ТИПОВЫЕ НАРУШЕНИЯ ПРИ РАЗМЕЩЕНИИ ГОСУДАРСТВЕННОГО ЗАКАЗА ГОРОДА МОСКВЫ, ПРОБЛЕМЫ ВЫЯВЛЕНИЯ И КВАЛИФИКАЦИИ

Methodological problems of violations detection under the Moscow government procurement are expounded. The great attention is paid to a qualification of these violations in compliance with the requirements of the Code of Administrative Offences of the Russian Federation. The authors conduct the research of common violations in Moscow government order and their causes. The consequences of these violations for Moscow budget are detected. A differentiated approach to estimation of administrative offences according the social danger of committed offence in government order is offered. An exercise of supervisory powers using scheduled, unscheduled check-outs (on the ground of appeals, complaints and the others) and administrative proceedings is considered.В статье излагают методологические проблемы выявления нарушений в сфере государственного заказа города Москвы. Основное внимание сосредоточено на квалификации выявленных нарушений в соответствии с требованиями Кодекса Российской Федерации об административных правонарушений. Проводится исследование типовых нарушений в госзаказе города Москвы и причины их возникновения. Выявлены последствия по типовым нарушениям для бюджета города Москвы. Предлагается дифференцированный подход к оценке правонарушения: по степени общественной опасности совершенного правонарушений в сфере госзаказа. Рассматривается осуществление контрольных полномочий путем плановых, внеплановых проверок (на основании обращений, жалоб и другой информации), а также административного расследования

Выявлены возможности в сфере государственного регулирования, которыми обладает субъект Федерации - Москва. Исследована проблема трансформации существующих контрактных механизмов для формирования модели государственной контрактной системы
