets a faculty member’s role. To broaden their programming, the VCU SOM faculty development team adopted a competency-based approach to the development and planning of faculty development activities. Summary of work—The Senior Associate Dean for Faculty Affairs completed a research project focused on successful medical faculty who promote through the tenure process and advance in their careers. She identified the following categories for success: teaching, service, scholarship, advancing, and leadership. Each of these categories contains action-focused competencies that align with career progression addressing early, mid, and late career stages. The faculty development team adopted the identified competencies to their curriculum development and planning processes. Summary of results—The results of this adoption have been clearer goals for learners, a mapped structure for faculty development activities, and a broader range of topics offered that align with career stages. Discussion—Faculty development activities are now categorized into five (5) categories: Teach, Lead, Serve, Discover, and Advance with each category color coded for easy recognition in event marketing materials. A new logo reflecting these competency categories is now included on all Office of Faculty Affairs communications. Faculty are beginning to recognize and register for activities they need for promotion, tenure, and advancement. Conclusions—The adoption of the competencies for success from the Senior Associate Dean’s study has enriched faculty development offerings providing a recognizable structure allowing faculty to easily identify competency areas for development

    Developing a Culture of Publication: a joint enterprise writing retreat

    Purpose: Many students irrespective of level of study produce excellent course work which, if given support and encouragement could clearly be of a publishable standard. Academic staff are expected to produce quality publications meeting peer review standards although they may be relatively novice authors. All are engaged in some aspects of academic writing practices but not as frequently involved in co-production of publications emanating from student work. This activity is still at the margins of much of the student experience. Design/methodology: Mindful of these issues, we designed and offered a writing programme including a writing retreat. This brought together undergraduate and postgraduate students from a range of applied disciplines (health and art, design and architecture) and their supervisors with the aim of co-producing publications and participating in a community of scholarly practice. The project was delivered over nine months. It involved four days ‘compulsory’ attendance and included a preparatory workshop, a two day off campus writing retreat and a dissemination event. Student and supervisors applied to participate as a team. Kirkpatrick’s (2006) four-stage classic model: reaction, learning, changes in behaviour and real world results was used as a framework for the educational evaluation. Key findings organised thematically were: Supervisor-supervisee relationships; space and time; building confidence enabling successful writing and publication. Originality/Value: This paper will provide an overview of the design, content and approaches used for successful delivery of this innovative project. It will draw on examples that illustrate the different types of joint enterprise that emerged, illuminate experiences of co-production and co-authorship along with recommendations for future ventures

    The Economic Consequences of Increased Disclosure: Evidence From International Cross-Listings

    We examine market behavior around earnings announcements to understand the consequences of the increased disclosure that non-U.S. firms face when listing shares in the U.S. We find that absolute return and volume reactions to earnings announcements typically increase significantly once a company cross-lists in the U.S. Furthermore, these increases are greatest for firms from developed countries and for firms that pursue over-the-counter listings or private placements, which do not have stringent disclosure requirements. Additional tests support the hypothesis that it is changes in the individual firm\u27s disclosure environment, rather than changes in its market liquidity, ownership, or trading venue, that explain our findings

    Exploring Music Beyond the Canon: Radio Orchestras, the CBC and Contemporary Music in the Mid-Twentieth Century

    The emergence of broadcast technology in the twentieth century fundamentally changed how people could experience music. Networks across the world assembled orchestras to serve a variety of functions—background music for dramatic presentations, light entertainment and symphonic concerts. Radio emancipated the orchestral concert from the confines of the concert hall, bringing to the masses a cultural experience which was formerly the domain of the privileged classes. As early as the 1930s, the notion of a radio symphony orchestra—that is, a permanent concert orchestra based in the broadcasting studio—began to emerge. Through unconventional programming philosophies, as well as distinct social and political roles, many of these orchestras gradually acquired identities distinct from traditional symphony orchestras. However, radio symphonies have not received a large amount of scholarly attention. The purpose of this dissertation is to establish the historical context from which radio symphony orchestras emerged, with a specific focus on Canada. My primary focus is the Canadian Broadcasting Corporation and its relationship with twentieth-century music, as seen through the lens of the CBC Symphony Orchestra (1952–1964). The study proceeds in three stages. First, I provide a broad historical overview of the origins of radio symphony orchestras before World War Two, exemplified by the NBC Symphony Orchestra, the Frankfurter Rundfunk-Sinfonie-Orchestra and the BBC Symphony. Second, I look at the emergence of radio orchestras in Canada, and the CBC’s patronage of twentieth-century music in Canada following World War Two. These concepts are brought together in the final section, which focuses on the work of the CBC Symphony. Born as an intended symbol of Canada’s musical achievement, the CBC Symphony regularly featured music from outside the traditional orchestral canon. Not only did this policy introduce modern composition to Canadian listeners, it provided Canadian composers with regular opportunities to write for large orchestras—opportunities which had previously been few and far between, if present at all

    Unhatched Eggs in Nests of Red-cockaded Woodpeckers

    During 1991 and 1992, nests of Red-cockaded Woodpeckers (Picoides borealis) were monitored in the Ouachita National Forest in Scott and Polk counties of west-central Arkansas. Nests in three additional woodpecker areas in Arkansas and Oklahoma were also monitored in 1992. Of 92 eggs laid in 27 nesting attempts in the Ouachita National Forest, 18 (19%) failed to hatch. When viewed in the cavities, six unhatched eggs were noticeably below average in size for the species and eight were average size. Seven unhatched eggs were removed in 1992 from seven nests in Arkansas and Oklahoma; three eggs showed some embryological development and three showed no development. Techniques used to remove unhatched eggs and results of analysis of eggs are presented. Possible management applications of egg data are discussed
