    How Courts Adjudicate Patent Definiteness and Disclosure

    Section 112 of the Patent Act requires patentees to clearly explain what their invention is (a requirement known as claim definiteness), as well as how to make and use it (the disclosure requirements of enablement and written description). Many concerns about the modern patent system stem from these requirements. But despite the critical importance of § 112 to the functioning of the patent system, there is surprisingly little empirical data about how it has been applied in practice. To remedy the reliance on anecdotes, we have created a hand-coded dataset of 1144 reported court decisions from 1982 to 2012 in which U.S. district courts or the Court of Appeals for the Federal Circuit rendered a decision on the enablement, written-description, or claim-definiteness requirements of § 112. We coded validity outcomes under these three doctrines on a novel five-level scale so as to capture significant subtlety in the strength of each decision, and we also classified patents by technology and industry categories. We also coded for a number of litigation characteristics that could arguably influence outcomes. Although one must be cautious about generalizing from reported decisions due to selection effects, our results show some statistically significant disparities in § 112 outcomes for different technologies and industries—although fewer than the conventional wisdom suggests, and not always in the direction that many have believed. Just as importantly, our analysis reveals significant relationships between other variables and § 112 litigation outcomes, including whether a district court or the Federal Circuit made the last decision in a case, whether a patent claim was drafted in means-plus-function format, and whether a case was decided before or after Markman v. Westview Instruments. Our results showing how § 112 has been applied in practice will be helpful in evaluating current proposals for reform, and our rich dataset will enable more systematic studies of these critical doctrines in the future

    Synthetic approaches to cis,cis-1,3,5-triaminocyclohexane (tach) and tach-based ligands

    Cis, cis-1,3,5-triaminocyclohexane (tach) has been synthesized according to various routes, and the methods were evaluated on the basis of product yield, number of steps, and expense of reagents. The conversion of cis, cis-1,3,5-cyclohexanetricarboxylic acid to the desired product by the Curtius rearrangement, as previously described in the literature, was found to be the most suitable procedure based on yield and number of steps. From the standpoint of cost, the reagents of the Curtius rearrangement were derived from inexpensive, commercially available starting materials. The yields of the synthesis are variable, and preliminary studies of yield optimization are described. Three ligands based on the tach framework, tachenPh (N,N\u27,N -tris(2-amino-2-phenylethyl)-cis, cis-1,3,5-triaminocyclohexane), tacheniPr (N,N\u27,N -tris(2-amino-2-isopropylethyl)- cis, cis-1,3,5-triaminocyclohexane), and tachenNMe (N,N\u27,N -tris[2-(methylamino)ethyl)-cis, cis-1,3,5-triaminocyclohexane) were complexed with divalent nickel and copper in solution. The relative ligand field strength of the chelators was assigned for each metal. For most of the cases, an octahedral geometry of the metal-ligand complexes can be inferred based on UV-Vis data, though there is some suggestion of a five-coordinate species for the copper complex of tachenPh. The synthesis of another tach-based ligand, tachENSH (N,N\u27,N -tris(2-mercaptoethyl)-cis, cis-1,3,5-triaminocylcohexane), containing an N3S3 donor set was evaluated. The thiol arms were derived from a prepared active ester and were combined by peptide linkage with three amine frameworks. The frameworks utilized are triaminocyclohexane (tach), ethylenediamine (en) and trans-1,2-diaminocyclohexane (dach). Borane in THF appeared to reduce the prepared amides, however isolation of a borane-free product has not yet proved feasible.     Risky Behaviors in Central Appalachia/Eastern Kentucky: Teen Pregnancy and Sexually Transmitted Infections

