    Setiap negara tentulah memiliki sebuah konstitusi yang pada umumnya digunakan sebagai pedoman pada saat menjalankan roda pemerintahannya. Dalam konstitusi di Indonesia yang menerapkan sistem pemerintahan presidensiil, menggunakan konsep pemisahan kekuasaan (separation of power) antar lembaga yang digunakan dalam rangka menjalankan prinsip pemerintahan dengan checks and balances. Salah satunya adalah terhadap hal pengelolaan keuangan negara yang dituangkan dalam bentuk Anggaran Pendapatan dan Belanja Negara (APBN) setiap tahunnya. UUD NRI 1945 memberikan kewenangan kepada Presiden sebagai lembaga eksekutif dalam mengajukan RAPBN serta memberikan sebuah kewenangan kepada DPR sebagai lembaga legislatif untuk menyetujui RAPBN yang diajukan oleh Presiden. Penyetujuan DPR atas RAPBN dianggap sebagai hal yang krusial dalam pembentukan dan penetapan APBN sehingga dalam tulisan ini akan mengemukakan problematika apabila terjadi penolakan terhadap RAPBN oleh DPR serta upaya yang dapat ditempuh oleh eksekutif dalam menyelesaikan persoalan tersebut. Metode penelitian menggunakan penelitian hokum normatif dan simpulan dari tulisan ini adalah hubungan antara pemerintah dengan DPR berupa hubungan check and balances dan pemerintah dapat mengambil opsi dengan mewujudkan Perpu APBN dalam hal terjadi penolakan RUU APBN oleh DPR

    Pasal 1 angka 7 Undang-Undang Nomor 6 Tahun 2014 tentang Desa menyebutkun bahwa Peraturan Desa adalah peraturan perundang-undangan yang ditetapkan oleh Kepala Desa setelah dibahas dan disepakati bersama Badan Permusyawaratan Desa. Penetapan Peraturan Desa merupakan penjabaran atas berbagai kewenangan yang dimiliki Desa mengacu pada ketentuan peraturan perundang-undangan yang lebih tingg. Sebagai sebuah produk hukum, Peraturan desa tidak boleh bertintangan dengan peraturan yang lebih tinggi dan tidak boleh merugikan kepentingan umum. Peraturan Desa yang mengatur kewenangan Desa berdasarkan hak asal usul dan kewenangan berskala lokal Desa pelaksanaannya diawasi oleh masyarakat Desa dan Badan Permusyawaratan Desa. Hal itu dimaksudkan agar pelaksanaan Peraturan Desa senantiasa dapat diawasi secara berkelanjutan oleh warga masyarakat Desa setempat mengingat Peraturan Desa ditetapkan untuk kepentingan masyarakat Desa. Ketentuan mengenai hak asal usul dijelaskan bahwa "hak asal usul" adalah hak yang merupakan warisan yang masih hidup dan prakarsa Desa atau prakarsa masyarakat Desa sesuai dengan perkembangrn kehidupan masyarakat, antara lain sistem organisasi masyarakat adat, kelembagaan, pranata dan hukum adat, tanah kas Desa, serta kesepakatan dalam kehidupan masyarakat Desa

    Making Model Of Village Regulation Based On Good Village Governance In Indonesia

    In Article 1, Sub-Article 7, Act Number 6 2014 on Villages, it said that the Village Regulation is a regulation stipulated by the Urban Village Head after being discussed and agreed with the Village Consultative Body. The determination of the Village Regulation is an elaboration of the various authorities which are owned by the Village which refers to the provisions of the higher legislation. As a legal product, Village Regulation should not conflict with the higher regulations and should not harm the public interest, or the general interest as mentioned in Act Number 6 2014 on Villages which are: a. the disruption of communal harmony; b. the disruptionof access to public services; c. the disruption of public order and tranquillity; d. the disruption of economic activities to improve the welfare of village communities; and e. the discrimination against tribe, religion, belief, race, intergroup, and gender. Village Regulations govern the village authority based on the right of origin and village local-scale a thority. The implementation is supervised by the village communities and Village Consultative Body. It is intended to make the implementation of the Village Regulation always monitored continuously by local villagers because village regulations are set for the benefit of the village community as a whole. The provisions on the right of origin are explained as "the right of origin" which is a living legacy and the initiative of the village or the initiative of the village’s society in accordance with the development of community life, including indigenous peoples' organisational systems, institutions, customary law, the ground of the village’s treasury, and agreements in village life as well. The meaning of "village-scale local authority" is the authority to regulate and manage the interests of the village community that has is conducted by the village, is able and effective when conducted by the village or what has arisen because of the development of the village and the village community, such as boat moorin s, the village market, public baths, irrigation canals, environmental sanitation, preand postnatal health care and information, art and learning centres, and village libraries, village retention basins, and village roads. In the context of good village governance, the village regulations should reflect: 1) Participation; 2) Law enforcement (rule of law); 3) Transparency; 4) Responsive; 5) Consensus orientation; 6) Equity; 6) Effectiveness and efficiency and 7) Accountability and strategic vision. The ways and mechanisms for the formulation of village regulations that reflect the principles of good village governance will be explained futher in this study, in the pre-establishment stage, establishment stage, and post-establishment stage of village regulations

