    Follow That Car! Legal Issues Arising from Installation of Tracking Devices in Leased Consumer Goods and Equipment

    Recent court cases in Connecticut and California have challenged the commercial use of Global Positioning Systems (GPS) for tracking and gathering data about consumers. Specifically, these cases focused on the terms and disclosures contained in automobile rental contracts relating to the use of GPS to monitor the driving patterns of rental car drivers. In response to concerns about consumer privacy, several states have also enacted legislation that addresses the use of tracking technology in the rental car market. This Article examines recent litigation concerning the use of GPS in rental cars and related legislative efforts. Although recent legislation and litigation focuses on the automobile rental industry\u27s use of GPS, similar legal issues may arise in other circumstances where devices containing tracking technology may be leased to consumers or commercial parties. Such devices include cellular telephones, heavy machinery, and other types of tracking and remote technologies such as ignition kill devices

    A faceted eye on intellectual giftedness: Examining the personality of gifted students using FFM domains and facets

    The study examines the personality profile of gifted vs. average-ability students from the perspective of the FFM. The issue was approached by (1) reviewing the literature for well-established personality characteristics of the gifted, (2) establishing correspondences between these traits and FFM domains/facets, and (3) formulating a domain and a facet-level model which were hypothesized to discriminate significantly between gifted and nongifted students. The domain-level model consisted of Openness and Agreeableness. The facet-level model included 14 traits: Anxiety, Impulsiveness, Gregariousness, Assertiveness, Fantasy, Feelings, Aesthetics, Ideas, Compliance, Modesty, Tendermindedness, Order, Achievement, and Deliberation. The models were tested on three samples (N1=515 high-school students, 155 gifted; N2=132 psychology students, 28 gifted; N3=443 psychology students, 91 gifted). Results indicate that the domain-level model does not discriminate significantly between gifted and nongifted students in each sample, whereas the proposed 14-facet model yields a significant discrimination across all samples. The latter model may be further adjusted by removing facets which proved inconsistent or unsubstantial in distinguishing between the two groups. This yields a 7-facet discriminant function, which is also significant across samples, indicating that gifted students are consistently distinguished by a combination of high Ideas, Fantasy, Aesthetics, and Assertiveness, but low Gregariuosness, Modesty, and Tendermindeness.     Profit of Tourism Companies and Their Market Evaluation on ZSE

    The author of this paper presents a statistical analysis of data on realized profits of companies in the tourist sector, whose shares are listed on the Zagreb Stock Exchange and used for active trading. Data on the realized profit for the companies in accounting period 2010 - 2015 is correlated with the prices of shares. Based on the above obtained results about the direction and strength of this correlation the author concludes about the extent to which the market takes into account profit of the companies as a relevant indicator for investments. This information can be extremely significant because, on the one hand, it provides information about the functionality of the market as a comprehensive socio-economic mechanism that anticipates all the available information based on which the prices of the shares are created as a monetary expression of the presumed value of companies. On the other hand, this information tells us about the expectations of active market participants about the future development of the tourism sector, which already accounts for almost 20% of the Croatian GDP. In addition, the author examines what other explanations could be used for the part of variance which is not explained with the correlation between profit and price of shares

    Reliability, construct and criterion-related validity of the Serbian adaptation of the Trait Emotional Intelligence Questionnaire (TEIQue)

    This paper presents evidence on the reliability and validity of the Serbian adaptation of the Trait Emotional Intelligence Questionnaire (TEIQue), an instrument designed to comprehensively assess emotional intelligence conceived as a constellation of emotionrelated self-perceptions. Study participants were 254 adults, who completed the Serbian TEIQue, NEO-FFI, MSCEIT, EQ-short, and RSPWB. The results indicate that the adapted TEIQue is a psychometrically sound assessment tool: internal consistencies were mostly acceptable at facet, generally good at factor, and excellent at whole-scale level; the fourfactor structure was confirmed by means of CFA; convergent-discriminant validity was established through meaningful associations with related constructs, indicating that trait EI is closely aligned with affect and self-efficacy related constructs from the realm of personality (i.e., E, N, C, and Empathy), but shows only moderate overlap with ability EI; finally, incremental validity was demonstrated in the prediction of psychological wellbeing, over and above the Big Five