    According to the Robert Wood Johnson Foundation (2017), Central Appalachia had a teen birth rate 63% higher than the national rate. In the Big Sandy Region of Kentucky, the teen pregnancy rates per 1,000 females ages 15-19 were Floyd at 55.9, Johnson at 30.3, Magoffin at 57.3, Martin at 50.7, and Pike at 38.2. These were more than double the national rate (16.9) (Centers for Disease Control, 2021). Sexually transmitted infection (STI) rates within the area were also high. Chlamydia increased 200%, and syphilis increased 300% between 2011 and 2017; many of these cases were in young adults (Meehan, 2018). The Big Sandy Optimal Health Teen Pregnancy Prevention Program (TPP) is a targeted program implemented by Mountain Comprehensive Care Center, Inc. to reduce teen pregnancy STIs within the Big Sandy Region. TPP is aimed towards youth ages 10-19 with a focus on high-risk youth. The data presentation will focus on data available as of April 2022.     As Indigenous knowledges and biomedicine come together in healthcare today, to improve health outcomes and strengthen cultural identity among Indigenous Peoples, it is vital for physicians to learn about this convergence during their training. This narrative review article aims to provide practical advice for educators when implementing teaching regarding this topic, using examples from the research literature, and pedagogical and practice-based methods used at the University of Toronto (UofT). The methodology on obtaining the research literature included a search of a computer database called Medline. Moreover, the medical school curriculum information specific to UofT, was obtained through the formal curriculum map and UofT’s Office of Indigenous Medical Education. The following six recommendations provide a way to successfully implement the teachings on Indigenous knowledges and biomedicine, within a culturally-safe Indigenous health curriculum.Alors que les savoirs autochtones et la biomédecine se rejoignent dans les soins de santé aujourd’hui, il est essentiel d’intégrer cette rencontre dans la formation des médecins afin d’améliorer les issues de santé et de renforcer l'identité culturelle des peuples autochtones. À l’aide d’exemples tirés de la littérature et des méthodes pédagogiques et pratiques employées à l'Université de Toronto, la présente revue narrative vise à offrir aux éducateurs des conseils pratiques sur l’intégration de ce sujet dans leur programme. La méthodologie utilisée pour la recherche de littérature scientifique comprenait une consultation de la base de données informatique Medline. Quant aux informations sur le programme d'études de la Faculté de médecine de l’Université de Toronto, elles ont été obtenues par le biais du schéma tutoriel officiel et du Bureau de la formation médicale autochtone de l’université.     An Overview and Examination of the Indian Services Sector

    India’s service sector has grown rapidly since the 1990s. Domestic demand for services has increased as incomes have risen, triggering the expansion of industries such as banking, education, and telecommunications. Exports have also increased rapidly, led by information technology and business process outsourcing (IT-BPO). India’s ability to offer low-cost, high-quality IT-BPO services has made it a world leader in this industry. However, employment in services has not grown as quickly as output. The majority of India’s jobseekers are low-skilled, but demand for workers is growing fastest in higher-skill industries. The supply of highly-skilled workers has not kept pace with demand, causing wages to increase faster for these workers than for lower-skilled ones. India’s government has supported the growth of service industries through a mix of deregulation, liberalization, and incentive programs, such as the Software Technology Parks of India. Nevertheless, burdensome regulations, poor infrastructure, and foreign investment restrictions continue to affect service firms’ ability to do business. USITC analysis suggests that additional liberalization would lead to an increase in India’s imports of services

    The Value of Jointly Held Conferences: Benefits and Considerations for Planners and Participants

    University faculty and staff regularly participate in academic conferences as part of their professional responsibilities, yet the literature on their value is scarce, especially when examining conferences held jointly by two associations. Research is needed to help association leaders, planning committees, and attendees make informed decisions about conference organization and participation. This paper highlights the benefits and challenges of a jointly held academic conference for participants, association leaders, and organizational liaisons. In June of 2016, two Cooperative Extension associations, the National Association of Community Development Extension Professionals (NACDEP) and the Association of Natural Resource Extension Professionals (ANREP), jointly held a conference in Burlington, VT. Surveys were administered to conference participants, planning committee members, and liaisons at the United States Department of Agriculture National Institute of Food and Agriculture (NIFA) to collect data immediately following the conference and six months later. Using the Community Capitals Framework (CCF) to organize evaluation results, the authors discuss the benefits and challenges of planning, sponsoring, and attending the conference from the perspectives of these different groups. The authors focus on three community capitals: human capital, social capital, and cultural capital. Based on the findings, they offer recommendations for future evaluation of jointly held academic conferences

    Intersectionality of Non-normative Identities in the Cultures of Engineering Survey

    This is a survey measuring students\u27 attitudes and beliefs in engineering. The survey was distributed at four institutions across the U.S. in the fall semester of 2015. Students in first semester first-year engineering courses were surveyed on a paper-and-pencil instrument as part of a larger study. We collected 2,916 valid student responses that were digitized by the research group and audited for accuracy. Validity evidence for this survey has been document in ASEE conference proceedings