    Komitmen internasional dalam kerangka pengembangan dinamik upaya pengendalian pemanasan global sudah dimulai sejak tahun l9l9 hingga sekarang. Beberapa instrumen internasional menunjukkan kuatnya komitmen masyarakat global dalam isu-isu lingkungan hidup, pemanasan global serta perubahan iklim. lndonesia sebagai negara yang rentan terhadap perubahan iklim, telah meratifikasi beberapa instrumen internasional tersebut' salah satunya Paris Agreement. Penelitian ini fokus terhadap 2 (dua) hal. Pertama, tentang bagaimana desain perkembangan regulasi pengendalian pemanasan global dan implementasinya baik datam skala nasional maupun internasional. Kedua, mengenai upaya rezim Paris Agreement dalam mengurangi banyaknya dampak negatif yang ditimbulkan dari pemanasan global seperti ketahanan pangan, kesehatan maupun ekonomi.     The Right To Access Banking Data In a Claim For A Divisio Of Combined Assets That Is Filed Separately From A Divorce Claim

    Bank Secrecy remains one of the most essential principles of banking. In Indonesia, however, this principle is not absolute. According to Indonesia regulation, there are several exceptions in implementing Bank Secrecy. In its implementation, these exceptions have yet to adjust to recent social development. One problematic case is when it relates to a claim of combined assets that is filed in conjunction with a claim for divorce. In a recent development, the Constitutional Court has asserted that one of the exceptions for Bank Secrecy can occur for cases of divorce, in its Judgement Number 64/PUU-X/2012. However, this decision has yet to answer a problematic issue when the claim for divorce is filed separately from the claim for the division of combined assets. Such a decision does not consider cases in which the two aforementioned claims are filed separately. This presents a problem for couples who are not Muslim and are confined to divorce laws in which the two claims must be filed separately. Thus, does a claim for the division of combined assets that are filed separately from the claim of divorce fall under the Scope of Constitutional Court Decision Number 64/PUU-X/2012? According to the following research, such cases indeed fall under the scope of Constitutional Court Decision Number 64/PUU-X/2012. This conclusion is based on historical interpretation and Extensive Interpretation. According to historical interpretation, the original intent of the judges in drafting Constitutional Court Decision Number 64/ PUU-X/2012 is to provide both the husband/wife equal share of their wealth. According to extensive interpretation, the concept of filing both claims separately is to an extension of the concept explicitly addressed in such a Constitutional Court decision

    A Chance to Defend Regional Heads in The Procedure of Regional Head Dismissal as A Manifestation of The Proportionality Principle

    The existence of regional autonomy in Indonesia is implemented through regional leaders who have the authority to run local government. When carrying out their duties, regional leaders are supervised by other state institutions as a form of checks and balances in government power. Hence, the procedure to dismiss regional leaders regulates to involve the Regional People's Representative Assembly, the Supreme Court, and the President through the Minister of Home Affairs as a form of right to dismiss. However, the existence of the proportionality principle in the procedure to dismiss regional leaders, through the right given to regional leaders to defend themselves, has yet to be regulated in the law. This article talks about two things: first, the procedure to dismiss regional leaders, and second, the legal consequences and the position of a chance to summon regional leaders to explain and defend themselves in the procedure to dismiss regional leaders. This article aims to find the importance of proportionality principles in the procedure to dismiss regional leaders. The method used in this article is legal research, with statutes, conceptual, and case approaches. The results of this research show that although the procedure to dismiss regional leaders has been regulated in law, applying the proportionality principle only exists in jurisprudences. Hence, an ius constituendum is needed to determine legal consequences and certainty regarding the procedure to dismiss regional leaders