    THREE SEAS INITIATIVE ā€“ BETWEEN ECONOMIC DIPLOMACY AND GEOPOLITICS

    Inicijativa triju mora kao neformalna politička platforma 12 novijih punopravnih država članica Europske unije, a čiji je glavni cilj realizacija konkretnih projekata u područjima infrastrukture, energetike i digitalizacije, od svog samog nastanka otvorila je brojna ekonomska, politička i geopolitička pitanja. Osim njih, ova inicijativa predstavlja i prvi pravi međunarodni multilateralni iskorak hrvatske gospodarske diplomacije, čime smo uÅ”li u svojevrsni joÅ” neistraženi model djelovanja. Hoće li ona pretvoriti RH u prepoznatljiv subjekt europske gospodarske diplomacije koji stvara nove spone među europskim narodima ili će produbiti već postojeće podjele unutar Europe, glavni je predmet interesa ovoga rada. Autor preispituje stav o tome može li RH kroz Inicijativu triju mora realizirati neke, ili čak sve, projekte iz kataloga projekata koji se odnose na nju. Dodatno, autor provjerava može li ova inicijativa biti izvor za prepoznavanje postojećeg i/ili stvaranje novog hrvatskog (geo)političkog identiteta. Uz to, u ovom radu postavlja se teza kako je hrvatsko sudjelovanje u ovoj Inicijativi objaÅ”njivo i nekim odabirima koje je Hrvatska činila tijekom svoje daljnje i bliže proÅ”losti.The Three Seas initiative, serving as an informal political platform for 12 recently admitted full member states of the European Union, whose main objective is the realization of the substantial projects in the fields of infrastructure, energy and digitization, has, since its very inception, opened numerous economic, political and geopolitical issues. At the same time this Initiative is the first international multilateral step of Croatian economic diplomacy, which is a kind of unexplored action model. Is it going to turn the Republic of Croatia into a recognizable subject of European economic diplomacy that creates new ties between European nations or is it going to deepen the already existing divisions within Europe, is the main subject of this paper. The author reviews the attitude whether the Republic of Croatia can, through the Three Seas Initiative, realize some, or even all, projects related to it. In addition, the author researches if this Initiative can be the source for recognizing the existing geopolitical identity of the Republic of Croatia and/or creating a new one. Additionally, this paper constructs the thesis that Croatiaā€™s participation in this Initiative can possibly be explained by some of the choices that Croatia has made during its remote and recent past

    THE FUNDAMENTAL VALUES OF THE EUROPEAN UNION ā€“ FROM UTOPIA TO REALITY

    U pokuÅ”aju određivanja osnovnih integracijskih pretpostavki za uspjeÅ”nost suživota u novonastajućoj i stalno mijenjajućoj, nadnacionalnoj Europskoj Uniji, zajedničke temeljne vrijednosti koje dijele stanovnici Europe jedan su od najvažnijih čimbenika. U ovom radu želi se procijeniti postoji li u Europskoj Uniji konsenzus oko određivanja sadržaja tih vrijednosti te istražiti primjenjuju li se one i u odlukama koje se svakodnevno donose na razini Europske Unije. Za pretpostavljeno postojeći odmak između političkih ideala kojima se proklamira željeni druÅ”tveni poredak i europske stvarnosti, autor nastoji odrediti uzroke te procijeniti posljedice do kojih takvo stanje može dovesti. Zaključuje da proklamirane temeljne vrijednosti Unije (joÅ”) nemaju svoj realni izraz u europskoj stvarnosti, nego su one (zasada) zamijenjene drugim, ponajprije ekonomskim interesima.In defining the main preconditions for successful coexistence in the emerging and constantly changing supranational European Union, the common fundamental values shared by the European population constitute one of the main factors of this integration. The present article strives to assess whether a consensus exists in the European Union with regard to the substance of these values and to examine whether these values are implemented also in the decisions taken every day at EU level. The author attempts to determine the causes of the assumed disparity between the political ideals proclaiming the desired social order and the European reality, and to envisage the consequences to which this situation may lead. The suggested conclusion is that the proclaimed fundamental values of the Union (still) do not find expression in the European reality and that they are (as yet) substituted by other, primarily economic, interests

    Autor u ovom radu istražuje i analizira povijesne i aktualne podatke o dionicama turističkog sektora na Zagrebačkoj burzi (ZSE) te na temelju toga iznosi moguću procjenu vrijednosti hrvatskog turizma, kao i tezu o tome kako se netransparentnost domaćeg tržiÅ”ta kapitala, te naročito njegova neefikasnost, direktno reflektira i na sektor turizma kao njegovu bitnu sastavnicu. Turizam predstavlja oko 15% ukupne hrvatske ekonomije, s jasnim naznakama da je posrijedi riječ o jednom od rijetkih segmenata u kojem Hrvatska ima stanovit uspjeh te u tom dijelu nacionalne ekonomije bitno napreduje. Time turistički sektor zaslužuje posebnu pažnju na tržiÅ”tu vrijednosnih papira, kojemu je jedan od temeljnih zadataka da na tržiÅ”tu pronađe sredstva za financiranje razvojnih projekata.In this paper the author investigates and analyzes the historical and current data on the shares of the tourism sector on the Zagreb Stock Exchange (ZSE), and on that basis he is trying to estimate the value of entire Croatian tourism. He also argues that the lack of transparency of the domestic capital market, and in particular its inefficiency, is directly reflected on the tourism sector as its significant component. Tourism represents about 15% of the total Croatian economy, with clear indications that it is one of the few segments in which Croatia has certain success, and has significant progress in this part of the national economy. Thereby tourism sector deserves special attention on the securities market, which has one of the fundamental tasks to find funds on the market for financing development projects
