    E-sports is a new and growing form of entertainment, where gamers at the peak level of their skill compete for prestige and prizes. The contracts these athletes have are evident of a problem within the legal field of the right of publicity: there are few, if any, protections for individuals who want to license their right of publicity. The growth of E-sports has shown us the caveat emptor approach taken by courts does not adequately protect the licensee from having their privacy intruded upon. Adopting a set of standards for licensing the right of publicity would protect the privacy of the licensee, and let them control their identity as they see fit

    Laboratory Performance Comparison of Vortecone Inertial Dust Scrubber to Flooded-Bed Dust Scrubber

    Increasing incidence of Black Lung disease in miners since the early 1990s has concerned law makers and the mining industry. New regulations promulgated by MSHA in 2014 lowered the permissible limit of dust exposure of underground workers. The hazards of respirable coal dust have been common knowledge throughout the mining industry since the enactment of the 1969 Federal Coal Mine Health and Safety Act, and many administrative controls have been put in place since its enactment. The purpose of this thesis is to analyze the performance of a Vortecone scrubber, used in the automotive industry to remove paint overspray from the air, for removing coal dust with an emphasis on respirable coal dust. Comparisons are made to a very effective scrubbing technology already in use in many underground coal mines, a flooded-bed scrubber system. This system is typically mounted on a continuous miner, and used to scrub contaminated air of unwanted particulate matter. Per the results of this study, a Vortecone appears to remove a greater amount of respirable dust from an airstream than a flooded-bed scrubber, and carries with it several operational advantages which are discussed

    The applicability of self-regulation theories in sport : goal adjustment capacities, stress appraisals, coping and well-being among athletes

    Objectives: We examined a model, informed by self-regulation theories, which included goal adjustment capacities, appraisals of challenge and threat, coping, and well-being. Design: Prospective. Methods: Two hundred and twelve athletes from the United Kingdom (n = 147) or Australia (n = 65), who played team (n = 135) or individual sports (n = 77), and competed at international (n = 7), national (n = 11), county (n = 67), club (n = 84), or beginner (n = 43) levels participated in this study. Participants completed measures of goal adjustment capacities and stress appraisals two days before competing. Athletes also completed questions on coping and well-being within three hours of their competition ending. Results: The way an athlete responds to an unattainable goal is associated with his or her well-being in the period leading up to and including the competition. Goal reengagement positively predicted well-being, whereas goal disengagement negatively predicted well-being. Further, goal reengagement was positively associated with challenge appraisals, which in turn was linked to task-oriented coping, and task-oriented coping positively associated with well-being. Conclusion: When highly-valued goals become unattainable, consultants could encourage athletes to seek out alternative approaches to achieve the same goal or help them develop a completely new goal

    Challenging the Randomness of Panel Assignment in the Federal Courts of Appeals

    A fundamental academic assumption about the federal courts of appeals is that the three-judge panels that hear cases have been randomly configured. Scores of scholarly articles have noted this “fact,” and it has been relied on heavily by empirical researchers. Even though there are practical reasons to doubt that judges would always be randomly assigned to panels, this assumption has never been tested. This Article fill this void by doing so. To determine whether the circuit courts utilize random assignment, we have created what we believe to be the largest dataset of panel assignments of those courts constructed to date. Using this dataset, we tested whether panel assignments are, in fact, random by comparing the actual assignments to truly random panels generated by code that we have created to simulate the panel generation process. Our results show evidence of non-randomness in the federal courts of appeals. To be sure, the analysis here is descriptive, not explanatory or normative. We do not ourselves mean to suggest that “perfect randomness” is a desirable goal. We are simply testing an existing assumption and believe these findings will have implications for empirical researchers and court scholars more generally

The definitive version was published in Integrative and Comparative Biology 53 (2013): 118-130, doi:10.1093/icb/ict024.The circadian clock is a molecular network that translates predictable environmental signals, such as light levels, into organismal responses, including behavior and physiology. Regular oscillations of the molecular components of the clock enable individuals to anticipate regularly fluctuating environmental conditions. Cnidarians play important roles in benthic and pelagic marine environments, and also occupy a key evolutionary position as the likely sister group to the bilaterians. Together, these attributes make members of this phylum attractive as models for testing hypotheses on role for circadian clocks in regulating behavior, physiology, and reproduction as well as those regarding the deep evolutionary conservation of circadian regulatory pathways in animal evolution. Here, we review and synthesize the field of cnidarian circadian biology by discussing the diverse effects of daily light cycles on cnidarians, summarizing the molecular evidence for the conservation of a bilaterian-like circadian clock in anthozoan cnidarians, and presenting new empirical data supporting the presence of a conserved feed-forward loop in the starlet sea anemone, Nematostella vectensis. Furthermore, we discuss critical gaps in our current knowledge about the cnidarian clock, including the functions directly regulated by the clock and the precise molecular interactions that drive the oscillating gene-expression patterns.
